<\/p>\nCivil rights lawyers are trying to land a temporary restraining order against Florida\u2019s \u201cAlligator Alcatraz\u201d detention center, alleging that detainees\u2019 constitutional rights are being violated.<\/p>\n
The lawyers claimed during a virtual hearing in Miami federal court Monday that detainees at the Trump administration\u2019s prized detention facility have been denied legal counsel, have had their bond hearings canceled, and are being held without charges.<\/p>\n

Civil rights lawyers filed a lawsuit claiming that <\/p>\n
Eunice Cho, an attorney for the American Civil Liberties Union Foundation, called<\/a> it an \u201cemergency situation.\u201d<\/p>\n \u201cOfficers at \u2018Alligator Alcatraz\u2019 are going around trying to force people to sign deportation orders without the ability to speak to counsel,\u201d she said.<\/p>\n Monday\u2019s hearing addressed a July 16 lawsuit filed by civil rights lawyers that stated that it was \u201cvirtually impossible\u201d for attorneys to get in contact with detainees, let alone contest their detention in immigration court.<\/p>\n \u201cThe government\u2019s restrictions on attorney-client communication at Alligator Alcatraz inhibit detainees\u2019 ability to meaningfully access and communicate with legal counsel, impinge upon attorney-client privilege, and violate detainees\u2019 constitutional rights under the First Amendment,\u201d the suit read<\/a>.<\/p>\n Homeland Security Secretary Kristi Noem said she was working at \u201cturbo speed\u201d to deliver on Trump’s mass deportation plans. \/ Andrew Caballero-Reynolds\/AFP via Getty Images<\/p>\n \u201cThese restrictions also violate the Organizational Plaintiffs\u2019 First Amendment rights to speak to their clients,\u201d it added. \u201cThe government\u2019s restrictions on detainees\u2019 ability to file documents and motions with the immigration court violate the Fifth Amendment right to due process.\u201d<\/p>\n The attorneys noted that lawyers have been unable to file bond petitions for detainees because the immigration court has no jurisdiction over their clients.<\/p>\n The suit added that detainees then \u201ceffectively have no way to contest their detention.\u201d<\/p>\n As such, the civil rights lawyers demanded that state and federal officials find an immigration court that had jurisdiction over their clients.<\/p>\n Trump-appointed U.S. District Judge Rodolfo Ruiz said that he would not allow the court to be transformed <\/p>\n Trump-appointed U.S. District Judge Rodolfo Ruiz said during Monday\u2019s hearing that his job was only to address any proven constitutional violations, warning that any \u201cattempts to transform the court into the warden of \u2018Alligator Alcatraz\u2019 is not going to happen here.\u201d<\/p>\n He didn\u2019t come to a decision by the end of the hearing and instead asked the attorneys to refile their complaint as a request for a preliminary injunction.<\/p>\n He set the next in-person court hearing for Aug. 18.<\/p>\n Nicholas Meros, an attorney representing Florida Gov.
