{"id":455352,"date":"2026-02-07T23:55:09","date_gmt":"2026-02-07T23:55:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/455352\/"},"modified":"2026-02-07T23:55:09","modified_gmt":"2026-02-07T23:55:09","slug":"toddler-hospitalized-with-respiratory-failure-was-returned-to-ice-detention-and-denied-prescribed-medication-lawsuit-says","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/455352\/","title":{"rendered":"Toddler hospitalized with respiratory failure was returned to ICE detention and denied prescribed medication, lawsuit says"},"content":{"rendered":"<p id=\"anchor-7b3a1e\" class=\"body-graf\">An 18-month-old baby held with her parents at<a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/kids-texas-immigration-facility-nightmares-school-food-dilley-ice-rcna257473\" target=\"_blank\" rel=\"nofollow noopener\"> a South Texas immigration detention center<\/a> became so ill last month that she was rushed to a hospital with life-threatening respiratory failure \u2014 then sent back to detention days later, where she was denied daily medication doctors prescribed, according to a federal lawsuit filed Friday.<\/p>\n<p id=\"anchor-bcc335\" class=\"body-graf\">The toddler, Amalia, remained in detention for another nine days and was released only after lawyers filed an emergency habeas corpus petition in federal court challenging her continued confinement. She was freed Friday after the filing.<\/p>\n<p id=\"anchor-443910\" class=\"body-graf\">Amalia had been healthy before immigration officers arrested her family in El Paso in December and transferred them to the Dilley Immigration Processing Center, a remote, prisonlike facility where hundreds of immigrant children are held with their parents. Advocates and pediatric experts have warned that conditions at the center are unsafe for young children.<\/p>\n<p id=\"anchor-8dfa4d\" class=\"body-graf\">Amalia\u2019s health quickly deteriorated, the lawsuit says. On Jan. 18, she was rushed to a children\u2019s hospital in San Antonio, where doctors treated her for pneumonia, Covid-19, RSV and severe respiratory distress.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/02\/260207-Amalia-ch-1449-5323ba.jpg\" alt=\"Amalia.\" height=\"2500\" width=\"2002\"\/>Amalia spent 10 days at a hospital before being returned to immigration detention, according to a federal lawsuit.via Elora Mukherjee<\/p>\n<p id=\"anchor-d911e9\" class=\"body-graf\">\u201cShe was at the brink of dying,\u201d said Elora Mukherjee, a Columbia Law School professor and the director of the school\u2019s Immigrants\u2019 Rights Clinic, who filed the petition seeking the family\u2019s release. <\/p>\n<p id=\"anchor-0620e0\" class=\"body-graf\">Yet after Amalia\u2019s return to Dilley on Jan. 28, federal officials \u201cdenied her access to the medication that doctors prescribed for her at the hospital\u201d the lawsuit says, forcing her parents to \u201cwait in long lines for hours outside daily\u201d to request the medicine, only to be turned away.<\/p>\n<p id=\"anchor-2497d5\" class=\"body-graf\">After days of intensive treatment on oxygen, Amalia began to recover. But her discharge from the hospital was not the end of her ordeal.<\/p>\n<p id=\"anchor-e80ada\" class=\"body-graf\">Despite warnings from medical experts that the toddler remained medically vulnerable and at high risk of reinfection, immigration officers returned Amalia and her mother to the detention center, the lawsuit says.<\/p>\n<p id=\"anchor-51c555\" class=\"body-graf\">\u201cAfter baby Amalia had been hospitalized for 10 days, ICE thought this baby should be returned to Dilley, where she was denied access to the medicines that the hospital doctors told her she needed,\u201d Mukherjee said. \u201cIt is so outrageous.\u201d<\/p>\n<p id=\"anchor-a38225\" class=\"body-graf\">The Department of Homeland Security didn\u2019t immediately respond to a request for comment. It has defended its use of family detention, saying in statements and legal filings that detainees are provided basic necessities and that officials work to ensure children and adults are safe.<\/p>\n<p id=\"anchor-42cc47\" class=\"body-graf\">CoreCivic, the company that runs Dilley under a federal contract, deferred questions about the facility to DHS and said in a statement that \u201cthe health and safety of those entrusted to our care\u201d is the company\u2019s top priority.<\/p>\n<p id=\"anchor-5f0992\" class=\"body-graf\">Amalia\u2019s case comes amid heightened scrutiny of conditions at Dilley, which was thrust into the national spotlight last month after immigration authorities <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/mother-5-year-old-taken-ice-immigration-agents-use-son-bait-rcna256729\" target=\"_blank\" rel=\"nofollow noopener\">detained Liam Conejo Ramos<\/a>, a 5-year-old boy taken into custody with his father \u2014 an episode that drew widespread outrage after a photograph showed the child in a blue bunny hat as he was led away by officers.<\/p>\n<p id=\"anchor-fd6e69\" class=\"body-graf\">Accounts from <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/kids-texas-immigration-facility-nightmares-school-food-dilley-ice-rcna257473\" target=\"_blank\" rel=\"nofollow noopener\">detained families, their lawyers and court filings<\/a> portray Dilley as a place where hundreds of children languish while being served contaminated food, receiving little education and struggling to obtain basic medical care. Sworn declarations <a href=\"https:\/\/youthlaw.org\/wp-content\/uploads\/plaintiffs-response-to-supplemental-ice-report.pdf\" target=\"_blank\" rel=\"nofollow noopener\">from dozens of parents<\/a> say prolonged confinement takes a heavy physical and psychological toll on children \u2014 including regression, weight loss, recurring illness and nightmares \u2014 as the federal government expands the use of family detention.<\/p>\n<p id=\"anchor-15fb65\" class=\"body-graf\">Like many other families held at Dilley, lawyers for Amalia\u2019s parents say the family should never have been detained.<\/p>\n<p id=\"anchor-0d63c2\" class=\"body-graf\">Kheilin Valero Marcano and Stiven Arrieta Prieto entered the United States in 2024 after fleeing Venezuela, where they say they faced persecution for their political opposition to President Nicol\u00e1s Maduro, according to the lawsuit. During their journey north, Valero Marcano gave birth to Amalia in Mexico.<\/p>\n<p id=\"anchor-7405f7\" class=\"body-graf\">They applied for asylum through the  government-run appointment system CBP One, and immigration authorities allowed the family to live in El Paso while their case moved forward. According to the lawsuit, they checked in regularly with immigration officials and complied with all requirements, including participation in an alternative-to-detention monitoring program.<\/p>\n<p id=\"anchor-316424\" class=\"body-graf\">That changed on Dec. 11, when the family reported together for a check-in and was taken into custody, according to the lawsuit. Two days later, they were transferred to the Dilley Immigration Processing Center, a sprawling complex an hour south of San Antonio, more than 500 miles from the community where they had been living.<\/p>\n<p id=\"anchor-84c5f0\" class=\"body-graf\">Once inside Dilley, the parents say their daughter\u2019s health deteriorated quickly. In early January, Amalia developed a high fever that would not break. She began vomiting, had diarrhea and struggled to breathe.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/02\/260201-dilley-texas-immigration-ww-2204-750238.jpg\" alt=\"A dense crowd of hundreds of people wearing raincoats and hoods is seen from an aerial perspective. Each visit ended the same way, according to the lawsuit: basic fever medication.<\/p>\n<p id=\"anchor-713d67\" class=\"body-graf\">By mid-January, Amalia was barely getting enough oxygen. On Jan. 18, the lawsuit said, her blood oxygen levels plunged into the 50s \u2014 \u200ba life-threatening emergency \u2014 and she was taken out of the facility with her mother to a hospital. Her father remained behind at Dilley, unable to communicate with his wife or see his daughter as doctors worked to save her.<\/p>\n<p id=\"anchor-ce378d\" class=\"body-graf\">She spent 10 days at Methodist Children\u2019s Hospital in San Antonio, much of that time on oxygen, as her lungs struggled to recover. Immigration and Customs Enforcement officers maintained constant supervision over Amalia and her mother throughout the hospitalization, according to the lawsuit.<\/p>\n<p id=\"anchor-58c1b6\" class=\"body-graf\">Mukherjee said the girl\u2019s mother spent the days praying at her daughter\u2019s bedside, terrified she would die \u2014 and was later devastated to learn that, once discharged, they would be sent back to detention.<\/p>\n<p id=\"anchor-54337a\" class=\"body-graf\">When Amalia was released from the hospital on Jan. 28, doctors gave clear instructions, medical records cited in the lawsuit show: She needed breathing treatments delivered by nebulizer and nutritional supplements to help her regain strength and weight.<\/p>\n<p id=\"anchor-d5665b\" class=\"body-graf\">Instead of allowing them to return to El Paso, immigration officers drove Amalia and her mother back to Dilley, the lawsuit says.<\/p>\n<p id=\"anchor-0c246e\" class=\"body-graf\">Once there, detention medical staff confiscated Amalia\u2019s nebulizer, albuterol and nutritional supplements. The parents were required to wait daily for hours in what detainees have described in interviews and sworn declarations as the \u201cpill line\u201d \u2014 an outdoor queue families must stand in to obtain medicine and other necessities.<\/p>\n<p id=\"anchor-b34683\" class=\"body-graf\">Amalia shivered in her mother\u2019s arms as they waited in the cold, Mukherjee said, only to be given PediaSure and denied the breathing medication doctors had prescribed.<\/p>\n<p id=\"anchor-be6ee9\" class=\"body-graf\">As Amalia remained in detention, Mukherjee and other immigration lawyers repeatedly urged federal officials to release the family, warning that the child\u2019s condition could rapidly worsen.<\/p>\n<p id=\"anchor-2774cf\" class=\"body-graf\">Medical experts who reviewed Amalia\u2019s records submitted affidavits cautioning that returning a medically fragile toddler to detention \u2014 particularly without reliable access to prescribed medication \u2014 put her at extreme danger. One physician warned that the child faced a \u201chigh risk for medical decompensation and death.\u201d<\/p>\n<p id=\"anchor-136c50\" class=\"body-graf\">Mukherjee\u2019s efforts intensified after health officials <a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/2-measles-infections-confirmed-texas-facility-5-year-old-detained-minn-rcna256993\" target=\"_blank\" rel=\"nofollow noopener\">confirmed two measles cases<\/a> among people held at Dilley.<\/p>\n<p id=\"anchor-724544\" class=\"body-graf\">When those appeals failed, Mukherjee filed the emergency challenge in federal court seeking the family\u2019s release.<\/p>\n<p id=\"anchor-016d46\" class=\"body-graf\">Hours later, on Friday evening, the family was freed. Mukherjee said ICE failed to turn over Amalia\u2019s prescriptions as well as her birth certificate.
