{"id":622039,"date":"2026-05-04T01:29:16","date_gmt":"2026-05-04T01:29:16","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/622039\/"},"modified":"2026-05-04T01:29:16","modified_gmt":"2026-05-04T01:29:16","slug":"aseans-rules-of-origin-problem-lowy-institute","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/622039\/","title":{"rendered":"ASEAN\u2019s rules-of-origin problem | Lowy Institute"},"content":{"rendered":"<p>In July last year, the Trump administration gave itself <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/07\/further-modifying-the-reciprocal-tariff-rates\/\" rel=\"nofollow noopener\" target=\"_blank\">the power<\/a> to enact 40% tariffs on the \u201ctransshipment\u201d of goods.<\/p>\n<p>These tariffs caused a frisson of anxiety throughout the Association of Southeast Asian Nations members, where it was widely understood that the principal target was the putative practice of Chinese companies using Southeast Asian countries as a conduit for tariff evasion.<\/p>\n<p>Transshipment is <a href=\"https:\/\/www.lowyinstitute.org\/the-interpreter\/vietnam-s-case-what-exactly-target-trump-s-transshipment-tariffs\" rel=\"nofollow noopener\" target=\"_blank\">notoriously difficult<\/a> to measure, but is typically defined as shipping goods to their final destination via a third country without \u201csubstantial transformation\u201d. A classic example would be a Chinese company unboxing solar panels in Malaysia or Vietnam for some light polishing, before final export to the United States.<\/p>\n<p>Vietnam, which is tightly interwoven with southern Chinese supply chains, is sometimes regarded as a major culprit. Trade advisor Peter Navarro has <a href=\"https:\/\/www.lowyinstitute.org\/the-interpreter\/vietnam-s-case-what-exactly-target-trump-s-transshipment-tariffs\" rel=\"nofollow noopener\" target=\"_blank\">claimed<\/a> that a third of Vietnamese exports to the US are in fact Chinese goods.<\/p>\n<p class=\"article-quote-right\">Perversely, overly restrictive rules of origin may even negate the tariff-driven cost advantage that ASEAN countries enjoy over China.<\/p>\n<p>Although some transshipment does occur, its prevalence is likely grossly exaggerated. One influential Harvard study found that just <a href=\"https:\/\/www.hbs.edu\/ris\/Publication%20Files\/24-072_d5780e10-7ebe-405a-840d-0d64c13aa2f2.pdf\" rel=\"nofollow noopener\" target=\"_blank\">9%<\/a> of the growth in Vietnamese exports to the US between 2018\u201321 was due to transshipment.<\/p>\n<p>Reliance on Chinese supply chains is growing but probably overestimated. A Lowy <a href=\"https:\/\/www.lowyinstitute.org\/publications\/navigating-storm-southeast-asia-global-trade-shocks\" rel=\"nofollow noopener\" target=\"_blank\">analysis<\/a> using data from 2022 put China\u2019s total share of value-added in ASEAN\u2019s US-bound global value chain exports at 18%.<\/p>\n<p>The veracity of Navarro\u2019s claims is, in one sense, immaterial in a White House where sentiment routinely wins out over technocratic analysis. In any case, the US does not appear to have enforced transshipment tariffs with much vigour.<\/p>\n<p>According to veteran US trade negotiator <a href=\"https:\/\/www.wsj.com\/world\/china\/rules-of-origin-set-up-u-s-china-clash-in-asia-1eea1d01\" rel=\"nofollow noopener\" target=\"_blank\">Wendy Cutler<\/a>, working out how to define and enforce transshipment proved too complicated given the extraordinarily ambitious timeline that Washington set for concluding trade agreements with ASEAN countries. Instead, the US included a placeholder in agreements for future discussions on rules of origin, such as in <a href=\"https:\/\/ustr.gov\/sites\/default\/files\/files\/Press\/Releases\/2026\/02.19.26%20US-IDN%20ART%20Full%20Agreement%20-%20US%20Final%20for%20Website%20sanitized.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Article 4.1<\/a> of the US-Indonesia agreement. These negotiations, which Cutler anticipates will begin in earnest shortly (likely after the US finds an <a href=\"https:\/\/www.piie.com\/blogs\/realtime-economics\/2026\/whats-next-trumps-tariffs\" rel=\"nofollow noopener\" target=\"_blank\">enduring legal basis<\/a> to reconstitute its \u201creciprocal tariffs\u201d), will define the maximum permissible level of Chinese content in goods qualifying for reduced US tariff rates.<\/p>\n<p>Much is at stake in these otherwise highly arcane and technical discussions.<\/p>\n<p>              <img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/05\/8759176354_1a7fe9de2e_k.jpg\" width=\"2047\" height=\"1281\" alt=\"The Special Economic Zone in Khan Posenchey, