Arnold & Porter was named to Law360’s list of
\n“Legal Lions Of The Week<\/a>” after the U.S.
\nSupreme Court ruled unanimously in favor of Arnold & Porter
\nclient Harold Berk, holding that Delaware’s affidavit of merit
\nrequirement does not apply in federal court because it conflicts
\nwith the Federal Rules of Civil Procedure.<\/p>\n

With its judgment on January 20, the Court overturned rulings
\nfrom the district court and the Third Circuit, which dismissed Mr.
\nBerk’s medical negligence suit for failure to comply with
\nDelaware’s statute requiring plaintiffs in certain medical
\nnegligence cases to submit, at the pleading stage, an affidavit
\nfrom a medical expert attesting to the merits of the claim.<\/p>\n

The Court’s decision also clarifies the interaction between
\nstate procedural statutes and the Federal Rules and reaffirms that
\nfederal pleading standards control in federal court.<\/p>\n

“The Court’s ruling reflects Arnold & Porter’s
\nstrength in litigating complex issues and distilling complicated
\ncases into a few propositions that are clear, principled, and
\nbroadly compelling,” said Arnold & Porter Appellate &
\nSupreme Court counsel Andrew Tutt, who argued the case before the
\nCourt. “The last time the Court considered this issue, it
\nresulted in a three-way split without a majority. In this case, the
\ndecision was unanimous.”<\/p>\n
