A Guide To All 50 States"},"content":{"rendered":"<p>Last year ended on a very high note for the cannabis industry. In late December, from behind the Resolute Desk in the Oval Office, President Donald Trump signed an executive order directing the Attorney General to <a href=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2025\/12\/18\/president-trump-to-reschedule-cannabis-as-less-dangerous-drug\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2025\/12\/18\/president-trump-to-reschedule-cannabis-as-less-dangerous-drug\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/willyakowicz\/2025\/12\/18\/president-trump-to-reschedule-cannabis-as-less-dangerous-drug\/\" aria-label=\"complete the marijuana rescheduling process\" rel=\"nofollow noopener\">complete the marijuana rescheduling process<\/a> in the \u201cmost expeditious manner.\u201d <\/p>\n<p>The aim of Trump\u2019s executive order is to reclassify marijuana as a less dangerous drug, which would be the most significant change to the nation\u2019s drug laws since President Nixon signed the Controlled Substances Act in 1970. The change in classification will not legalize weed, but it will give the cannabis industry <a href=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2021\/04\/30\/state-legal-cannabis-companies-pays-insane-tax-rates-thanks-to-a-minnesota-speed-dealer\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2021\/04\/30\/state-legal-cannabis-companies-pays-insane-tax-rates-thanks-to-a-minnesota-speed-dealer\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/willyakowicz\/2021\/04\/30\/state-legal-cannabis-companies-pays-insane-tax-rates-thanks-to-a-minnesota-speed-dealer\/\" aria-label=\"a big tax break\" rel=\"nofollow noopener\">a big tax break<\/a> worth billions of dollars.<\/p>\n<p>While the $32 billion cannabis industry rejoiced at the historic move, the process will not be quick. Marijuana is still categorized as a Schedule I drug, alongside heroin and LSD. If the federal government completes the process, marijuana will be reclassified as a Schedule III drug, which is used for drugs with accepted medical benefits that still have addiction potential, including steroids, ketamine and Tylenol with codeine.<\/p>\n<p>Schedule III drugs, however, are still considered controlled substances, which means restrictions will remain on cannabis\u2019 manufacture, sales and possession. And the patchwork of regulated markets across 40 states that allow medical sales and 25 that permit recreational sales will still be in conflict with federal law. The timeline for rescheduling cannabis remains murky as Attorney General Pam Bondi has not made a public comment on the process. <\/p>\n<p>Despite that promise for the industry, 2025 also delivered a major buzzkill for marijuana\u2019s cannabis cousin, hemp. In early November, Kentucky Senator Mitch McConnell added an amendment to the Agriculture Appropriations section of the minibus spending bill to re-open the federal government, ending the longest shutdown in history, to effectively <a href=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2025\/11\/13\/28-billion-hemp-industry-faces-extinction-with-government-re-opening\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2025\/11\/13\/28-billion-hemp-industry-faces-extinction-with-government-re-opening\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/willyakowicz\/2025\/11\/13\/28-billion-hemp-industry-faces-extinction-with-government-re-opening\/\" aria-label=\"ban the $28 billion intoxicating hemp industry\" rel=\"nofollow noopener\">ban the $28 billion intoxicating hemp industry<\/a>. The junior senator from Kentucky, Rand Paul, launched an unsuccessful vote to block the ban, which will go into effect this November unless new legislation is introduced.  Earlier this week, Rep. Morgan Griffith of Virginia and Rep. Marc Veasey of Texas introduced a bill that would <a href=\"https:\/\/morgangriffith.house.gov\/news\/documentsingle.aspx?DocumentID=405576\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/morgangriffith.house.gov\/news\/documentsingle.aspx?DocumentID=405576\" data-ga-track=\"ExternalLink:https:\/\/morgangriffith.house.gov\/news\/documentsingle.aspx?DocumentID=405576\" aria-label=\"regulated hemp products\">regulated hemp products<\/a>.<\/p>\n<p>In addition to the giant uncertainty of hemp\u2019s future, there are some serious obstacles for the cannabis industry to get over. For instance, there are well-funded campaigns in three states, Arizona, Massachusetts and Maine, to repeal recreational cannabis sales. There is also resistance against the rescheduling effort as one group opposed to it has hired Bill Barr, Trump\u2019s former attorney general, to file a suit if and when Attorney General Pam Bondi files a final rule to reschedule the drug.  <\/p>\n<p>\u201cThe takeaway is that the marijuana reform movement is at a crossroads and the movement is facing some serious headwinds,\u201d says Paul Armentano, the deputy director of nonprofit cannabis legalization advocacy group NORML.  \u201cHow the movement responds to those distinct situations is really going to define whether we continue to move the ball forward in 2026 and beyond, or whether we begin to lose momentum and slip backward.\u201d <\/p>\n<p>Coupled with the fact that there has not been a state to legalize adult-use sales since 2023, when Ohio voters chose to legalize marijuana, Armentano says he does not have \u201ca lot of optimism at this point\u201d when it comes to more states legalizing. \u201cLooking forward, I\u2019m not convinced the prospects are strong for this year,\u201d he adds. <\/p>\n<p>That said, there could be more state-level progress in the year ahead. Here\u2019s where the cannabis map could expand in 2026.<\/p>\n<p>Florida<\/p>\n<p>Legalizing recreational marijuana sales could make its way back to the Sunshine State\u2019s ballot in November, but it will be <a href=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2024\/08\/22\/inside-the-battle-over-cannabis-legalization-in-florida\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2024\/08\/22\/inside-the-battle-over-cannabis-legalization-in-florida\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/willyakowicz\/2024\/08\/22\/inside-the-battle-over-cannabis-legalization-in-florida\/\" aria-label=\"another uphill battle\" rel=\"nofollow noopener\">another uphill battle<\/a>. In 2024, despite President Trump giving his support, <a href=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2024\/11\/05\/what-the-failure-of-floridas-amendment-3--means-for-cannabis-legalization\/\" target=\"_self\" class=\"color-link\" title=\"https:\/\/www.forbes.com\/sites\/willyakowicz\/2024\/11\/05\/what-the-failure-of-floridas-amendment-3--means-for-cannabis-legalization\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/willyakowicz\/2024\/11\/05\/what-the-failure-of-floridas-amendment-3--means-for-cannabis-legalization\/\" aria-label=\"the ballot measure failed\" rel=\"nofollow noopener\">the ballot measure failed<\/a> to get the necessary 60% of the vote and did not pass. A <a href=\"https:\/\/floridapolitics.com\/archives\/774324-florida-chamber-poll-shows-support-for-legalizing-pot-crashing-to-4-year-low\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/floridapolitics.com\/archives\/774324-florida-chamber-poll-shows-support-for-legalizing-pot-crashing-to-4-year-low\/\" data-ga-track=\"ExternalLink:https:\/\/floridapolitics.com\/archives\/774324-florida-chamber-poll-shows-support-for-legalizing-pot-crashing-to-4-year-low\/\" aria-label=\"new poll\">new poll<\/a> found that support for legalizing recreational sales decreased to 51%, a four-year low.  <\/p>\n<p>Hawaii <\/p>\n<p>Hawaii was the first state to legalize medical marijuana through the state legislature in 2000 but has not been able to legalize a recreational market. The state\u2019s lawmakers tried to pass adult-use in 2024, but the bill passed by the Senate died in committee. There is now a push to get the issue approved as a ballot measure. <\/p>\n<p>\u201cThat certainly tells me that proponents are not of the opinion that they have the votes in the legislature to get this done, and they&#8217;re trying to find an end run around the legislature,\u201d says Armentano. <\/p>\n<p>Pennsylvania<\/p>\n<p>The Keystone State legalized medical marijuana in 2016 and Democratic Governor Josh Shapiro, the state\u2019s former attorney general, is in favor of legalizing recreational cannabis. Every state bordering Pennsylvania has legalized adult-use cannabis, except for West Virginia which has a <a href=\"https:\/\/omc.wv.gov\/rules\/Pages\/default.aspx#:~:text=%E2%80%8B%E2%80%8B%E2%80%8B%E2%80%8B%E2%80%8B,%3A%20pill%3B%20oil%3B%20topical%20forms\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" class=\"color-link\" title=\"https:\/\/omc.wv.gov\/rules\/Pages\/default.aspx#:~:text=%E2%80%8B%E2%80%8B%E2%80%8B%E2%80%8B%E2%80%8B,%3A%20pill%3B%20oil%3B%20topical%20forms\" data-ga-track=\"ExternalLink:https:\/\/omc.wv.gov\/rules\/Pages\/default.aspx#:~:text=%E2%80%8B%E2%80%8B%E2%80%8B%E2%80%8B%E2%80%8B,%3A%20pill%3B%20oil%3B%20topical%20forms\" aria-label=\"strict and limited medical program\">strict and limited medical program<\/a>. But so far, efforts have failed and there is not enough support bipartisan support to get it done.<\/p>\n<p>\u201cUntil there is a real bipartisan effort on the part of Democrats and Republicans, any effort there is going to stall,\u201d says Armentano. \u201cThat&#8217;s not to say that in the future, the two parties might not work together on a consensus bill, but that hasn&#8217;t happened yet, and I&#8217;ve seen no indication of any sort of breakthrough on the horizon.\u201d<\/p>\n<p>Virginia <\/p>\n<p>Virginia legalized recreational marijuana for those 21 and over in 2021, but the state still does not have a legal market set up thanks to former Republican Governor Glenn Youngkin\u2019s multiple vetoes.
