{"id":44679,"date":"2025-07-29T08:44:07","date_gmt":"2025-07-29T08:44:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/44679\/"},"modified":"2025-07-29T08:44:07","modified_gmt":"2025-07-29T08:44:07","slug":"employers-warn-labors-push-to-lock-in-penalty-rates-is-bad-for-business-but-its-not-that-simple","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/44679\/","title":{"rendered":"Employers warn Labor\u2019s push to lock in penalty rates is bad for business \u2013 but it\u2019s not that simple"},"content":{"rendered":"<p>The Albanese government is pushing ahead with <a href=\"https:\/\/www.abc.net.au\/news\/2025-07-24\/labor-seeks-to-legislate-to-protect-penalty-rates\/105565016\" rel=\"nofollow noopener\" target=\"_blank\">new legislation<\/a> to protect <a href=\"https:\/\/www.pm.gov.au\/media\/government-moves-enshrine-penalty-rates-protection#:%7E:text=It%20will%20ensure%20the%20wages,the%20Opposition%20and%20the%20Greens.%E2%80%9D\" rel=\"nofollow noopener\" target=\"_blank\">penalty rates and overtime<\/a> for about 2.6 million workers under the <a href=\"https:\/\/www.fairwork.gov.au\/employment-conditions\/awards\" rel=\"nofollow noopener\" target=\"_blank\">award system<\/a>. Those workers are more likely to be female, younger and work casual or part-time.<\/p>\n<p>Penalty rates are higher rates of pay to compensate for working overtime or at unsociable hours, such as weekends, late nights or public holidays. <\/p>\n<p>Australia is not unique in having penalty rates. Other countries, especially in Europe, have <a href=\"https:\/\/www.eurofound.europa.eu\/system\/files\/2022-03\/ef21025en.pdf\" rel=\"nofollow noopener\" target=\"_blank\">similar arrangements<\/a>. It\u2019s less common in the United States and the United Kingdom.<\/p>\n<p>But while penalty rates and overtime may be good for workers, they\u2019re bad for business \u2013 right?<\/p>\n<p>Surprisingly, it\u2019s not that simple. Past experience in Australia and overseas shows that when workers\u2019 pay or conditions get worse, it can end up creating headaches for business \u2013 especially those facing worker shortages. <\/p>\n<p>What the government\u2019s proposing<\/p>\n<p>The Albanese government\u2019s <a href=\"https:\/\/parlinfo.aph.gov.au\/parlInfo\/download\/legislation\/ems\/r7335_ems_6a80246a-bac9-4c88-af6c-74e6fd56cefb\/upload_pdf\/JC016337.pdf;fileType=application%2Fpdf#search=%22legislation\/ems\/r7335_ems_6a80246a-bac9-4c88-af6c-74e6fd56cefb%22\" rel=\"nofollow noopener\" target=\"_blank\">Protecting Penalty and Overtime Rates bill<\/a> would enshrine a new \u201c<a href=\"https:\/\/ministers.dewr.gov.au\/rishworth\/protecting-penalty-rates-top-government-priority-parliament-resumes\" rel=\"nofollow noopener\" target=\"_blank\">high-level principle<\/a>\u201d into the Fair Work Act. <\/p>\n<p>It\u2019s designed to <a href=\"https:\/\/ministers.dewr.gov.au\/rishworth\/protecting-penalty-rates-top-government-priority-parliament-resumes\" rel=\"nofollow noopener\" target=\"_blank\">override<\/a> cases currently before Australia\u2019s workplace relations regulator, the <a href=\"https:\/\/www.fwc.gov.au\/\" rel=\"nofollow noopener\" target=\"_blank\">Fair Work Commission<\/a>, where industry is pushing for greater flexibility on penalty rates and overtime.<\/p>\n<p>If passed, the bill would <a href=\"https:\/\/ministers.dewr.gov.au\/rishworth\/protecting-penalty-rates-top-government-priority-parliament-resumes\" rel=\"nofollow noopener\" target=\"_blank\">stop<\/a> the Fair Work Commission from allowing penalty or overtime rates to be \u201crolled up\u201d into a single rate of pay \u201cwhere it leaves any individual employee worse off\u201d.<\/p>\n<p>The Coalition says <a href=\"https:\/\/online.lnp.org.au\/news\/ignorance-isn-t-a-policy-as-small-businesses-collapse\" rel=\"nofollow noopener\" target=\"_blank\">more consultation<\/a> with small business is needed. But there are <a href=\"https:\/\/www.theaustralian.com.au\/nation\/politics\/labor-set-to-secure-penalty-rate-protections-as-greens-signal-support\/news-story\/ee2d54c0be3b23713216bc5f5ce3461c\" rel=\"nofollow noopener\" target=\"_blank\">signs<\/a> the Greens could support the bill, which would be enough for parliament to pass it.