{"id":446559,"date":"2026-02-03T12:59:07","date_gmt":"2026-02-03T12:59:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/446559\/"},"modified":"2026-02-03T12:59:07","modified_gmt":"2026-02-03T12:59:07","slug":"red-and-blue-states-move-further-apart-on-immigration-enforcement-npr","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/446559\/","title":{"rendered":"Red and blue states move further apart on immigration enforcement : NPR"},"content":{"rendered":"<p>            <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/02\/1770123547_694_.jpeg\" data-template=\"https:\/\/npr.brightspotcdn.com\/dims3\/default\/strip\/false\/crop\/5500x3667+0+0\/resize\/{width}\/quality\/{quality}\/format\/{format}\/?url=http%3A%2F%2Fnpr-brightspot.s3.amazonaws.com%2Fa7%2F6b%2Ff6c28dd84dbba0c42389db8f987d%2Fgettyimages-2255697899.jpg\" class=\"img\" alt=\"Students cheer during a school walkout to protest federal immigration enforcement at the State Capitol building on January 14, 2026, in St. Paul, Minnesota.\" fetchpriority=\"high\"\/><\/p>\n<p>\n                Students cheer during a school walkout to protest federal immigration enforcement at the State Capitol building on January 14, 2026, in St. Paul, Minnesota.<\/p>\n<p>                    Stephen Maturen\/Getty Images North America<\/p>\n<p>                hide caption\n            <\/p>\n<p>            toggle caption<\/p>\n<p>        Stephen Maturen\/Getty Images North America<\/p>\n<p>The deaths of Renee Macklin Good and Alex Pretti have shaken up the conversation about how states should respond to immigration crackdowns across the country.<\/p>\n<p>Some Democratic leaders have vowed to hold federal Immigration and Customs Enforcement officers accountable \u2014 even charging them with crimes.<\/p>\n<p>After an ICE surge in Chicago last year, state leaders established the <a href=\"https:\/\/ilac.illinois.gov\/about-ilac\/commission-leadership.html\" target=\"_blank\" rel=\"nofollow noopener\">Illinois Accountability Commission<\/a> to collect evidence from citizens about ICE&#8217;s actions, including the agency&#8217;s leadership, and to make accountability recommendations.<\/p>\n<p>The chair of the commission and former federal judge, Rub\u00e9n Castillo, says the group is having conversations with local law enforcement to &#8220;suggest prosecutions that should be coming as we speak.&#8221;<\/p>\n<p>Prosecutors <a href=\"https:\/\/billypenn.com\/2026\/01\/28\/krasner-fafo-ice-prosecutors-democracy-constitution\/\" target=\"_blank\" rel=\"nofollow noopener\">in Philadelphia<\/a> and California say they are also considering criminal charges against federal agents.<\/p>\n<p>   Can states charge federal agents with crimes?\u00a0   <\/p>\n<p>White House officials have raised the idea of agents having immunity when they&#8217;re on the job, but legal experts say that is not the case.<\/p>\n<p>&#8220;There is no structural or blanket barrier to states bringing a criminal prosecution against federal officials,&#8221; says Harrison Stark, an attorney who works with the University of Wisconsin Law School&#8217;s State Democracy Research Initiative.<\/p>\n<p>&#8220;If a state believes that a federal official has violated state criminal law,&#8221; Stark says, &#8220;the state has broad Investigatory Powers to collect evidence, to explore that criminal action, basically in the same way they would against anybody else.&#8221;<\/p>\n<p>And it&#8217;s not just about criminal prosecutions; Illinois has a law on the books that <a href=\"https:\/\/chicago.suntimes.com\/immigration\/2025\/12\/09\/illinois-immigration-law-ice-dhs-courthouses-lawsuits\" target=\"_blank\" rel=\"nofollow noopener\">allows people to sue federal agents in civil court<\/a>. The Trump administration has sued to block the law, saying it violates federal powers. Democratic lawmakers in New York, California, Colorado and Oregon are considering similar laws.<\/p>\n<p>   Republican-led states lean into enforcement   <\/p>\n<p>After Trump took office last year, many red states jumped to support the president&#8217;s mass deportation efforts.