{"id":489472,"date":"2026-02-25T11:09:16","date_gmt":"2026-02-25T11:09:16","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/489472\/"},"modified":"2026-02-25T11:09:16","modified_gmt":"2026-02-25T11:09:16","slug":"judge-bars-justice-department-from-searching-through-devices-seized-from-washington-post-reporter-as-part-of-leak-probe","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/489472\/","title":{"rendered":"Judge bars Justice Department from searching through devices seized from Washington Post reporter as part of leak probe"},"content":{"rendered":"<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1apnal000x26qj4baseaki@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Justice Department may not search through the contents of several devices <a href=\"https:\/\/www.cnn.com\/2026\/01\/14\/media\/fbi-hannah-natanson-washington-post-search-doj\" rel=\"nofollow noopener\" target=\"_blank\">seized from a Washington Post reporter<\/a> earlier this year as part of a probe into leaked classified documents, a federal judge said in a ruling Tuesday that was highly critical of the government\u2019s approach in the case.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1arpz500053b6r15c1l1lf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The decision from <a href=\"https:\/\/www.cnn.com\/2026\/02\/20\/politics\/judge-rips-washington-post-fbi-reporter-warrant\" rel=\"nofollow noopener\" target=\"_blank\">Magistrate Judge William Porter<\/a>, of the federal court in Alexandria, Virginia, is a remarkable turn of events some six weeks after he first gave the government permission to raid the reporter\u2019s home to seize a phone, two computers and a Garmin watch.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1arpz500063b6rofp4ujcv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In a 22-page ruling laying bare the judge\u2019s concerns that investigators would use the search warrant he approved to peer into parts of the reporter\u2019s data that are unrelated to the leak investigation, Porter said that giving them carte blanche to rummage through all of the data it seized \u201cwhen probable cause exists for only a narrow subset \u2026 would authorize an unlawful general warrant.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1arpz500073b6r39kjdrtr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cGiven the documented reporting on government leak investigations and the government\u2019s well-chronicled efforts to stop them, allowing the government\u2019s filter team to search a reporter\u2019s work product \u2014 most of which consists of unrelated information from confidential sources \u2014 is the equivalent of leaving the government\u2019s fox in charge of the Washington Post\u2019s henhouse,\u201d he wrote.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1arpz500083b6rdl6c37il@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Porter rejected separate requests from lawyers for the reporter and DOJ attorneys to look through the devices and filter out information that is not subject to the search warrant, instead tasking the court with that responsibility.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1arpz500093b6rdq8o2mtf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cTo gather the information the government needs to prosecute its criminal case without authorizing an unrestrained search \u2026 the court will conduct the review itself,\u201d he wrote.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1bmcl500033b6rfbwbc5w7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The decision landed several days after lawyers for the reporter, Hannah Natanson, pressed Porter to issue an order that would require the government to return all of the devices it seized from her. They argued that investigators were violating her First Amendment rights by frustrating her ability to continue working on stories and communicating with more than 1,000 sources she\u2019s developed covering President Donald Trump\u2019s efforts to shrink the federal workforce.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1bt8pi00073b6r3hyfgp65@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cNo easy remedy exists here,\u201d Porter wrote. Natanson\u2019s \u201cFirst Amendment rights have been restrained. The government seized all of Ms. Natanson\u2019s work product, documentary material, and devices, terminating her access to the confidential sources she developed and to all the tools she needs as a working journalist. The government\u2019s proposed remedy \u2013 that she simply buy a new phone and laptop, set up new accounts, and start from scratch \u2013 is unjust and unreasonable.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1bvdkr00093b6r9madlu1a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But he went on to say that his \u201cgenuine hope is that this search was conducted \u2013 as the government contends \u2013 to gather evidence of a crime in a single case, not to collect information about confidential sources from a reporter who has published articles critical of the administration.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1arpz5000a3b6rp8ebd1dz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN has previously reported that Natanson is not under investigation. But her communications with a government contractor who was charged with illegally leaking classified information are what led prosecutors to ask Porter to approve a search warrant for her Virginia home earlier this year.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1arpz5000b3b6r4d5s31ke@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The contractor, <a href=\"https:\/\/www.cnn.com\/2026\/01\/23\/politics\/ex-government-contractor-charged-leaking-washington-post\" rel=\"nofollow noopener\" target=\"_blank\">Aurelio Luis Perez-Lugones<\/a>, pleaded not guilty late last month to five counts of unlawfully transmitting national defense information to Natanson through an encrypted messaging application and a single count of unlawfully retaining the defense information.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1cp4nb000r3b6rnl2fgvno@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Washington Post said in a statement that it\u2019s pleased with Porter\u2019s \u201crecognition of core First Amendment protections and its rejection of the government\u2019s expansionist arguments for searching Hannah Natanson\u2019s devices and work materials in their entirety and placing itself in charge of determining their relevance.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1cte4c000t3b6ru7gtu4vo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN has reached out to the Justice Department for comment.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1bjvx000013b6rjuh8gv3s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In his decision Tuesday, Porter scolded Justice Department attorneys for failing to inform him of the applicability of a law meant to protect journalists from government searches and seizures when it asked him for permission to raid Natanson\u2019s home \u2013 a move he described as \u201ca matter of significant concern.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1c88c9000c3b6riqdhuxep@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The law, known as the Privacy Protection Act of 1980, establishes guardrails to prevent federal investigators from searching or seizing work product materials from a newsroom or journalist unless a reporter is themself the subject of a criminal investigation or prosecution.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1cealx000h3b6rjq52ng0j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Porter said he was unaware of the law\u2019s existence when he signed off on the search warrant, and he chided the government attorneys for deciding to not raise it with him last month when they sought approval for the raid.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1cgl0d000j3b6rz5kypf9p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe government\u2019s failure to identify the PPA as applicable to a request for a search warrant on a member of the press \u2013 and to analyze it in its warrant application \u2013 is another matter,\u201d he wrote. \u201cThis omission has seriously undermined the Court\u2019s confidence in the government\u2019s disclosures in this proceeding.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1ck5l6000l3b6rdsar367f@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Had the government told him about the applicability of the law, Porter said, he may have rejected the search warrant request and instead told its lawyers to subpoena Natanson for the information it\u2019s seeking.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1cmpjh000p3b6rc6wml7xa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAt the very least, it would have asked more questions,\u201d he wrote. \u201cThe government deprived the court of the opportunity to make those real-time decisions.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmm1apnal000y26qjfr8yepj2@published\" data-editable=\"text\"