<\/p>\n<p>The industries most affected by Labor\u2019s proposed change include retail, hospitality, care and clerical work, where many workers are \u201c<a href=\"https:\/\/www.fwc.gov.au\/documents\/wage-reviews\/2022-23\/profile-of-employee-characteristics-across-modern-awards-2023-03-03.pdf#page=13.17\" rel=\"nofollow noopener\" target=\"_blank\">award reliant<\/a>\u201d, or who often work at irregular or unsociable hours. <\/p>\n<p>The government <a href=\"https:\/\/parlinfo.aph.gov.au\/parlInfo\/download\/legislation\/ems\/r7335_ems_6a80246a-bac9-4c88-af6c-74e6fd56cefb\/upload_pdf\/JC016337.pdf;fileType=application%2Fpdf#search=%22legislation\/ems\/r7335_ems_6a80246a-bac9-4c88-af6c-74e6fd56cefb%22\" rel=\"nofollow noopener\" target=\"_blank\">argues<\/a> the bill does not prevent awards from being made more flexible for employers \u2013 provided workers are not financially disadvantaged.<\/p>\n<p>Unions <a href=\"https:\/\/www.news.com.au\/finance\/work\/at-work\/labor-to-introduce-new-bill-to-protect-penalty-overtime-rates-for-26-million-award-workers\/news-story\/23c335b1c859394fbad226518ae28632?amp\" rel=\"nofollow noopener\" target=\"_blank\">support<\/a> Labor\u2019s bill. They <a href=\"https:\/\/www.actu.org.au\/media-release\/unions-welcome-bill-to-protect-penalty-rates-for-2-6-million-workers\/\" rel=\"nofollow noopener\" target=\"_blank\">say<\/a> workers on awards are typically in lower-paid roles, where penalty rates form a significant part of their take-home pay. <\/p>\n<p>Why business is concerned<\/p>\n<p>Earlier this year, the Australian Retailers Association and employers including Woolworths, Coles and Kmart <a href=\"https:\/\/www.abc.net.au\/news\/2025-02-21\/supermarket-push-to-scrap-penalty-rates-opposed-by-government\/104962994\" rel=\"nofollow noopener\" target=\"_blank\">proposed<\/a> letting retail managers opt in for a <a href=\"https:\/\/www.fwc.gov.au\/documents\/awards\/variations\/2024\/am20249-ors-sub-ara-250325.pdf\" rel=\"nofollow noopener\" target=\"_blank\">salary pay rise of up to 35%<\/a>, while trading off penalty rates, overtime and rest breaks. <\/p>\n<p>While that proposal relates to managerial staff, some are concerned it could set a precedent for those arrangements to be extended to non-managerial workers. (The retailers\u2019 association <a href=\"https:\/\/www.retail.org.au\/media\/penalty-rates-bill-undermines-choice-flexibility-and-remuneration-for-employees-and-employers\" rel=\"nofollow noopener\" target=\"_blank\">says<\/a> \u201cit never sought to remove penalty rates from the award\u201d for those not wanting to opt in.)<\/p>\n<p>This followed employers seeking similar changes to <a href=\"https:\/\/www.afr.com\/work-and-careers\/workplace\/push-to-end-penalty-rates-for-it-finance-workers-after-wfh-boom-20250312-p5lixd\" rel=\"nofollow noopener\" target=\"_blank\">banking and clerical awards<\/a>, affecting around 2 million workers. <\/p>\n<p>The Australian Industry Group says Labor\u2019s new bill is a \u201c<a href=\"https:\/\/www.aigroup.com.au\/news\/media-centre\/2025\/penalty-rates-plan-is-a-union-thought-bubble-that-will-kill-jobs\/\" rel=\"nofollow noopener\" target=\"_blank\">union thought bubble that will kill jobs<\/a>\u201d and<\/p>\n<p>Labor should trust the independent umpire [the Fair Work Commission [\u2026]] to set fair terms for awards, not simply change the rules to ensure unions get their way.<\/p>\n<p>Others warn it <a href=\"https:\/\/www.ragtrader.com.au\/news\/retailers-berate-heavy-handed-penalty-rates-bill\" rel=\"nofollow noopener\" target=\"_blank\">denies employees choice<\/a> about how they\u2019re paid, and will undermine workplace productivity \u2013 just when the government is <a href=\"https:\/\/theconversation.com\/view-from-the-hill-how-much-can-jim-chalmers-get-out-of-the-economic-reform-roundtable-261095\" rel=\"nofollow noopener\" target=\"_blank\">trying to improve it<\/a>.<\/p>\n<p>Does cutting penalty rates create jobs?<\/p>\n<p>For decades, employer groups have pushed for more flexibility to cut penalty rates, while unions have fought to keep them.<\/p>\n<p>What can we learn from those past clashes?