<\/p>\n<p>In Tennessee, the state <a href=\"https:\/\/wpln.org\/post\/how-tennessees-governor-plans-to-help-with-trumps-mass-deportations\/\" target=\"_blank\" rel=\"nofollow noopener\">provides grants to law enforcement agencies<\/a> that work with ICE. Since that was passed last year, the number of sheriff&#8217;s offices and police departments that have <a href=\"https:\/\/www.wkrn.com\/news\/tennessee-politics\/surge-law-enforcement-partnerships-ice\/\" target=\"_blank\" rel=\"nofollow noopener\">signed a formal agreement with ICE<\/a> has skyrocketed.<\/p>\n<p>Now, Republican lawmakers in the state are considering making that voluntary program involuntary as part of a bigger immigration package. <a href=\"https:\/\/www.lpm.org\/news\/2026-01-14\/kentucky-gop-bills-would-require-locals-to-work-with-ice-ban-sanctuary-policies\" target=\"_blank\" rel=\"nofollow noopener\">Kentucky<\/a> lawmakers are moving in the same direction.<\/p>\n<p>This year, Tennessee is <a href=\"https:\/\/wpln.org\/post\/tennessee-to-pilot-white-house-immigration-agenda-at-state-level\/\" target=\"_blank\" rel=\"nofollow noopener\">piloting legislation<\/a> made in partnership with Steven Miller, Trump&#8217;s deputy chief of staff for policy, and the White House.<\/p>\n<p>One of the policies would make it impossible for someone without legal status to buy a car, earn a nursing certificate or receive any government benefits. (Many government benefits are already off-limits to people living in the country illegally.) &#8220;We&#8217;re not spending taxpayer dollars on you unless you&#8217;re in jail,&#8221; is how Cameron Sexton, the Republican Tennessee House Speaker, explained it when announcing the legislation.<\/p>\n<p>The Indiana Senate last week passed a measure that would tighten requirements for local agencies, including universities, to cooperate with immigration enforcement. Last month, <a href=\"https:\/\/www.nhpr.org\/nh-news\/2025-12-30\/anti-sanctuary-city-bills-nh-new-hampshire-immigration\" target=\"_blank\" rel=\"nofollow noopener\">New Hampshire<\/a> took a page out of Tennessee&#8217;s book by banning sanctuary cities. Meaning, cities can&#8217;t impede federal immigration officers from carrying out their duties.<\/p>\n<p>   Blue states limiting ICE cooperation   <\/p>\n<p>Some Democratic-led states are considering <a href=\"https:\/\/www.npr.org\/2026\/01\/30\/nx-s1-5686778\/states-look-at-banning-masked-agents-but-local-police-have-doubts\" target=\"_blank\" rel=\"nofollow noopener\">mask bans or ID requirements<\/a> for federal agents. California&#8217;s law on that is currently <a href=\"https:\/\/www.kqed.org\/news\/12058936\/masking-bill-fuels-california-legal-battle-over-federal-immigration-agents\" target=\"_blank\" rel=\"nofollow noopener\">tied up in court<\/a>.<\/p>\n<p>Illinois has a law limiting police cooperation with ICE that lawmakers say they want to expand this year. Last week, New York Gov. Kathy Hochul <a href=\"https:\/\/gothamist.com\/news\/hochul-seeks-to-end-local-ny-law-enforcement-agreements-with-ice-citing-tyranny\" target=\"_blank\" rel=\"nofollow noopener\">announced legislation<\/a> to do that, too.<\/p>\n<p>Maine has set up a <a href=\"https:\/\/www.mainepublic.org\/immigration\/2026-01-26\/maine-attorney-general-creates-email-tip-line-for-alleged-ice-abuses\" target=\"_blank\" rel=\"nofollow noopener\">tipline to report<\/a> ICE activity and abuses.<\/p>\n<p>Democrats in other states, including Massachusetts, are looking at <a href=\"https:\/\/www.wgbh.org\/news\/local\/2026-01-29\/healey-seeks-to-limit-courthouse-immigration-arrests-cooperation-with-ice\" target=\"_blank\" rel=\"nofollow noopener\">creating &#8220;safe zones&#8221;<\/a> around courthouses, schools, churches and hospitals <a href=\"https:\/\/calmatters.org\/politics\/2026\/01\/democrats-immigration-legislation\/\" target=\"_blank\" rel=\"nofollow noopener\">where agents are not allowed to make arrests<\/a>.<\/p>\n<p>In a couple of weeks, the Minnesota legislature will meet for the first time since the ICE surge there.
