Sinclair Broadcast Group, the second largest station owner, last year spent four times its 2023 federal lobbying total.\u00a0<\/p>\n<p>EDITOR&#8217;S NOTE: In Rhode Island, Nexstar owns WPRI-12 and WNAC-64, and Sinclair owns WJAR-10 and WLNE-6<\/p>\n<p><a href=\"https:\/\/www.golocalprov.com\/newsletter\" style=\"display:block;margin-bottom:10px;\" rel=\"nofollow noopener\" target=\"_blank\">GET THE LATEST BREAKING NEWS HERE &#8212; SIGN UP FOR GOLOCAL FREE DAILY EBLAST<\/a><\/p>\n<p>Both organizations are lobbying to change regulations that restrict their growth.<\/p>\n<p>National station owners are limited to owning stations that collectively reach no more than 39 percent of the national audience, but a regulatory loophole known as the <a href=\"https:\/\/www.fcc.gov\/document\/reinstatement-uhf-discount\" rel=\"nofollow noopener\" target=\"_blank\">UHF discount<\/a> lets some stations be counted as reaching fewer households than they actually do.<\/p>\n<p>Without the discount, Nexstar serves <a href=\"https:\/\/www.nexstar.tv\/wp-content\/uploads\/2025\/05\/Nexstar-2024-Annual-Report.pdf\" rel=\"nofollow noopener\" target=\"_blank\">70 percent of national television households<\/a>; with the UHF discount applied, however, its reach only extends to 39 percent.<\/p>\n<p>Potential Nexstar-Tegna merger drives record lobbying<\/p>\n<p>\u00a0<\/p>\n<p class=\"image-container\" style=\"position:relative;\">\n                    <a class=\"fancybox\" href=\"https:\/\/www.golocalprov.com\/cache\/images\/cached\/chrootmedia\/files\/article_files\/Open_Secrets_1_Nexstar__1494_880_90.jpg\" title=\"IMAGE: Open Secrets\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>                      <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/02\/Open_Secrets_1_Nexstar__728_429_90.jpg\" alt=\"\" width=\"728\" height=\"429\"\/><\/p>\n<p>                      View Larger +<br \/>\n                    <\/a>\n                  <\/p>\n<p class=\"caption\">IMAGE: Open Secrets<\/p>\n<p>\u00a0<\/p>\n<p>Nexstar\u2019s 2025 <a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/clients\/issues?cycle=2025&amp;id=D000068622&amp;spec=COM&amp;specific_issue=Radio+%26+TV+Broadcasting#specific_issue\" rel=\"nofollow noopener\" target=\"_blank\">federal disclosure reports<\/a> shows the company lobbied on the ownership cap and a potential merger with Tegna, another major broadcaster.<\/p>\n<p>In August 2025, Nexstar announced a deal to acquire <a href=\"https:\/\/www.opensecrets.org\/search?q=tegna+inc&amp;type=site#gsc.tab=0&amp;gsc.q=tegna%20inc&amp;gsc.page=1\" rel=\"nofollow noopener\" target=\"_blank\">Tegna<\/a> for $6.2 billion. The proposed merger would send the cumulative household reach soaring past the 39 percent ownership cap. Thus, the deal is pending while the FCC determines whether to change the ownership rules.<\/p>\n<p>To help sway the FCC, Congress and the White House, Nexstar hired lobbyist <a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/lobbyists\/summary?cycle=2025&amp;id=Y0000052783L\" rel=\"nofollow noopener\" target=\"_blank\">Jeff Miller<\/a>, who served as finance chair on President Donald Trump\u2019s second inaugural committee, at the start of 2025. Miller heads <a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/firms\/summary?id=D000073422&amp;year=2025\" rel=\"nofollow noopener\" target=\"_blank\">Miller Strategies<\/a>, one of the firms that have <a href=\"https:\/\/www.opensecrets.org\/news\/2025\/11\/as-lobbying-revenue-grows-at-record-pace-trump-aligned-firms-reap-the-biggest-rewards\/\" rel=\"nofollow noopener\" target=\"_blank\">benefited most<\/a> from their close connection with the Trump administration. Nexstar <a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/clients\/lobbyists?cycle=2025&amp;id=D000068622\" rel=\"nofollow noopener\" target=\"_blank\">paid the firm $510,000<\/a> over the course of the year, although most of its lobbying was handled by the company\u2019s in-house team.<\/p>\n<p>Tegna reported its <a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/clients\/summary?cycle=2025&amp;id=D000084069\" rel=\"nofollow noopener\" target=\"_blank\">first year of lobbying<\/a> in 2025, spending $550,000 exclusively on Miller Strategies. Combined, the lobbying firm raked in over a million dollars from just the potential Nexstar-Tegna merger.