Tiger Woods\u2019 attorney is challenging Florida prosecutors seeking a subpoena for the golfer\u2019s prescription medications from a pharmacy, according to court records filed in Martin County (Fla.) Circuit Court on Tuesday.<\/p>\n
Prosecutors requested the number of times Woods\u2019 prescriptions were filled at Lewis Pharmacy in Palm Beach, Fla., from Jan. 1 to March 27, the day of Woods\u2019 car crash<\/a> in Jupiter Island. Attorney Douglas Duncan objected to the state\u2019s request for a subpoena and is asking the court to conduct a hearing to determine if the prescription records are \u201crelevant to a criminal investigation.\u201d<\/p>\n In the filing on April 8<\/a>, prosecutors also requested \u201cdate and time prescription was filled, type of prescription, number of pills in each prescription, the dosage amount, all special instructions on how to take the medication, date of next refill, all warnings, including but not limited to operating a motor vehicle while taking the prescription.\u201d<\/p>\n \u201cIn the event the court grants the State\u2019s request to issue a subpoena for Mr. Woods\u2019 prescription records, the defense requests that the court enter a protective order governing the use and release of the records,\u201d Duncan said in the filing.<\/p>\n Duncan also wrote that if the court decides to grant the state\u2019s request for a subpoena, the judge shall enter a protective order \u201cproviding that the prescription records shall be confidentially reviewed by the state, its law enforcement officers, any state experts and the defense.\u201d Duncan added that the records shall not be disclosed to any third party, which would prohibit their release in response to any public records request.<\/p>\n \u201cIf and when it becomes necessary for the state to publicly disclose said records or any portion of said records, that a hearing must be held to determine the necessity of said disclosure,\u201d Duncan wrote.<\/p>\n The Athletic\u00a0has reached out to Duncan and Lewis Pharmacy for comment and will update this story if they respond.<\/p>\n Authorities arrested Woods, 50, following the crash after he failed a sobriety test. While the breathalyzer test showed no traces of alcohol, Woods refused to take a urine test, and according to officers, admitted to taking \u201ca few pills.\u201d Two hydrocodone pills were later found in Woods\u2019 pocket, according to an arrest affidavit<\/a> released by the Martin County Sheriff\u2019s Office and reviewed by The Athletic.<\/p>\n Woods pleaded not guilty to one DUI count and one count of refusing a urinalysis test.
