Lawyers for school staff had alleged that they helped the PSERS public school pension fund select hundreds of high-fee but collectively underperforming investments when they could have been making more owning U.S. stock-index funds, according to <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/news\/psers-aon-hamilton-lane-teacher-sues-20210623.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/news\/psers-aon-hamilton-lane-teacher-sues-20210623.html\">a complaint initially filed in 2021<\/a>. <\/p>\n<p class=\"inq-p text-primary  \">PSERS\u2019 performance was so weak in 2011-20 that the state\u2019s<a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/psers-sers-pension-fbi-scandal-investigaton-teachers-20210411.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-sers-pension-fbi-scandal-investigaton-teachers-20210411.html\"> \u201cshared-risk\u201d law,<\/a> which requires teachers to pay more for their future pensions when investments perform poorly, kicked in for the first time. <\/p>\n<p class=\"inq-p text-primary  \">That law compelled 176,000 Pennsylvania school employees hired since 2011 to pay an extra $87 million in payroll-deduction surcharges from 2021 to 2024. The pensions are financed mostly by investment profits and state treasury payments, with a smaller portion from school staff\u2019s standard payroll deductions of around 7.5%.<\/p>\n<p class=\"inq-p text-primary  \">Teachers and other school staff paid extra charges of 0.5% to 0.75%, averaging nearly $500 each over the three years, to help cover PSERS\u2019 poor performance. They each will recover an average of around $112.<\/p>\n<p class=\"inq-p text-primary  \">\u201cThe lawsuit shined a light on the industry and will result in a significant recovery to these hardworking teachers. Our work on this case will result in better decision-making for this fund and other funds,\u201d said Gerard Mantese, the teachers\u2019 lead counsel along with John J. Conway and Gregory B. Heller.<\/p>\n<p class=\"inq-p text-primary  \">The lawyers will be paid $10 million from the settlement for their five years of work on the case. <\/p>\n<p class=\"inq-p text-primary  \">The former PSERS advisers had denied in a pre-settlement court filing \u201cthat their actions and\/or inactions caused an increased contribution\u201d from the teachers. They maintained they did the work, for which PSERS paid them millions, \u201cfully and lawfully.\u201d<\/p>\n<p class=\"inq-p text-primary  \">FS and Hamilton Lane officials agreed to settlements last fall. Checks began arriving at teachers\u2019 homes in February. <\/p>\n<p class=\"inq-p text-primary  \">\u201cWe have consistently denied the assertions in this lawsuit\u201d and \u201care glad to put the matter behind us\u201d with a settlement that ends the claims, Hamilton Lane said in a statement. FS declined to comment.<\/p>\n<p class=\"inq-p text-primary  \">Aon, whose recent settlement is awaiting court approval, didn\u2019t respond to queries.<\/p>\n<p class=\"inq-p text-primary  \">\u201cTeachers across the state of Pennsylvania should be thrilled\u201d \u2014 even if the checks, averaging enough to pay for a restaurant dinner for two, are mostly \u201csymbolic,\u201d said Kevin Steinke, the lead plaintiff in the teachers\u2019 suit. <\/p>\n<p class=\"inq-p text-primary  \">Steinke teaches anthropology, sociology, and law at <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/springfield\" rel=\"nofollow noopener\" target=\"_blank\">Springfield<\/a> High School in <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/delaware-county\" rel=\"nofollow noopener\" target=\"_blank\">Delaware County<\/a>, and coaches middle-school track.<\/p>\n<p class=\"inq-p text-primary  \">\u201cAnything that can be done to reassure younger teachers these days they are getting into a field where someone is looking out and caring for them is important,\u201d he said. \u201cThere is still work to be done \u2014 in police pensions, in hospital pensions \u2014 but it\u2019s a start.\u201d <\/p>\n<p class=\"inq-p text-primary  \">Steinke said he decided to sue after reading about PSERS\u2019 unusual investments and weak returns in The Inquirer. <\/p>\n<p class=\"inq-p text-primary  \">He said he hasn\u2019t discussed the lawsuit with leaders of the Pennsylvania State Education Association, the union representing staff at most suburban and upstate schools, including Springfield.<\/p>\n<p class=\"inq-p text-primary  \">Local union leaders held five seats on the 15-member PSERS board and <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/psers-pension-pa-psea-teachers-union-20210802.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-pension-pa-psea-teachers-union-20210802.html\">regularly supported hiring high-fee private managers<\/a>, even when state treasurer <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/stacy-garrity\" rel=\"nofollow noopener\" target=\"_blank\">Stacy Garrity<\/a> and her predecessor, Joe Torsella, warned that the high fees and low returns endangered the fund. <\/p>\n<p class=\"inq-p text-primary  \">In 2021, The Inquirer <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/psers-sers-pension-fbi-scandal-investigaton-teachers-20210411.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-sers-pension-fbi-scandal-investigaton-teachers-20210411.html\">reported <\/a>two <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/psers-compensation-gifts-sec-fbi-pension-fund-pennsylvania-teachers-subpoena-20210925.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-compensation-gifts-sec-fbi-pension-fund-pennsylvania-teachers-subpoena-20210925.html\">federal investigations<\/a> of the fund. <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/psers-sec-no-criminal-charges-20220802.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-sec-no-criminal-charges-20220802.html\">No one <\/a>was charged, but <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/psers-spiller-private-alternative-non-traditional-investments-20211217.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-spiller-private-alternative-non-traditional-investments-20211217.html\">top officials<\/a> <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/psers-pension-board-retire-fbi-sec-departures-20211118.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-pension-board-retire-fbi-sec-departures-20211118.html\">left PSERS<\/a>, and <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/psers-board-change-shift-stocks-fbi-sec-20211007.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-board-change-shift-stocks-fbi-sec-20211007.html\">trustees agreed to drop hedge funds, reduce private-equity investments<\/a>, and sell unproductive investments such as a declining Florida mall. <\/p>\n<p class=\"inq-p text-primary  \">Performance improved and the surcharge was dropped in July 2024, though <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.pa.gov\/agencies\/psers\/newsroom\/10232025\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.pa.gov\/agencies\/psers\/newsroom\/10232025\">PSERS returns<\/a> have continued to trail those of more mainstream investors like the<a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.phila.gov\/media\/20250729170219\/Pensions-Investment-Performance-report-06262025.pdf\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.phila.gov\/media\/20250729170219\/Pensions-Investment-Performance-report-06262025.pdf\"> Philadelphia city pension fund<\/a>, which <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/philly\/blogs\/inq-phillydeals\/sers-psers-njdi-pension-retirement-investment-returns-profits-fees-20180318.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/philly\/blogs\/inq-phillydeals\/sers-psers-njdi-pension-retirement-investment-returns-profits-fees-20180318.html\">divested of most of its private assets<\/a> years ago and has <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/philadelphia-pension-funding-expenses-kenney-mayoral-race-20230426.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/philadelphia-pension-funding-expenses-kenney-mayoral-race-20230426.html\">bet heavily on U.S. stocks, which have reached record levels in the long bull market. <\/a><\/p>\n<p class=\"inq-p text-primary  \">Steinke and a handful of other named plaintiffs who spent many hours reviewing the litigation and settlement as it progressed over five years will receive at least $10,000 each under terms of the settlement. <\/p>\n<p class=\"inq-p text-primary  \">Mantese said his fees would cover costs including expert witnesses, such as labor economist <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.newschool.edu\/nssr\/faculty\/teresa-ghilarducci\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.newschool.edu\/nssr\/faculty\/teresa-ghilarducci\/\">Teresa Ghillarducci<\/a> and former Harvard endowment tech fund manager Marty Dirks, who confirmed PSERS\u2019 poor performance. Their analyses, along with comments from officials of the three firms, were redacted from the public record at the parties\u2019 request by Philadelphia Common Pleas Court Judge Nina W. Padilla, who oversaw the cases. <\/p>\n<p class=\"inq-p text-primary  \">A fourth adviser, Aksia LLC of New York, hasn\u2019t settled and still faces a pending complaint.