\n Nearly 150 retired federal and state judges have filed an amicus brief on Tuesday supporting AI company Anthropic in its lawsuit against the Trump administration<\/a> for designating it a \u201csupply chain risk,\u201d CNN has learned.\n <\/p>\n

\n The former judges, appointed by both Republicans and Democrats, join a growing list of Anthropic supporters that includes industry organizations and former senior national security government officials, as well as Microsoft and staffers from competing AI companies.\n <\/p>\n

\n The amicus brief underscores concerns raised in the tech, legal and national security community over the precedent the situation could set regarding government influence over private companies. For Anthropic, the stakes could be significant; the \u201csupply chain risk\u201d label could affect the company\u2019s contracts with the vast ecosystem of private-sector firms that do business with the military.\n <\/p>\n

\n \u201cMore fundamentally, as a practical matter, no one is trying to force the Department to contract with Anthropic,\u201d the judges wrote. \u201cInstead, Anthropic is asking only that it not be punished on its way out the door.\u201d\n <\/p>\n

\n The Pentagon \u201cmisinterpreted the statute and violated the necessary procedures\u201d when it labeled Anthropic a \u201csupply chain risk,\u201d they also wrote.\n <\/p>\n

\n The Defense Department designated Anthropic a \u201csupply chain risk\u201d earlier this month after negotiations over the use of the company\u2019s AI models in classified systems broke down<\/a>. The Pentagon wanted to use Claude in \u201call lawful\u201d cases, but Anthropic refused to back down over two key redlines: AI\u2019s use in autonomous weapons, and AI\u2019s use in mass surveillance of American citizens.\n <\/p>\n

\n The \u201csupply chain risk\u201d label is usually given to companies associated with foreign adversaries and has never been given to an American company in modern times. It means companies with military contracts must ensure that any use of Anthropic\u2019s tools are kept separate from that work.\n <\/p>\n

\n In addition to the \u2018supply chain risk\u2019 designation, President Donald Trump ordered all federal agencies to stop using Claude.\n <\/p>\n

\n Anthropic CEO Dario Amodei said the company had \u201cno choice but to challenge it in court.\u201d In response to Anthropic\u2019s lawsuit last week, White House spokesperson Liz Huston said the president \u201cwill never allow a radical left, woke company\u201d to dictate how the military operates.\n <\/p>\n

\n Anthropic\u2019s chief financial officer said in a legal filing that the company is at risk of losing \u201chundreds of millions\u201d in revenue in 2026 because of the government\u2019s action.\n <\/p>\n

\n In a filing<\/a> late Tuesday, responding to Anthropic\u2019s initial complaint, the Trump administration said Anthropic is now seeking \u201cto force the government to continue to use its products and services and to enjoin the designation,\u201d noting the Defense Department made the supply chain risk designation because of \u201cconcerns about Anthropic\u2019s potential future conduct if it retained access to the government\u2019s IT infrastructure.\u201d\n <\/p>\n

\n A hearing on Anthropic\u2019s request for a preliminary injunction on the government is set to take place next Tuesday.\n <\/p>\n

\n Tuesday\u2019s filing from the group of former judges comes after ethics experts and advocacy groups have raised concerns the potential long-term ramifications of the Trump administration\u2019s actions against Anthropic.\n <\/p>\n
