{"id":558525,"date":"2026-04-01T16:29:10","date_gmt":"2026-04-01T16:29:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/558525\/"},"modified":"2026-04-01T16:29:10","modified_gmt":"2026-04-01T16:29:10","slug":"the-actual-danger-of-trumps-phony-vote-by-mail-executive-order","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/558525\/","title":{"rendered":"The actual danger of Trump\u2019s phony vote-by-mail executive order."},"content":{"rendered":"<p class=\"slate-paragraph slate-graf\" data-word-count=\"21\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfjbkgw003s3b7c1zj8e0km@published\"><a href=\"https:\/\/slate.com\/theslatest?utm_source=slate&amp;utm_medium=article&amp;utm_campaign=article_plain_text_topper&amp;sailthru_source=Article-TopperText-CTA\" rel=\"nofollow noopener\" target=\"_blank\">Sign up for the Slatest<\/a> to get the most insightful analysis, criticism, and advice out there, delivered to your inbox daily.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"10\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixtzc001oncm564r3fsau@published\">Sometimes it\u2019s the chaos, not the <a href=\"https:\/\/www.theatlantic.com\/ideas\/archive\/2018\/10\/the-cruelty-is-the-point\/572104\/\" rel=\"nofollow noopener\" target=\"_blank\">cruelty<\/a>, that\u2019s the point.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"104\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixxwe000o3b7clezdij38@published\">That certainly seems true of President Donald Trump\u2019s <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/03\/ensuring-citizenship-verification-and-integrity-in-federal-elections\/\" rel=\"nofollow noopener\" target=\"_blank\">second executive order<\/a> on elections, issued on Tuesday. The order purports, among other things, to direct the United States Department of Homeland Security to create a list of all U.S. citizens over 18, to supply that list to states, and for the United States Postal Service to refuse to accept mailed-in ballots from voters unless that voter\u2019s name appears on a list of the state\u2019s eligible voters that it has given USPS months before the election (a list which presumably the state would have to match with the DHS\u2019 list, though that part\u2014among many others!\u2014is <a href=\"https:\/\/electionlawblog.org\/?p=155196\" rel=\"nofollow noopener\" target=\"_blank\">unclear<\/a>).<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"85\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixxzk000p3b7c729ec3zd@published\">The order will face multiple court challenges and likely will be found unconstitutional by courts. Even if courts did not intervene before November, the multiple rulemakings and new procedures for DHS, USPS, and state and local election officials envisioned by the order would be impossible to implement before November\u2019s elections. Indeed, the order is so underwhelming that it suggests Trump\u2019s real purpose was not its implementation but to create more confusion and litigation around elections, further undermining voter confidence in the integrity of American elections.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"87\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixy2v000q3b7cqeantf2u@published\">To understand the likely fate of this new executive order, we should begin with his <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/preserving-and-protecting-the-integrity-of-american-elections\/\" rel=\"nofollow noopener\" target=\"_blank\">first executive order<\/a> on elections, issued in March 2025. That order, like the new one, was marketed as a means for the president to protect the integrity of federal elections by changing federal election rules. Among other things, the first order purported to direct an independent federal agency, the U.S. Election Assistance Commission, to enact new rules requiring that people using a federal form for voter registration supply documentary proof of citizenship.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"55\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixyay000r3b7cmf4aadj4@published\">The problem Trump faced with the first executive order is that the Constitution gives the president no role to play in the conduct of elections. Federal District Court Judge Colleen Kollar-Kotelly, <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/judge-blocks-additional-citizenship-provisions-in-latest-setback-to-trumps-wide-ranging-election-executive-order\" rel=\"nofollow noopener\" target=\"_blank\">enjoining<\/a> key parts of that order, wrote: \u201cPut simply, our Constitution does not allow the President to impose unilateral changes to federal election procedures.\u201d<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"127\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixyec000s3b7cp1vwonp7@published\">The new EO should fare no better. To put this in plain terms: The order would use the USPS, which is not under the direct control of the president, to interfere with a state\u2019s lawful transmission of ballots if the state did not comply with Trump\u2019s rules. It would also provide no mechanism for eligible voters who move to the state or register with the state for the first time in the weeks before the election to cast a ballot by mail because they would not be on the state\u2019s list. This alone interferes with both the state\u2019s right to conduct its elections as well as Congress\u2019s ultimate right to resolve any election disputes by looking at the ballots cast by all of the state\u2019s eligible voters.<\/p>\n<p>    <a href=\"https:\/\/slate.com\/news-and-politics\/2026\/03\/supreme-court-analysis-sonia-sotomayor-trump-free-press.html\" class=\"recirc-line__content\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>          <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/04\/cc55436c-0a89-4793-af07-a4667014cd77.jpeg\" width=\"141\" height=\"94\"   alt=\"\" loading=\"lazy\"\/><\/p>\n<p>\n          Shirin Ali<br \/>\n        Sonia Sotomayor Just Issued a Stirring Defense of One of Trump\u2019s Biggest Targets<br \/>\n        Read More\n      <\/p>\n<p>    <\/a><\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"68\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixyhh000t3b7cbgqegakn@published\">The upshot is this: The president does not have this authority to interfere in state election processes. The new order cites to two federal voting statutes, <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artIV-S4-2\/ALDE_00013636\/\" rel=\"nofollow noopener\" target=\"_blank\">a part of Article 4<\/a> of the Constitution, saying that \u201cthe United States shall guarantee to every State in this Union a Republican Form of Government.