<\/p>\n<p class=\"inq-p text-primary  \">The lawsuit also cited public reports critical of PSERS and its advisers, including conclusions of the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.pa.gov\/agencies\/psers\/transparency\/public-pension-management-and-asset-investment-review-commission\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.pa.gov\/agencies\/psers\/transparency\/public-pension-management-and-asset-investment-review-commission\">2019 state pension study commission (PPMAIRC) report<\/a>, which found that PSERS and the smaller Pennsylvania State Employees\u2019 Retirement Fund owned far more private \u201calternative\u201d fund investments, paid some of the highest investment fees to private managers, and posted some of the lowest returns, among state pension funds over the previous decade.<\/p>\n<p class=\"inq-p text-primary  \">PSERS hired hundreds of specialized U.S. and foreign firms recommended by staff and advisers. <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/news\/david-mccormick-mehmet-oz-psers-bridgewater-hedge-fund-republican-primary-20220327.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/news\/david-mccormick-mehmet-oz-psers-bridgewater-hedge-fund-republican-primary-20220327.html\">Bridgewater Associates<\/a>, the world\u2019s largest hedge fund manager, collected over $700 million in Pennsylvania pension management fees. By the late 2010s Bridgewater managed one-tenth of PSERS\u2019 outside investments, far more than any other firm, before PSERS began canceling its contracts due to poor returns. Bridgewater\u2019s former chief executive, David McCormick, now serves as one of Pennsylvania\u2019s U.S. senators.<\/p>\n<p class=\"inq-p text-primary  \">The settlements include: <\/p>\n<p class=\"inq-p text-primary \">$15 million, paid by Aon, which served as PSERS\u2019 general investment adviser, collecting $7.2 million in PSERS fees from 2010 until it was fired for poor results in 2023. Aon was hired to recommend how PSERS should invest its assets, which now total $80 billion. But in its \u201cwillful blindness,\u201d Aon did \u201clittle or nothing to recommend that PSERS reduce the [proportion] of its risky and expensive alternative investments,\u201d according to the complaint. Aon had previously <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" href=\"https:\/\/www.inquirer.com\/business\/psers-aon-settlement-lubert-investment-20240816.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-aon-settlement-lubert-investment-20240816.html\">paid PSERS $7 million<\/a> to compensate for \u201cmiscalculation\u201d that exaggerated PSERS\u2019 performance for 2011-20 and <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" href=\"https:\/\/www.inquirer.com\/business\/psers-sec-aon-investments-investigation-discrepancies-20240126.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/business\/psers-sec-aon-investments-investigation-discrepancies-20240126.html\">$1.5 million to the SEC<\/a> for failure to investigate \u201cdiscrepancies\u201d between PSERS\u2019 annual reports and the unaudited data used to calculate long-term results. <\/p>\n<p class=\"inq-p text-primary \">$11.25 million to be paid by Portfolio Advisors, which Steinke and his fellow teachers accused of recommending \u201cnumerous investments that were inappropriately and unduly expensive.\u201d The payment almost equals the $11.45 million that Portfolio Advisors collected from PSERS to advise on private investment purchases in 2010-17. <\/p>\n<p class=\"inq-p text-primary \">$4 million to be paid by Hamilton Lane, a publicly traded advisory firm that replaced Portfolio Advisors as PSERS\u2019 private investment adviser from 2017 to 2023 and collected $10.2 million in PSERS fees over that period. \u201cHamilton Lane\u2019s failure to keep a close eye on the private market returns\u201d resulted in \u201cexcessive\u201d fees \u2014 and the firm \u201ctook virtually no action\u201d to secure lower fees, even though that\u2019s one of the things it was hired to do, according to the complaint. <\/p>\n","protected":false},"excerpt":{"rendered":"Three investment firms that advised Pennsylvania\u2019s largest pension system have agreed to pay $30 million to settle legal&hellip;\n","protected":false},"author":2,"featured_media":506794,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[39],"tags":[28,147,530,230425],"class_list":["post-506793","post","type-post","status-publish","format-standard","has-post-thumbnail","category-personal-finance","tag-business","tag-personal-finance","tag-personalfinance","tag-psers-lawsuit-investment-advisers-pensions"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/506793","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/comments?post=506793"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/506793\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media\/506794"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media?parent=506793"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/categories?post=506793"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/tags?post=506793"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
