The complaint alleges that the Army&#13;<br \/>\nfailed to keep Diaz and other female soldiers safe at Fort Hood&#13;<br \/>\ndespite having notice of a string of similar assaults against women&#13;<br \/>\non base in the months before Diaz&#8217;s attack.<\/p>\n<p>Mayra Diaz is represented in the matter by <a href=\"https:\/\/sanfordheisler.com\/team\/christine-dunn\/\" target=\"_blank\" rel=\"nofollow noopener\">Christine Dunn<\/a>, Sanford Heisler&#8217;s Co-Chair&#13;<br \/>\nof the firm&#8217;s <a href=\"https:\/\/sanfordheisler.com\/sexual-violence-title-ix-victims-rights\/\" target=\"_blank\" rel=\"nofollow noopener\">Sexual Violence, Title IX, and Victims&#8217; Rights&#13;<br \/>\nPractice Group<\/a>, as well as <a href=\"https:\/\/sanfordheisler.com\/team\/jillian-seymour\/\" target=\"_blank\" rel=\"nofollow noopener\">Jillian Seymour<\/a>, Associate.<\/p>\n<p>The FTCA is a federal statute that permits individuals to bring&#13;<br \/>\nlegal claims against federal agencies for torts committed by their&#13;<br \/>\nemployees. Prior to filing an FTCA complaint in court, the&#13;<br \/>\nindividual must first file an administrative complaint with the&#13;<br \/>\nagency at fault. The agency is then afforded at least six months to&#13;<br \/>\ninvestigate the claim. After that, the individual may file a&#13;<br \/>\nlawsuit against the agency in federal court.<\/p>\n<p>Today, Sanford Heisler took the first step in the FTCA legal&#13;<br \/>\nprocess by filing an administrative complaint against the Army on&#13;<br \/>\nbehalf of Diaz. The complaint claims Clarke attacked five Fort Hood&#13;<br \/>\nfemale soldiers in the span of 18 months, from March 2021 until his&#13;<br \/>\narrest in October 2022. The complaint alleges that Clarke knocked&#13;<br \/>\non the door of Diaz&#8217;s Fort Hood barracks&#8217; room on the&#13;<br \/>\nevening of July 15, 2022. Upon seeing Clarke&#8217;s uniform through&#13;<br \/>\nher peephole, Diaz opened her door to him, at which point Clarke&#13;<br \/>\nrevealed a handgun and forced entry into her room. The complaint&#13;<br \/>\nasserts that Clarke then tied Diaz&#8217;s arms above her head with&#13;<br \/>\ntactical cord, blindfolded her, and raped her. Clarke additionally&#13;<br \/>\nwaterboarded her, strangled her with a lamp cord, and stepped on&#13;<br \/>\nher neck in an attempt to kill her. The complaint further alleges&#13;<br \/>\nthat Clarke stole Diaz&#8217;s valuables before exiting her room.&#13;<br \/>\nDiaz remained semi-unconscious on her bed for over 24 hours before&#13;<br \/>\nbeing discovered by concerned friends and taken to the hospital for&#13;<br \/>\nlife-threatening injuries. Clarke was eventually arrested in&#13;<br \/>\nOctober 2022 after his fifth and final victim escaped his grasp,&#13;<br \/>\nleading to his apprehension. During Clarke&#8217;s subsequent court&#13;<br \/>\nmartial in the spring of 2025, Diaz learned that Clarke had&#13;<br \/>\nsimilarly attacked three other female soldiers in the Fort Hood&#13;<br \/>\nbarracks in the months preceding her attack.<\/p>\n<p>On April 24, 2025, after three weeks of court-martial&#13;<br \/>\nproceedings, Clarke was convicted of 29 separate specifications,&#13;<br \/>\nincluding attempted premeditated murder, rape, and kidnapping. He&#13;<br \/>\nwas sentenced to life in prison. He was serving his life sentence&#13;<br \/>\nat the United States Disciplinary Barracks in Fort Leavenworth,&#13;<br \/>\nKansas when he was found dead in his prison cell on September 19,&#13;<br \/>\n2025 due to apparent suicide.<\/p>\n<p>The complaint alleges that the Army&#8217;s negligence facilitated&#13;<br \/>\nClarke&#8217;s brutal attack on Diaz. The complaint asserts that,&#13;<br \/>\nprior to Diaz&#8217;s assault, the Army was aware of a string of&#13;<br \/>\nsimilar attacks against female soldiers but nonetheless failed to&#13;<br \/>\nwarn the Fort Hood community or bolster security measures in the&#13;<br \/>\nbarracks. The complaint further alleges that Army leadership&#13;<br \/>\ncultivated an environment at Fort Hood plagued with rampant sexual&#13;<br \/>\nviolence against women, creating an unreasonable risk that Diaz and&#13;<br \/>\nother female soldiers would experience harm. Multiple reports name&#13;<br \/>\nFort Hood as one of the most dangerous Army bases for female&#13;<br \/>\nsoldiers.<\/p>\n<p>Sanford Heisler is currently representing multiple other victims&#13;<br \/>\nof sexual misconduct at Fort Hood and other military facilities. On&#13;<br \/>\nDecember 15, 2025, Sanford Heisler filed FTCA complaints against&#13;<br \/>\nthe Army on behalf of seven Jane Does, all of whom were sexually&#13;<br \/>\nabused or non-consensually videotaped by Army doctor Blaine McGraw&#13;<br \/>\nduring medical appointments at the Darnall Army Medical Center in&#13;<br \/>\nFort Hood, Texas and the Tripler Army Medical Center in Honolulu,&#13;<br \/>\nHawaii. The Army has ignored the&#13;<br \/>\ndangers threatening women at Fort Hood for too long, creating an&#13;<br \/>\nenvironment of inexcusable risks to women&#8217;s safety.