\u201d These sources, though, do not give him authority to force states to change their election rules.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"69\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixypi000u3b7c8gfqewg2@published\">Indeed, Article 1, Section 4 of the Constitution says that states through their legislatures set the rules for congressional elections, subject to congressional override. States also have authority under the 10th Amendment\u2019s reservation to the states and people the power to run their own state elections. Article 1 also gives states the right to set voter qualifications, even in federal elections. The president has no role to play here.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"53\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixysl000v3b7coriyehlq@published\">Trump is also trying to exert power over USPS, which Congress in the <a href=\"https:\/\/www.congress.gov\/bill\/91st-congress\/house-bill\/17070\/text\" rel=\"nofollow noopener\" target=\"_blank\">Postal Reorganization Act of 1970<\/a> recast as an independent agency. Just like Trump failed in claiming power over the Election Assistance Commission in his first executive order, he will likely fail in claiming power over USPS in his second one.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"119\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixyvs000w3b7ccepxokhb@published\">Critically, even if courts don\u2019t put Trump\u2019s new order on hold as lawsuits work their way through the courts, the timing here makes these rules virtually impossible to implement in time for November\u2019s elections. The order calls for extensive rulemaking by both DHS and USPS, and complicated implementation rules for the states, including rules related to the types of envelopes states must use and forms of ballot tracking. Such changes cannot be done on the fly, as we learned during the 2020 COVID-laden elections. That\u2019s not to mention the need to resolve questions about the relationship between the citizen lists created by DHS and state voters lists that states must provide to USPS to get their voters\u2019 ballots accepted.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"82\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixyz8000x3b7cecshyu1i@published\">This half-assed effort is surely going to disappoint the election-fraud conspiracy theorists whom Trump has cultivated. Consider how mild the new order is compared\u00a0<a href=\"https:\/\/www.washingtonpost.com\/politics\/2026\/02\/26\/trump-elections-executive-order-activists\/\" rel=\"nofollow noopener\" target=\"_blank\">to the draft EO<\/a> leaked to the Washington Post from election conspiracy theorists. It would have had Trump declare a national emergency and take over all aspects of federal elections, from registration and voting machines to voter ID, banning almost all mail ballots, and more. (The Constitution has no emergency exception that would give the president powers over elections.)<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"84\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixz42000y3b7c3pl0j5nv@published\">Rather than opting for an outlandishly illegal order, Trump went for a weaker (though still illegal) order that will have to be hashed out in courts, over time, keeping in the news the \u201ccheating\u201d that Trump falsely claims is endemic to mail balloting. He knows he is likely to lose, <a href=\"https:\/\/www.washingtonpost.com\/politics\/2026\/03\/31\/trump-mail-voting-executive-order\/?pwapi_token=eyJ0eXAiOiJKV1QiLCJhbGciOiJIUzI1NiJ9.eyJyZWFzb24iOiJnaWZ0IiwibmJmIjoxNzc0OTI5NjAwLCJpc3MiOiJzdWJzY3JpcHRpb25zIiwiZXhwIjoxNzc2MzExOTk5LCJpYXQiOjE3NzQ5Mjk2MDAsImp0aSI6IjFhM2Y2OTFkLWFlYmQtNGU5YS1iODBhLTI5NGQ0NWNmMDVjOCIsInVybCI6Imh0dHBzOi8vd3d3Lndhc2hpbmd0b25wb3N0LmNvbS9wb2xpdGljcy8yMDI2LzAzLzMxL3RydW1wLW1haWwtdm90aW5nLWV4ZWN1dGl2ZS1vcmRlci8ifQ.47I0-fzVaMF8q5B0wfHSwFRQ6Ky2MSKnq6grbw0uoVQ\" rel=\"nofollow noopener\" target=\"_blank\">telling the press<\/a> while signing the EO: \u201cThey\u2019ll probably challenge it.  \u2026 You find a rogue judge\u2014a lot of rogue judges. Very bad, bad people. Very bad judges. And hopefully we\u2019ll win on appeal.\u201d<\/p>\n<p>          <a href=\"https:\/\/slate.com\/news-and-politics\/2026\/03\/supreme-courts-big-voting-case-moore-watson-fail.html\" class=\"in-article-recirc__link\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>            The Supreme Court\u2019s Big Voting Case Embraces an Approach It Rejected Just Three Years Ago<br \/>\n          <\/a><\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"152\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixz77000z3b7cnla912zb@published\">The point, though, isn\u2019t to win in court. Trump is engaging in election-denialism theater. It makes voters of all sides mistrust the election process and the virtues of democracy. It convinces his supporters that Democrats have to cheat to win, something that will come in handy should Democrats take back control of the House in November with the intent of beginning investigations and potentially impeachment. It lets Trump, the most powerful person on earth, paint himself as a victim of fraud and of \u201cbad, bad\u201d judges. It also puts into question the rules of an election that is just months away, giving voters reason to fear that the Postal Service could sabotage their ballots. (The recent Supreme Court <a href=\"https:\/\/slate.com\/news-and-politics\/2026\/02\/supreme-court-analysis-clarence-thomas-mail-voting.html\" rel=\"nofollow noopener\" target=\"_blank\">ruling<\/a> saying that Postal Service employees cannot be held liable for intentionally failing to deliver mail surely doesn\u2019t help that perception.) Trump\u2019s executive order seems aimed to sow chaos in elections and depress turnout.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"52\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmnfixzaj00103b7cnkvxaqk9@published\">We will look back at Donald Trump\u2019s presidency as years where the concept of election integrity got turned on its head. In the name of protecting democracy, Trump is breaking democracy.
