But xAI \u201chas not alleged that it actually uses datasets that are unique, that it has meaningfully larger or smaller datasets than competitors, or that it cleans its datasets in unique ways.\u201d<\/p>\n<p>Therefore, xAI is not likely to succeed on the merits of its Fifth Amendment claim.<\/p>\n<p>The same goes for First Amendment arguments. xAI failed to show that the law improperly \u201cforces developers to publicly disclose their data sources in an attempt to identify what California deems to be \u2018data riddled with implicit and explicit biases,\u2019\u201d Bernal wrote.<\/p>\n<p>To xAI, it seemed like the state was trying to use the law to influence the outputs of its chatbot Grok, the company argued, which should be protected commercial speech.<\/p>\n<p>Over the past year, Grok has increasingly drawn global public scrutiny for its <a href=\"https:\/\/arstechnica.com\/tech-policy\/2025\/07\/grok-praises-hitler-gives-credit-to-musk-for-removing-woke-filters\/\" rel=\"nofollow noopener\" target=\"_blank\">antisemitic rants<\/a> and for generating <a href=\"https:\/\/arstechnica.com\/tech-policy\/2026\/01\/grok-assumes-users-seeking-images-of-underage-girls-have-good-intent\/\" rel=\"nofollow noopener\" target=\"_blank\">nonconsensual intimate imagery (NCII<\/a>) and <a href=\"https:\/\/arstechnica.com\/tech-policy\/2026\/01\/x-blames-users-for-grok-generated-csam-no-fixes-announced\/\" rel=\"nofollow noopener\" target=\"_blank\">child sexual abuse materials (CSAM).<\/a> But despite these scandals, which prompted <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-sends-cease-and-desist-letter-xai-demands-it-halt-illegal\" rel=\"nofollow noopener\" target=\"_blank\">a California probe<\/a>, Bernal contradicted xAI, saying California did not appear to be trying to regulate controversial or biased outputs, as xAI feared.<\/p>\n<p>\u201cNothing in the language of the statute suggests that California is attempting to influence Plaintiff\u2019s models\u2019 outputs by requiring dataset disclosure,\u201d Bernal wrote.<\/p>\n<p>Addressing xAI\u2019s other speech concerns, he noted that \u201cthe statute does not functionally ask Plaintiff to share its opinions on the role of certain datasets in AI model development or make ideological statements about the utility of various datasets or cleaning methods.\u201d<\/p>\n<p>\u201cNo part of the statute indicates any plan to regulate or censor models based on the datasets with which they are developed and trained,\u201d Bernal wrote.<\/p>\n<p>Public \u201ccannot possibly\u201d care about AI training data<\/p>\n<p>Perhaps most frustrating for xAI as it continues to fight to block the law, Bernal also disputed that the public had no interest in the training data disclosures.<\/p>\n","protected":false},"excerpt":{"rendered":"\u201cIt is not lost on the Court the important role of datasets in AI training and development, and&hellip;\n","protected":false},"author":2,"featured_media":509139,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[45],"tags":[182,181,507,74],"class_list":{"0":"post-509138","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-artificial-intelligence","8":"tag-ai","9":"tag-artificial-intelligence","10":"tag-artificialintelligence","11":"tag-technology"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/509138","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/comments?post=509138"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/509138\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media\/509139"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media?parent=509138"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/categories?post=509138"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/tags?post=509138"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