<\/p>\n<p>Sinclair multiplies spending as it eyes acquisition<\/p>\n<p>Sinclair spent $800,000 lobbying the FCC last year on <a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/clients\/issues?cycle=2025&amp;id=D000029062&amp;spec=COM&amp;specific_issue=Radio+%26+TV+Broadcasting#specific_issue\" rel=\"nofollow noopener\" target=\"_blank\">issues such as media ownership and the communications ecosystem<\/a>. When it nearly quadrupled its previous lobbying spending in 2024, it cited the same issues.<\/p>\n<p>\u00a0<\/p>\n<p class=\"image-container\" style=\"position:relative;\">\n                    <a class=\"fancybox\" href=\"https:\/\/www.golocalprov.com\/cache\/images\/cached\/chrootmedia\/files\/article_files\/Open_Secrets_Sinclair_2_1504_872_90.jpg\" title=\"IMAGE: Open Secrets\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>                      <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/02\/Open_Secrets_Sinclair_2_728_422_90.jpg\" alt=\"\" width=\"728\" height=\"422\"\/><\/p>\n<p>                      View Larger +<br \/>\n                    <\/a>\n                  <\/p>\n<p class=\"caption\">IMAGE: Open Secrets<\/p>\n<p>\u00a0<\/p>\n<p>While Sinclair reaches a smaller share of TV households than Nexstar \u2013 about <a href=\"https:\/\/d2ghdaxqb194v2.cloudfront.net\/2732\/197115.pdf\" rel=\"nofollow noopener\" target=\"_blank\">24 percent<\/a> when the UHF discount is applied \u2013 the company still sees the national ownership cap as limiting its ability to expand.<\/p>\n<p>The company has been in <a href=\"https:\/\/www.cnbc.com\/2025\/08\/11\/sinclair-is-exploring-mergers-for-its-broadcast-business.html\" rel=\"nofollow noopener\" target=\"_blank\">conversations<\/a> with multiple potential merger partners and launched a <a href=\"https:\/\/sbgi.net\/sinclair-launches-comprehensive-strategic-review-for-broadcast-business\/\" rel=\"nofollow noopener\" target=\"_blank\">strategic review<\/a> in August pointing to a desire to acquire one of its peers. Discussions with E.W. Scripps, a smaller broadcast station owner, <a href=\"https:\/\/www.cnbc.com\/2025\/12\/02\/broadcast-station-owners-consolidation-regulation-deal-structure.html\" rel=\"nofollow noopener\" target=\"_blank\">began in 2024<\/a>. The conversations never progressed and, in November, Sinclair announced it would pursue a <a href=\"https:\/\/www.latimes.com\/entertainment-arts\/business\/story\/2025-11-24\/sinclair-broadcast-group-makes-bid-for-scripps-tv-stations\" rel=\"nofollow noopener\" target=\"_blank\">hostile takeover of Scripps<\/a>.<\/p>\n<p>Who gets to make the call?<\/p>\n<p><a href=\"https:\/\/www.opensecrets.org\/revolving-door\/brioche-rudy\/summary?id=71326\" rel=\"nofollow noopener\" target=\"_blank\">Rudy Brioche<\/a>, a former vice president and policy counsel at Comcast, said that increases in lobbying from broadcast companies are centered on pending mergers and implementation of the <a href=\"https:\/\/www.tvtechnology.com\/news\/sinclair-urges-fcc-to-abolish-station-ownership-rules-sunset-atsc-1-0\" rel=\"nofollow noopener\" target=\"_blank\">ATSC 3.0 standard<\/a>, which would change how television is transmitted to households. Before working for Comcast for 16 years, Brioche served as chief of staff at the FCC.<\/p>\n<p>\u201cIt is primarily about pending transactions, the ATSC standard 3.0, which is a new technology that would allow broadcasters to use the digital airwaves for other streams of revenue,\u201d Brioche said.<\/p>\n<p>That push for regulatory changes is unfolding as broadcasters see a more favorable political climate in Washington.<\/p>\n<p>Trump\u2019s push for deregulation <a href=\"https:\/\/www.marketwatch.com\/story\/sinclair-makes-a-move-for-scripps-as-trumps-deregulation-push-makes-previously-unthinkable-deals-possible-95668041?gaa_at=eafs&amp;gaa_n=AWEtsqcuQNBxNW5GcyUhqBc8voaHUHObvLlG4Wc00YjWrR9x3EiClnU8nMLbLiP9yqg%3D&amp;gaa_ts=698b7c43&amp;gaa_sig=bhrQIY1pujI9EMuSO_AhswZELe0KwTkENZkNWXU2ESlQoRT3RXRPiBFjWc_QV-QP_F_xjonRIvA3wuUiogdFrQ%3D%3D\" rel=\"nofollow noopener\" target=\"_blank\">has created hope<\/a> for the largest station owners that they may gain more flexibility. The FCC has signaled its intention to do away with the 39 percent ownership cap, and its chairman, Brendan Carr, has shown <a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/FCC-25-64A2.pdf\" rel=\"nofollow noopener\" target=\"_blank\">support for allowing stations owners<\/a> to expand their reach.