{"id":487132,"date":"2026-02-24T06:44:07","date_gmt":"2026-02-24T06:44:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/487132\/"},"modified":"2026-02-24T06:44:07","modified_gmt":"2026-02-24T06:44:07","slug":"fedex-sues-us-government-seeking-full-refund-over-trump-tariffs-trump-tariffs","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/487132\/","title":{"rendered":"FedEx sues US government, seeking \u2018full refund\u2019 over Trump tariffs | Trump tariffs"},"content":{"rendered":"<p class=\"dcr-130mj7b\">FedEx sued the US government on Monday, seeking a refund for the tariffs imposed by Donald Trump that were <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/feb\/23\/senate-democrats-tariffs-refund-bill\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">deemed illegal<\/a> by the US supreme court last week.<\/p>\n<p class=\"dcr-130mj7b\">The lawsuit marks the first attempt by a major company to receive reimbursement of their share of an <a href=\"https:\/\/www.reuters.com\/world\/us-tariff-revenue-risk-supreme-court-ruling-tops-175-billion-penn-wharton-2026-02-20\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">estimated $175bn<\/a> in levies after the highest court found Trump had overstepped his authority in issuing the tariffs. Other companies are expected to follow.<\/p>\n<p class=\"dcr-130mj7b\">The FedEx lawsuit named as defendants US Customs and Border Protection (CBP), which collects tariffs; the agency\u2019s commissioner Rodney Scott; and the United States of America. The suit was filed in the US court of international trade. The company did not specify an amount in its complaint but said it was seeking a \u201cfull refund\u201d for duties paid to the US.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWhile the supreme court did not address the issue of refunds, FedEx has taken necessary action to protect the company\u2019s rights as an importer of record to seek duty refunds from US Customs and Border Protection,\u201d the company said in a written statement.<\/p>\n<p class=\"dcr-130mj7b\">Trump has made tariffs a key component of his economic policy during his second term, imposing import duties on goods from nearly every country on earth using a novel interpretation of emergency powers law as justification.<\/p>\n<p class=\"dcr-130mj7b\">In a 6-3 ruling last Friday, the court made clear that Congress retains the sole authority to levy taxes under the constitution and that the International Emergency Economic Powers Act (IEEPA), cited by the administration, could not be used to supersede that authority during peacetime.<\/p>\n<p class=\"dcr-130mj7b\">The decision marked the first time the supreme court has overruled Trump\u2019s policies in his second term, and undercut his claims to executive authority, and the assertions he has relied upon to reshape US trade policy. But it did not make clear whether businesses would be entitled to refunds.<\/p>\n<p class=\"dcr-130mj7b\">In a dissenting opinion, Justice Brett Kavanaugh addressed the issue, claiming: \u201cThe court says nothing today about whether, and if so how, the government should go about returning the billions of dollars that it has collected from importers.\u201d He added that \u201crefunds of billions of dollars would have significant consequences for the US treasury\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The the president swiftly and sharply rebuked the supreme court after the ruling, and claimed it would do little to slow him down. Trump said he would move forward with <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/feb\/22\/trump-tariff-policy-ruling\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">new global tariffs<\/a> issued under different statutes. He then announced a 10% global tariff which <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/feb\/21\/trump-tariffs-15-percent\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">he increased<\/a> to 15% less than 24 hours later.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe policy hasn\u2019t changed.
