Brian Littrell\u2019s $50,000 lawsuit against the woman he claims trespassed on his private beach property<\/a> has been dismissed by a Walton County, Fla., judge.<\/p>\n

According to court documents obtained by Page Six, the judge dismissed the case \u201cwithout prejudice\u201d on Tuesday for \u201cfailing to state a claim for which relief can be granted.\u201d<\/p>\n

However, Brian and his wife, Leighanne Littrell, have 20 days to refile an amended complaint for their case.<\/p>\n

A rep for Brian and Leighanne did not immediately respond to Page Six\u2019s request for comment.<\/p>\n

The couple first took legal action against Carolyn Barrington Hill on Sept. 19, 2025, accusing her of seven counts of illegal trespassing, one count of invasion of privacy and one count of stalking over incidents that took place between April 2025 through September 6, 2025. However, they later dismissed their count of stalking.<\/p>\n

They claimed in their legal filing that Hill \u201cignored the no trespassing\u201d signs on their Santa Rosa Beach property and entered the area \u201cwithout right or authority.\u201d<\/p>\n

They alleged that Hill \u201cset out to antagonize, bully and harass\u201d them with her \u201cmultiple\u201d \u201cunauthorized entries\u201d that started in April.<\/p>\n

The couple claims Carolyn Barrington Hill \u201cignored the no trespassing\u201d signs on their property and \u201cset out to antagonize, bully and harass\u201d them. Google Street<\/p>\n

Brian and Leighanne further claimed that they suffered \u201cemotional distress\u201d because Hill\u2019s \u201ctrespassing\u201d hindered their \u201cuse and enjoyment of the property.\u201d<\/p>\n

In the judge\u2019s order, Littrell\u2019s claim for emotional was dismissed because \u201cemotional distress damages are not permitted on a claim for trespassing.\u201d<\/p>\n

Brian and Leighanne also listed their BLB Beach Hut LLC as a plaintiff, and as a legal entity and not a person, it cannot experience emotional distress, according to the judge.<\/p>\n

In one incident the pair accused Hill of setting up her own beach furniture on their property before she engaged in a heated exchange with their property manager.<\/p>\n

The lawsuit alleged that Hill started \u201cshouting and cursing\u201d at their property manager after he asked her to move her things.<\/p>\n

They also claimed she \u201cvideotaped\u201d them without their \u201cknowledge or consent\u201d and \u201cincited\u201d other members of the public to join her in her alleged trespassing of their property.<\/p>\n
