{"id":502618,"date":"2026-03-04T05:41:08","date_gmt":"2026-03-04T05:41:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/502618\/"},"modified":"2026-03-04T05:41:08","modified_gmt":"2026-03-04T05:41:08","slug":"former-financial-adviser-banned-for-seven-years-fined-15000","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/502618\/","title":{"rendered":"Former financial adviser banned for seven years, fined $15,000"},"content":{"rendered":"<p class=\"body-paragraph articleLinkText  [&amp;_p]:tit-sub-xl tit-sub-xl md:[&amp;_p]:d-tit-sub-xl md:d-tit-sub-xl mb-[1.3rem]\">Former Auckland financial adviser David McEwen has been banned for seven years after he continued seeking money from clients in breach of a regulatory order.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The ex-adviser \u2013 who pleaded <a href=\"https:\/\/www.1news.co.nz\/2025\/11\/13\/ex-financial-adviser-pleads-guilty-to-stop-order-breach\/\" target=\"_blank\" rel=\"nofollow noopener\">guilty in November<\/a> to <a href=\"https:\/\/www.1news.co.nz\/2025\/03\/18\/ex-finance-adviser-faces-criminal-charges-for-alleged-stop-order-breach\/\" target=\"_blank\" rel=\"nofollow noopener\">four charges<\/a> of breaching the Financial Markets Authority&#8217;s (FMA) stop order \u2013 has been fined $15,000 and had his application for a discharge without conviction dismissed.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">McEwen has been banned from being a director or promoter, or involved in the management, of a company and from providing financial advice services for seven years. The stop order had been issued to prevent material financial harm to his clients.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">McEwen, previously based in Auckland, and several associated entities, were issued with a stop order by the FMA in December 2023.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The FMA said McEwen breached the stop order almost immediately.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Enforcement head Margot Gatland said the agency focused its enforcement actions on preventing and addressing significant harm to consumers and the financial system.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">&#8220;Mr McEwen breached our stop order in various ways almost immediately after it was made, after he had left New Zealand,&#8221; she said. &#8220;He continued to seek money from former clients and obtained around $17,000 after the stop order was issued.&#8221;<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The stop order prohibited making offers, issues, sales or other disposals of financial products, distributing any restricted communication, and accepting further contributions, investments, or deposits in respect of McEwen and Associates&#8217; products.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">In December 2024, the FMA filed criminal charges against McEwen for breaching this, alleging he had continued to make offers of financial products and take contributions.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The FMA has also previously issued warnings about financial products offered by McEwen or businesses associated with him, including advising former and existing clients to check their credit and debit card statements for <a href=\"https:\/\/www.1news.co.nz\/2025\/09\/15\/clients-of-ex-finance-adviser-urged-to-check-for-unauthorised-charges\/\" target=\"_blank\" rel=\"nofollow noopener\">possible unauthorised payments<\/a>.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The authority said it had received complaints from clients where it had been suspected card payments had been made on their accounts without their authority.<\/p>\n","protected":false},"excerpt":{"rendered":"Former Auckland financial adviser David McEwen has been banned for seven years after he continued seeking money from&hellip;\n","protected":false},"author":2,"featured_media":502619,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[39],"tags":[28,141314,147,530],"class_list":{"0":"post-502618","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-personal-finance","8":"tag-business","9":"tag-crime-and-justice","10":"tag-personal-finance","11":"tag-personalfinance"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/502618","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/comments?post=502618"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/502618\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media\/502619"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media?parent=502618"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/categories?post=502618"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/tags?post=502618"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
