California Democrats want to dramatically expand who can perform abortions and when \u2014 despite warnings from experts.<\/p>\n
A controversial bill is making its way through state legislature seeking to let nurse practitioners handle abortions into the third trimester.<\/p>\n
Assembly Bill 1973, introduced by Assemblymember Cecilia Aguiar-Curry and coauthored by Assemblymember Dawn Pellerin, passed out of committee <\/a>last week and now heads to the Assembly Appropriations Committee, its next stop before a full Assembly vote.<\/p>\n The proposal seeks to amend multiple sections of California\u2019s Business and Professions Code, marking a notable shift in state law governing abortion providers<\/a>.<\/p>\n Abortion-rights activists rally outside the First Street U.S. Courthouse, Central District of California, in downtown Los Angeles AP<\/p>\n Assemblymember Cecilia Aguiar-Curry introduced the bill.<\/p>\n Under current law, nurse practitioners, certified nurse-midwives, and physician assistants are allowed to perform certain abortions<\/a> \u2014 but only during the first trimester and typically under more limited definitions such as medication or aspiration procedures.<\/p>\n AB 1973 would remove that first-trimester restriction entirely.<\/p>\n If passed, the bill would allow those same non-physician providers to perform \u201cprocedural abortions\u201d beyond the early stages of pregnancy, so long as they are trained and acting within their scope of practice.<\/p>\n \u201cThis is gonna put women in California in danger and it\u2019s going to be women in rural communities, and they don\u2019t have access to doctors<\/a>.<\/p>\n \u201cIt is going to affect women in poor places,\u201d Greg Burt, president of the California Family Council, who testified against the bill, told the California Post.<\/p>\n \u201cYou would think if you\u2019re pro-choice, you would still be concerned and that safe abortions would be needed, but that is not the case.\u201d<\/p>\n The legislation also broadens the terminology from specific methods to the wider category of \u201cprocedural abortion,\u201d while requiring providers to demonstrate clinical competency through approved training programs.<\/p>\n Backers of the bill say it addresses ongoing gaps in access to abortion care, particularly in underserved areas.<\/p>\n Critics argue the changes to abortion practices in the state of California could put patients at risk. AP<\/p>\n \u201cThe reality is simple. We already have a workforce that is trained, qualified, and ready to provide this care, but they are restricted in their ability to do so,\u201d said Aguiar-Curry who presented her bill to the committee.<\/p>\n \u201cNurse practitioners, certified nurse midwives, and physician assistants, also known as advanced practiced clinicians APCs, receive extensive education and training.\u201d<\/p>\n \u201cThey are already safely providing a range of reproductive health services in California today. They\u2019ve demonstrated their competency and training, but state law has not kept up,\u201d she added. <\/p>\n Tania Basu Serna, a licensed obstetrician and physician, also spoke in support of the bill during the hearing.<\/p>\n \u201cThe evidence is clear. Abortion care is safe, and appropriately trained advanced practice clinicians provide this care with the same safety, quality, and patient satisfaction outcomes as physicians,\u201d she said. <\/p>\n Critics, however, argue the changes could put patients at risk \u2014 particularly in later-stage procedures that may involve higher medical complexity.<\/p>\n Registered nurse Mindy Hertzel testified in opposition, citing her experience in high-risk obstetrics.<\/p>\n Mindy Hertzel, a registered nurse and Director of Clinic Operations at Sierra Pregnancy and Health, testified in opposition, citing her experience in high-risk obstetrics.<\/p>\n \u201cSecond and third trimester abortions are not simple procedures,\u201d Hertzel told committee members. \u201cRisks include hemorrhage, infection, uterine perforation, cervical laceration, amniotic embolism, and more, all of which are life-threatening. When complications occur, they escalate quickly and require immediate experienced interdisciplinary intervention.\u201d<\/p>\n While the bill allows some providers to operate without direct physician supervision, it includes provisions requiring nurse practitioners and certified nurse-midwives to establish protocols for consultation, referrals, and transfers of care in complex or emergency situations.<\/p>\n AB 1973 is currently mid-way through California\u2019s legislative process.<\/p>\n After being introduced in February, the bill was heard in policy committee, where lawmakers debated its merits and heard testimony from both supporters and opponents. With committee approval secured, it now moves to the Assembly Appropriations Committee, where lawmakers will evaluate its fiscal impact.<\/p>\n If it passes Appropriations, it would proceed to a full vote on the Assembly floor. The legislature would reject that immediately. So why does abortion get special exemption?\u201d<\/p>\n The debate is unfolding within California\u2019s broader abortion framework.<\/p>\n In the state, abortion is legal until fetal viability, generally considered to be between 24 and 26 weeks of pregnancy. After viability, abortions are permitted if necessary to protect the life or health of the pregnant person.<\/p>\n The issue has taken on added national significance since June 24, 2022, when the US Supreme Court overturned\u00a0Roe v. Wade\u00a0in\u00a0Dobbs v. Jackson Women\u2019s Health Organization. The 6\u20133 ruling ended nearly 50 years of federal abortion protections and returned authority over abortion laws to individual states.<\/p>\n In California abortion is legal until fetal viability, generally considered to be between 24 and 26 weeks of pregnancy.
