FORT HOOD, Texas, Jan. 20, 2026 (GLOBE NEWSWIRE<\/a>) \u2014 Attorneys at Sanford Heisler
\nSharp McKnight<\/a> (“Sanford Heisler”) today filed a
\nFederal Tort Claims Act (“FTCA”) administrative complaint
\nagainst the United States Department of the Army (“the
\nArmy”) on behalf of Mayra Diaz, who was violently raped and
\nattacked by former Sergeant Greville Clarke in the Fort Hood
\nbarracks on July 15, 2022. The complaint alleges that the Army
\nfailed to keep Diaz and other female soldiers safe at Fort Hood
\ndespite having notice of a string of similar assaults against women
\non base in the months before Diaz’s attack.<\/p>\n

The FTCA is a federal statute that permits individuals to bring
\nlegal claims against federal agencies for torts committed by their
\nemployees. Prior to filing an FTCA complaint in court, the
\nindividual must first file an administrative complaint with the
\nagency at fault. The agency is then afforded at least six months to
\ninvestigate the claim. After that, the individual may file a
\nlawsuit against the agency in federal court.<\/p>\n

Today, Sanford Heisler took the first step in the FTCA legal
\nprocess by filing an administrative complaint against the Army on
\nbehalf of Diaz. The complaint claims Clarke attacked five Fort Hood
\nfemale soldiers in the span of 18 months, from March 2021 until his
\narrest in October 2022. The complaint alleges that Clarke knocked
\non the door of Diaz’s Fort Hood barracks’ room on the
\nevening of July 15, 2022. Upon seeing Clarke’s uniform through
\nher peephole, Diaz opened her door to him, at which point Clarke
\nrevealed a handgun and forced entry into her room. The complaint
\nasserts that Clarke then tied Diaz’s arms above her head with
\ntactical cord, blindfolded her, and raped her. Clarke additionally
\nwaterboarded her, strangled her with a lamp cord, and stepped on
\nher neck in an attempt to kill her. The complaint further alleges
\nthat Clarke stole Diaz’s valuables before exiting her room.
\nDiaz remained semi-unconscious on her bed for over 24 hours before
\nbeing discovered by concerned friends and taken to the hospital for
\nlife-threatening injuries. Clarke was eventually arrested in
\nOctober 2022 after his fifth and final victim escaped his grasp,
\nleading to his apprehension. During Clarke’s subsequent court
\nmartial in the spring of 2025, Diaz learned that Clarke had
\nsimilarly attacked three other female soldiers in the Fort Hood
\nbarracks in the months preceding her attack.<\/p>\n

On April 24, 2025, after three weeks of court-martial
\nproceedings, Clarke was convicted of 29 separate specifications,
\nincluding attempted premeditated murder, rape, and kidnapping. He
\nwas sentenced to life in prison. He was serving his life sentence
\nat the United States Disciplinary Barracks in Fort Leavenworth,
\nKansas when he was found dead in his prison cell on September 19,
\n2025 due to apparent suicide.<\/p>\n

The complaint alleges that the Army’s negligence facilitated
\nClarke’s brutal attack on Diaz. The complaint asserts that,
\nprior to Diaz’s assault, the Army was aware of a string of
\nsimilar attacks against female soldiers but nonetheless failed to
\nwarn the Fort Hood community or bolster security measures in the
\nbarracks. The complaint further alleges that Army leadership
\ncultivated an environment at Fort Hood plagued with rampant sexual
\nviolence against women, creating an unreasonable risk that Diaz and
\nother female soldiers would experience harm. Multiple reports name
\nFort Hood as one of the most dangerous Army bases for female
\nsoldiers.<\/p>\n

Sanford Heisler is currently representing multiple other victims
\nof sexual misconduct at Fort Hood and other military facilities. On
\nDecember 15, 2025, Sanford Heisler filed FTCA complaints against
\nthe Army on behalf of seven Jane Does, all of whom were sexually
\nabused or non-consensually videotaped by Army doctor Blaine McGraw
\nduring medical appointments at the Darnall Army Medical Center in
\nFort Hood, Texas and the Tripler Army Medical Center in Honolulu,
\nHawaii. Sanford Heisler additionally represents numerous
\nsurvivor-servicemembers who were sexually abused by Army doctor
\nMichael Stockin at Joint Base Lewis McChord in Tacoma, Washington,
\nas well as multiple former cadets who were sexually abused and
\nharassed while at the Coast Guard Academy.<\/p>\n

“What happened to my client is horrific \u2013 no one
\nshould ever have to endure what she went through. But it’s made
\neven worse knowing that her attack could have been prevented if the
\nArmy had taken reasonable measures to protect her and others on
\nbase,” said Dunn. “Our servicemembers make so many
\nsacrifices to protect our country, the least the Army can do is
\nkeep them safe in their own barracks.”<\/p>\n

“Time and again we have seen female soldiers at Fort Hood
\nexperience preventable sexual violence. The Army has ignored the
\ndangers threatening women at Fort Hood for too long, creating an
\nenvironment of inexcusable risks to women’s safety. Ms. Diaz is
\na victim of not only Greville Clarke but also of the Army’s
\nrefusal to act,” said Seymour. “By filing this complaint,
\nwe are hoping to finally hold the Army accountable for the violence