<\/p>\n<p>However, the jurisdiction over the ownership cap was one of the topics discussed in a recent <a href=\"https:\/\/www.youtube.com\/watch?v=iHBxzxTgDVU\" rel=\"nofollow noopener\" target=\"_blank\">Senate hearing<\/a> that examined the rules around broadcast media ownership in the digital age. The debate in Congress over who has the authority to change the 39 percent ownership cap is central to Nexstar\u2019s and Sinclair\u2019s expansion plans. In 2004, Congress <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/2673\" rel=\"nofollow noopener\" target=\"_blank\">set the 39 percent cap<\/a> and <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/47\/160\" rel=\"nofollow noopener\" target=\"_blank\">explicitly prohibited the FCC<\/a> from using its forbearance authority to avoid enforcing the limit.<\/p>\n<p>Sen. Jacky Rosen (D-Nev.) made clear that the authority to change the cap lay with Congress.<\/p>\n<p>\u201cJust because large corporations like Nexstar and Tegna want to merge, it doesn\u2019t mean they can simply ignore the laws that Congress has put in place,\u201d Rosen said. \u201cIn order for there to be a merger that results in ownership above the 39 percent cap, Congress would have to change the law.\u201d<\/p>\n<p>Proponents of change to the ownership cap <a href=\"https:\/\/www.yalejreg.com\/nc\/can-the-fcc-lift-the-national-audience-reach-cap-by-joel-thayer\/#:~:text=After%20all%2C%20Congress%20did%20not,these%20arguments%20move%20the%20needle.\" rel=\"nofollow noopener\" target=\"_blank\">argue<\/a> that Congress didn\u2019t set a permanent statutory limit, but instead directed the FCC to modify its rules at specific moments in time, leaving the underlying cap as a regulatory creation that the agency can revisit.<\/p>\n<p>The hearing also featured the <a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/clients\/summary?id=D000000202\" rel=\"nofollow noopener\" target=\"_blank\">National Association of Broadcasters<\/a>\u2019 chief executive officer, Curtis LeGeyt. NAB, <a href=\"https:\/\/www.opensecrets.org\/federal-lobbying\/industries\/summary?cycle=2025&amp;id=B02\" rel=\"nofollow noopener\" target=\"_blank\">the entertainment industry\u2019s largest lobbying client<\/a>, has long advocated for allowing station owners to expand past the ownership cap and for deregulation of the broadcast industry.<\/p>\n<p>\u201cThese outdated regulations distort today\u2019s video and advertising marketplace,\u201d LeGeyt said. \u201cThey advantage giant tech platforms, global streaming services, pay TV providers and national cable programmers, while placing local broadcasters at a severe disadvantage.\u201d<\/p>\n<p>Chris Ruddy, CEO of Newsmax, a relatively small conservative broadcaster, urged members of Congress to protect the ownership cap, saying it blocks monopolization of the industry and promotes localism of stations.<\/p>\n<p>Whether that cap holds may depend not only on Congress but on how the FCC responds to political pressure from the White House and industry. The FCC historically has acted independently from past administrations, but has become increasingly politicized under Trump.\u00a0<\/p>\n<p>During a <a href=\"https:\/\/www.politico.com\/live-updates\/2025\/12\/12\/congress\/brendan-carr-gop-huddle-ahead-of-senate-showdown-on-his-kimmel-threats-00689618\" rel=\"nofollow noopener\" target=\"_blank\">congressional probe<\/a> of the FCC focused on censorship and free speech in December 2025, Carr said the agency wasn\u2019t independent of the administration, a contradiction to the mission statement that included the word \u201cindependent\u201d <a href=\"https:\/\/web.archive.org\/web\/20251001051308\/https:\/\/www.fcc.gov\/about\/overview\" rel=\"nofollow noopener\" target=\"_blank\">prior to the hearing<\/a>.\u00a0<\/p>\n<p>Brioche, who served as former chief of staff at the FCC, noted how much things have changed under Trump.<\/p>\n<p>\u201cIt is different from past administrations, because past administrations viewed the FCC as an independent agency. This administration does not view the FCC as an independent agency,\u201d Brioche said. \u201cIt views the FCC as a tool, an instrument of advancing its political interest.\u201d<\/p>\n<p>Trump has recently reversed his position: Last November he responded to a <a href=\"https:\/\/www.newsmax.com\/newsmax-tv\/newsmax-ruddy-fcc\/2025\/11\/19\/id\/1235187\/\" rel=\"nofollow noopener\" target=\"_blank\">warning by Newsmax\u2019s Ruddy<\/a> against lifting the ownership cap by railing against the potential expansion of station owners because it would help enlarge \u201cRadical Left Networks.\u201d\u00a0<\/p>\n<p>Nexstar has sought to <a href=\"https:\/\/apnews.com\/article\/trump-nexstar-tegna-deal-037c97de84d1249c2122c8d503fda38c\" rel=\"nofollow noopener\" target=\"_blank\">represent<\/a> the potential merger as aligned with the administration\u2019s deregulation agenda. Its efforts seem to have worked.
