{"id":45374,"date":"2025-07-29T15:36:08","date_gmt":"2025-07-29T15:36:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/45374\/"},"modified":"2025-07-29T15:36:08","modified_gmt":"2025-07-29T15:36:08","slug":"legal-group-files-brief-to-support-blocking-law-banning-books-from-iowa-k-12-schools","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/45374\/","title":{"rendered":"Legal group files brief to support blocking law banning books from Iowa K-12 schools"},"content":{"rendered":"<p class=\"text | article-text\">DES MOINES, Iowa (<a href=\"https:\/\/iowacapitaldispatch.com\/2025\/07\/28\/legal-group-files-brief-to-support-blocking-law-banning-books-from-iowa-k-12-schools\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/iowacapitaldispatch.com\/2025\/07\/28\/legal-group-files-brief-to-support-blocking-law-banning-books-from-iowa-k-12-schools\/\">IOWA CAPITAL DISPATCH<\/a>) &#8211; A legal organization focused on freedom of expression filed a new legal brief Monday asking the Eighth Circuit Court of Appeals to keep the injunction in place blocking Iowa\u2019s ban on books that are not \u201cage appropriate\u201d from K-12 schools.<\/p>\n<p class=\"text | article-text\">PEN America, a nonprofit focused on freedom of expression, filed the brief in support of the legal challenge mounted by publishers including Penguin Random House, the Iowa State Education Association and several authors, including Laurie Halse Anderson, John Green and Jodi Picoult. The plaintiffs are challenging <a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ga=90&amp;ba=SF496\" rel=\"nofollow noopener\" target=\"_blank\">Senate File 496<\/a>, a 2023 Iowa law that prohibits books depicting sex acts from being available in K-12 school libraries, as well as banning programs, materials and instruction related to gender identity and sexual orientation for K-6 students.<\/p>\n<p class=\"text | article-text\">U.S. District Court Judge Stephen Locher has ruled to block enforcement of multiple portions of the law, including the prohibition on books involving sexual or LGBTQ+ content. But that injunction could be overturned by the Eight Circuit Court of Appeals, which <a href=\"https:\/\/iowacapitaldispatch.com\/2024\/08\/09\/injunction-lifts-on-iowa-law-restricting-books-in-k-12-school-libraries\/\" rel=\"nofollow noopener\" target=\"_blank\">had ruled in August 2024<\/a> that Locher\u2019s \u201canalysis\u201d of the case was not correct and returned it to the district court.<\/p>\n<p class=\"text | article-text\">PEN America argued in its brief for the appeals court to keep the latest injunction in place, saying the law \u201cundermines public education systems in violation of the First Amendment by denying students\u2019 rights to receive information, infringing on authors\u2019 free speech rights, and misapplying the obscenity doctrine.\u201d<\/p>\n<p class=\"text | article-text\">\u201cThe law requires the removal of hundreds of books from public school libraries regardless of the age of the student reader or the books\u2019 value as a whole \u2014 both of which considerations are required by the First Amendment,\u201d the brief states.<\/p>\n<p class=\"text | article-text\">Iowa public schools had removed 3,400 books from school shelves by the end of 2024, according to <a href=\"https:\/\/www.desmoinesregister.com\/story\/news\/education\/2024\/06\/06\/books-banned-in-iowa-3400-include-to-kill-a-mockingbird-and-1984\/73643557007\/\" rel=\"nofollow noopener\" target=\"_blank\">the Des Moines Register<\/a>, including classic literature like \u201c1984\u201d by George Orwell, \u201cThe Bluest Eye\u201d by Toni Morrison and \u201cI Know Why the Caged Bird Sings\u201d by Maya Angelou. Many school districts have expressed uncertainty about what books can be available in schools under the law, as the Iowa Department of Education had <a href=\"https:\/\/iowacapitaldispatch.com\/2023\/08\/03\/iowa-department-of-education-does-not-commit-to-clarifying-k-12-book-restriction-rules\/\" rel=\"nofollow noopener\" target=\"_blank\">declined to respond<\/a> to advocates asking for more clarification about \u201cage appropriate\u201d materials as defined by SF 496.<\/p>\n<p class=\"text | article-text\">Locher wrote the law \u201cplaces the burden on local school districts and school officials to determine whether a book is permitted,\u201d and that the measure was \u201cfacially unconstitutional\u201d when looking at previous court precedents on First Amendment cases.<\/p>\n<p class=\"text | article-text\">In the Monday court brief, PEN America staff attorney Elly Brinkley echoed these concerns, writing that laws that target any and all descriptions of sex in literature have been \u201csquarely condemned\u201d by the U.S. courts in previous decisions, as it abridges students\u2019 First Amendment rights to receive information.<\/p>\n<p class=\"text | article-text\">Elly Brinkley, PEN America staff attorney, said in a statement: \u201cThis sweeping Iowa law robs young people of literary classics that have offered sustenance and meaning to generations of readers. These restrictions deprive Iowa students of books that help them understand the world in which we live. We cannot allow a vocal minority of censorship proponents (to) have the final say over what tens of thousands of students can read in school.\u201d<\/p>\n<p class=\"text | article-text\">In addition to the lawsuit filed by Penguin Random House, ISEA and authors, there is another challenge filed by Lambda Legal and ACLU of Iowa on behalf of students, teachers and the organization Iowa Safe Schools. The action is based on the law\u2019s ban on books and material available in school libraries and classrooms, in addition to challenging the ban on \u201cany program, curriculum, test, survey, questionnaire, promotion, or instruction relating to gender identity or sexual orientation to students in kindergarten through grade six.\u201d<\/p>\n<p class=\"text | article-text\">Locher <a href=\"https:\/\/iowacapitaldispatch.com\/2025\/05\/16\/court-again-blocks-key-elements-of-iowas-school-book-ban\/\" rel=\"nofollow noopener\" target=\"_blank\">ruled in May<\/a> that parts of the law challenged by Lambda Legal and the ACLU are also unconstitutional, issuing an injunction in May ruling that K-6 students must be allowed to join Gender Sexuality Alliances (GSA) and other student groups related to LGBTQ+ identities and that school districts and teachers must be allowed to provide instruction and materials that contain references to gender identity and sexual orientation, though they cannot be focused on these topics.<\/p>\n<p class=\"copyright |\">Copyright 2025 IOWA CAPITAL DISPATCH.
