{"id":453982,"date":"2026-02-07T06:36:09","date_gmt":"2026-02-07T06:36:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/453982\/"},"modified":"2026-02-07T06:36:09","modified_gmt":"2026-02-07T06:36:09","slug":"appeals-court-greenlights-trump-admin-policy-of-detaining-undocumented-immigrants-without-opportunity-to-seek-release","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/453982\/","title":{"rendered":"Appeals court greenlights Trump admin policy of detaining undocumented immigrants without opportunity to seek release"},"content":{"rendered":"<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbr89bw001z27p8ekvg6ajp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A divided federal appeals court on Friday ruled in favor of the Trump administration\u2019s <a href=\"https:\/\/www.cnn.com\/2025\/07\/20\/politics\/immigration-enforcement-deportations-budget\" rel=\"nofollow noopener\" target=\"_blank\">policy of detaining millions of undocumented immigrants<\/a>, even those who have been living in the US for decades, without the opportunity to challenge their detention, handing President Donald Trump a major win as he seeks to carry out an aggressive deportation campaign.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira00073b6pxnqncy3u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca5.227192\/gov.uscourts.ca5.227192.507860231.1.pdf\" target=\"_blank\" rel=\"nofollow noopener\">2-1 ruling<\/a> from the conservative 5th US Circuit Court of Appeals means that in several southern states, scores of immigrants who had been living in the US unlawfully, including those who were previously allowed to remain out on bond as their case made its way through the immigration system, can now be detained and denied the opportunity to seek their release through bond hearings before immigration judges.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira00083b6p0z8mrjvs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In thousands of cases around the country, federal judges had consistently ruled that the policy Trump rolled out last year was unlawful, but Friday\u2019s decision marks the first time an appeals court has backed it. The ruling only applies to immigrants in Texas, Louisiana and Mississippi.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira00093b6pqhv7kbig@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThere\u2019s a reason why, across more than three thousand cases in dozens of federal district courts, the Trump administration decided to have its first appeal of a loss on this issue go to the Fifth Circuit,\u201d said Steve Vladeck, CNN Supreme Court analyst and professor at Georgetown University Law Center, who has <a href=\"https:\/\/www.stevevladeck.com\/p\/195-the-immigration-detention-flood?r=1uo2gq&amp;utm_campaign=post&amp;utm_medium=web\" target=\"_blank\" rel=\"nofollow noopener\">previously written<\/a> about the legal dispute in these cases.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira000a3b6p2ux7gi5m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe Fifth Circuit isn\u2019t just the most right-leaning appeals court in the country; the government drew on this panel two of that right-leaning court\u2019s most right-leaning judges. It\u2019s hard to imagine they\u2019re going to get the last word,\u201d he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira000b3b6p9x8jvbr9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Though other appeals courts around the US are still examining the policy, the 5th Circuit\u2019s ruling tees up a likely showdown over it at the Supreme Court.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira000c3b6p8a0pqrw3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Friday\u2019s majority decision was authored by Judge Edith Jones, an appointee of former President Ronald Reagan, and joined by Judge Kyle Duncan, a Trump appointee.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira000d3b6p2vqhmyby@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The two Republican appointees said that while the Trump administration had reversed decades of executive branch policy of allowing immigrants to remain out on bond while their immigration cases proceeded, current officials were well within their authority to make the switch.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira000e3b6pkhnochda@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThat prior administrations decided to use less than their full enforcement authority \u2026 does not mean they lacked the authority to do more,\u201d Jones wrote.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmlbs4ira000f3b6p1kswp3dy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Under prior administrations, noncitizens who had entered the US illegally, were later apprehended away from the border and had no criminal history were able to be released on bond while their immigration cases unfolded. That longstanding policy contrasted with how immigrants who were detained at the border were treated.