<\/p>\n<p>We don\u2019t have to look back far. In 2017, the Fair Work Commission <a href=\"https:\/\/theconversation.com\/explainer-where-to-from-here-on-penalty-rates-73694\" rel=\"nofollow noopener\" target=\"_blank\">decided<\/a> to reduce Sunday and public holiday penalty rates for more than 700,000 workers covered by the retail, hospitality, fast food and pharmacy awards. <\/p>\n<p>In that case, the Fair Work Commission agreed with employer groups that these reductions would create more jobs. <\/p>\n<p>However, that conclusion did not bear fruit. <\/p>\n<p>In 2019, researchers Martin O\u2019Brien and Ray Markey analysed employment data and did a survey (with union funding) of more than 1,800 employees and 200 owner-managers in retail and hospitality. Their <a href=\"https:\/\/theconversation.com\/cutting-penalty-rates-was-supposed-to-create-jobs-it-hasnt-and-heres-why-not-117178\" rel=\"nofollow noopener\" target=\"_blank\">analysis<\/a> found no evidence of jobs being created by the 2017 penalty rates reduction.<\/p>\n<p>A 2017 report from the Australian Institute\u2019s Centre for Future Work <a href=\"https:\/\/futurework.org.au\/wp-content\/uploads\/sites\/2\/2022\/11\/Tip_of_the_Iceberg.pdf\" rel=\"nofollow noopener\" target=\"_blank\">estimated<\/a> the additional income generated by penalty rates adds $14 billion each year to the economy, which boosts aggregate demand. So when penalty rates are cut, there can also be consequences for the wider economy.<\/p>\n<p>And arrangements exchanging penalty rates for higher base salaries have often led employees to be worse off overall \u2013 <a href=\"https:\/\/www.afr.com\/work-and-careers\/workplace\/court-whacks-cba-with-record-10m-fine-for-wage-theft-20240215-p5f589\" rel=\"nofollow noopener\" target=\"_blank\">in some cases, substantially so<\/a>.<\/p>\n<p>When workers do better, business often does too<\/p>\n<p>While workers are most likely to suffer when penalty rates are cut, there may also be negative consequences for employers. <\/p>\n<p>The hospitality and retail industries, where workers are among <a href=\"https:\/\/www.fwc.gov.au\/documents\/wage-reviews\/2022-23\/profile-of-employee-characteristics-across-modern-awards-2023-03-03.pdf#page=13.17\" rel=\"nofollow noopener\" target=\"_blank\">the most award-reliant<\/a>, are also <a href=\"https:\/\/www.abs.gov.au\/statistics\/labour\/earnings-and-working-conditions\/employee-earnings\/latest-release#industry\" rel=\"nofollow noopener\" target=\"_blank\">the lowest paid<\/a>. Both industries are characterised by <a href=\"https:\/\/www.abs.gov.au\/statistics\/labour\/jobs\/job-vacancies-australia\/latest-release#industry\" rel=\"nofollow noopener\" target=\"_blank\">persistently high job vacancies<\/a>. <\/p>\n<p>My research with Susan Belardi and Angela Knox on the hospitality industry <a href=\"https:\/\/www.smh.com.au\/business\/workplace\/restaurateurs-better-served-improving-conditions-than-complaining-20201208-p56lm4.html\" rel=\"nofollow noopener\" target=\"_blank\">found<\/a> pay competitiveness is important for attracting and retaining workers \u2013 and addressing job vacancies. <\/p>\n<p><a href=\"https:\/\/sydney.edu.au\/content\/dam\/corporate\/documents\/business-school\/research\/work-and-organisational-studies\/towards-a-durable-future-report.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Other Australian studies<\/a> point to uncompetitive pay contributing to worker shortages.<\/p>\n<p>The <a href=\"https:\/\/www.oecd.org\/content\/dam\/oecd\/en\/publications\/reports\/2019\/11\/negotiating-our-way-up_16bd8a10\/1fd2da34-en.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Organisation for Economic Co-operation and Development<\/a> (OECD) has found collective bargaining \u2013 rather than individuals negotiating their own pay \u2013 can: <\/p>\n<p>benefit not only workers, but also firms, as lower turnover and longer tenure can reduce hiring and training costs and increase productivity. <\/p>\n<p>Other <a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/pdf\/10.1111\/j.1467-8543.2009.00726.x\" rel=\"nofollow noopener\" target=\"_blank\">international research<\/a> also shows sector-wide agreements with workers can help drive greater business productivity.<\/p>\n<p>The evidence suggests that without penalty rates, not only would workers be disadvantaged, but business problems relating to worker shortages and productivity might end up worse than before.<\/p>\n<p>Correction: an earlier version of this article included Bunnings among the retailers proposing an optional change to pay and penalty rates, however this is not the case.
