Arbitration decisions, it turns out, are like cockroaches. They\u2019re very hard to kill.\u00a0<\/p>\n

It\u2019s a long held truism in the legal world, and it was underscored this week<\/a> when a federal judge shot down a health insurer\u2019s lawsuit challenging No Surprises Act arbitration decisions. The ruling doesn\u2019t bode well for other pending lawsuits challenging awards doled out under the 2020 law\u2019s arbitration process, known as independent dispute resolution.\u00a0\u00a0<\/p>\n

\u201cYou can\u2019t second guess the arbitrators,\u201d said Chris Deacon, a health policy consultant and former lawyer. \u201cThat\u2019s the whole point of arbitration.\u201d<\/p>\n
