Jury is still out"},"content":{"rendered":"<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoa6uli3006z26p38g9s9pic@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Just looking at the raw numbers, less than 1% of filers have been audited by the IRS in recent tax years. Based on the latest data available, for example, in tax year 2021 the IRS pursued a mere 0.3% of filers overall.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6600003b6qgr5qpu1m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The audit rate has been higher for select groups of taxpayers based on certain characteristics \u2013 like the amount or types of income they report or specific tax breaks they claim. But even there, with very few exceptions, audits typically affect less than 10% of any given group and often a far smaller share \u2013 smaller as in, again, less than 1%.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6700013b6qreybadh1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But a lot has changed for the IRS in the past year.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafm2mi00133b6qi9gf97qo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A large percentage of employees were laid off or resigned, including many highly experienced in areas of enforcement and complex audits. Just over a quarter of both tax examiners and revenue agents were among them, according to a July 2025 <a href=\"https:\/\/www.tigta.gov\/sites\/default\/files\/reports\/2025-08\/2025ier027fr.pdf\" target=\"_blank\" rel=\"nofollow noopener\">report<\/a> from the Treasury Inspector General for Tax Administration.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafmsa000173b6q2bimyi2l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And a majority of funding for enforcement promised under the 2022 Inflation Reduction Act was rescinded and the Trump administration is seeking to <a href=\"https:\/\/taxpolicycenter.org\/sites\/default\/files\/2026-04\/THE%20STATE%20OF%20FEDERAL%20TAX%20ADMINISTRATION%20IN%202026.pdf\" target=\"_blank\" rel=\"nofollow noopener\">cut IRS funding further<\/a> next year.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafmive00153b6qdssv9b4p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the same time, the agency has been modernizing its antiquated systems and <a href=\"https:\/\/www.gao.gov\/products\/gao-26-107522\" target=\"_blank\" rel=\"nofollow noopener\">increasing its use of AI<\/a> in a number of areas, including enforcement. \u201cThe IRS is using artificial intelligence (AI) and advanced analytics to identify high-risk areas of non-compliance and fraud with greater accuracy,\u201d IRS CEO Frank Bisignano said in written testimony before the Senate Finance Committee earlier this month. Among his stated goals for the agency: \u201cAdvancing a strong compliance agenda while improving collections beyond historical norms.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6700023b6q9fflebwd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            How will the combination of these big changes affect any filer\u2019s chance of being audited in the coming years?\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6700033b6qgr5vbok4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It\u2019s not clear, for several reasons, not least of which are a) whether the technology will be used <a href=\"https:\/\/www.gao.gov\/products\/gao-26-107522\" target=\"_blank\" rel=\"nofollow noopener\">responsibly and strategically<\/a>, as former IRS Commissioner Danny Werfel put it; and b) whether there will be a sufficient number of experienced IRS employees to successfully select and audit returns that AI identifies as potentially suspect.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6700053b6qoqnbprp0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Ideally, AI will help keep the IRS off the back of perfectly compliant tax filers \u2013 thereby reducing the rate of so-called \u201cno change\u201d audits. Those are audits undertaken by the IRS which result in no revenue raised because, well, it found nothing wrong.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6700063b6qktq33bqz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And it can help better identify anyone underreporting their income or otherwise violating tax rules.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6700073b6qh4lk5jic@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt will make the IRS more efficient in finding noncompliance,\u201d said Barry Johnson, former chief data and analytics officer at the IRS who, among other things, oversaw how the agency used AI.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6700083b6qo7hue66j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            AI has the capacity to search and identify patterns in tax returns that would take humans and the IRS\u2019 older statistical models a lot longer to unearth, if ever. It can identify returns with anomalies, which might indicate anything from a filer mistakenly underreporting income to committing outright fraud.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht6700093b6qbgdo13oz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAI gives us a forensic edge to select the right returns for audit,\u201d Werfel said. \u201cIt\u2019s almost like purchasing night-vision goggles. They help figure out which returns to select, and where the tax evasion is.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000b3b6qc55a4a0l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            If used responsibly, he added, AI could lead to more taxpayers with unpaid balances being contacted.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000c3b6qo7og7r4q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            By responsibly, he means that the IRS will have to balance \u201cthe use of AI with a human review \u2013 double checking and confirming AI is generating reliable output.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000d3b6q0mt5jvrw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In particular, the use of AI could raise the rate of \u201ccorrespondence audits\u201d \u2013 which is the most typical type of audit the IRS pursues, as opposed to the more time-and-resources-intensive field audits and office audits.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000e3b6qt79ave2u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In a <a href=\"https:\/\/www.taxpayeradvocate.irs.gov\/news\/nta-blog\/nta-blog-lifecycle-of-a-tax-return-correspondence-audits-increased-communication-alternatives-are-in-progress\/2021\/09\/\" target=\"_blank\" rel=\"nofollow noopener\">correspondence audit<\/a>, the agency sends a letter to a filer indicating that more money may be owed (or that it is withholding their refund) based on one or two discrete issues on their return for given single tax year. And the filer must either send in payment or <a href=\"https:\/\/www.taxpayeradvocate.irs.gov\/notices\/taxpayer-disagrees-with-assessment\/\" target=\"_blank\" rel=\"nofollow noopener\">take steps<\/a> if they wish to challenge the assessment.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000h3b6q7gyu4lbn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But if the agency pursues more correspondence audits, it will need to make sure they have enough trained staff to address those filers affected who call with questions, Werfel said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000i3b6qyovfkmse@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The same is true when AI unearths problems with substantially more complex returns that may require a field or office audit.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000j3b6qcxlra2h6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At present, given how much expertise walked out the door last year, experienced enforcement employees may be in short supply. \u201cI don\u2019t think AI is going to substitute for the staff who have been lost. You still need people who are experts to conduct an audit by meeting with taxpayers and reviewing their books and records to determine if their tax return is accurate,\u201d said Johnson, who is now a nonresident fellow at the Urban-Brookings Tax Policy Center.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000l3b6q05tl322b@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Another reason it\u2019s hard to predict what will happen to audit rates is AI itself. It\u2019s developing so quickly that it may be able to do more in the future than what it can do today.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmoafht67000m3b6q1dfimahp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWhen you decide to be aggressive, to bend the rules or break them, look at the IRS capacity not just now, but years from now,\u201d Werfel said. \u201cIt\u2019s hard to know what surveillance and assessment powers AI will have \u2026.
