\n\tA model who claimed Kanye West<\/a> suddenly choked and pornographically gagged her with his fingers on a La Roux <\/a>music video set has submitted new affidavits to corroborate her claims. They include alleged Instagram exchanges from La Roux, who remembered the choking incident vividly, writing, \u201cI could never forget that, it was horrific,\u201d according to court documents obtained by Rolling Stone.\u00a0<\/p>\n

\n\tJennifer An<\/a>, who was a finalist on America\u2019s Next Top Model in 2009, sued West for sexual assault under New York City\u2019s Gender Motivated Violence Protection Act in November 2024. What was supposed to be an exciting role as a background actress for a remix of La Roux\u2019s song \u201cIn for the Kill\u201d in September 2010, turned into a \u201chumiliating and degrading\u201d experience when West allegedly singled out An during the shoot. \u201cGive me the Asian girl,\u201d West reportedly ordered.\u00a0<\/p>\n

\n\tGoing off-script with the camera rolling, West allegedly choked An with both his hands, smeared her makeup, and then \u201crammed several fingers down her throat, continuously moving them in and out,\u201d effectively \u201cemulat[ing] forced oral sex.\u201d \u201cThis is art,\u201d West yelled, according to the lawsuit. \u201cThis is fucking art. I am like Picasso.\u201d\u00a0<\/p>\n

\n\tIn January, West\u2019s team filed a motion to dismiss An\u2019s lawsuit on a variety of grounds, including the argument that because West\u2019s conduct \u201coccurred in the course of producing expressive\u201d art, his actions should be shielded by free-speech protections.<\/p>\n

\n\tAn\u2019s lawyers pushed back on that notion in a new filing on Tuesday and attached five exhibits that they say bolster An\u2019s claims.\u00a0\u201cWe disagree with [West\u2019s] contention that the alleged sexual assault of Ms. An was protected artistic expression,\u201d attorney Jesse S. Weinstein, who is a partner at Phillips & Associates and counsel at Arc\u00e9 Law Group, tells Rolling Stone. \u201cOur filing sets out substantial corroborating evidence supporting the allegations, including contemporaneous communications and witness testimony. We believe the record makes clear that the claims have a substantial basis in law and fact and should proceed so that the evidence can be fully examined in court.\u201d<\/p>\n

\n\tRolling Stone has reached out to attorneys for West for comment. <\/p>\n

\n\tThe documents include screenshots of a lengthy exchange between An and La Roux\u2019s verified Instagram account. (In the messages, La Roux \u2014\u00a0a.k.a. Elly Jackson \u2014\u00a0provides an email address associated with her full name.)<\/p>\n

\n\tIn the 2024 messages, An reaches out to the \u201cBulletproof\u201d singer through the official La Roux account to ask whether the singer remembered the incident. Jackson confirms that she does, according to the court documents, writing: \u201cI have never seen the footage (thankfully) and obviously I asked for it to never be used or for it to be seen as you were understandably very concerned about anyone or your family seeing it.\u201d<\/p>\n

\n\t\u201cI\u2019m so sorry it happened,\u201d Jackson added, according to the lawsuit. <\/p>\n

\n\tThe court documents show additional messages where Jackson acknowledges that she previously publicly referred to the incident, but told An she felt that \u201cit wasn\u2019t my story to tell\u201d and that West \u201calready threatened me in some way.\u201d Jackson added, per the documents, \u201cHe wanted to remind me of his power and status and threatened me with my career essentially. I\u2019ve obviously continued to say how I feel about him regardless but I haven\u2019t told your story out of respect for you.\u201d<\/p>\n

\n\tIn 2020, Jackson said West caught wind of her commentary<\/a> and demanded she write him an apology email, which she said she did ironically, with a \u201cmassive grin on my face.\u201d<\/p>\n

\n\tReps for Jackson did not immediately respond to Rolling Stone\u2018s request for comment.<\/p>\n

\n\tAlso included in the exhibits is a signed statement from Liz Martins, a makeup artist who was on set that day, which offers further corroboration. Martins wrote that she saw West \u201cforcefully put his fingers down [An\u2019s] mouth and told her to, \u2018Suck on them.\u2019\u201d<\/p>\n

\n\t\u201cThis sexual assault was not a part of the script,\u201d Martins added. \u201cEveryone on set was shocked and nervous to step in because of Kanye\u2019s influence. Afterwards, [An] was crying and I heard her repeatedly say, \u2018My mom is going to see this. I don\u2019t want my mom to see this.\u2019\u201d<\/p>\n

\n\tMichelle An \u2014 who is unrelated to the plaintiff, model Jennifer An \u2014 also submitted an affirmation. She said that from her vantage point on set, she did not directly see West place his fingers inside An\u2019s mouth or around her neck. However, she recalled that West stood over the model and appeared to \u201cmove his thumb back and forth across the outside of [the] plaintiff\u2019s mouth.\u201d<\/p>\n

\n\tRegarding the rest of An\u2019s claims about West\u2019s actions, Michelle An wrote that she was \u201cnot saying that it did not happen, only that, from where I was located on the set, I did not \u2014 and could not \u2014 see it happen.\u201d<\/p>\n

\n\tThe rest of the exhibits contain reports from a third party private investigation firm who tracked down other crew members on the shoot, who both recalled West sticking his fingers down An\u2019s mouth.\u00a0West is currently in the middle of a trial for a separate civil lawsuit from a former worker at his $57 million Malibu mansion<\/a> in Los Angeles. He also faces a second sexual assault lawsuit from his former assistant Lauren Pisciotta<\/a>, who sued him in 2024.
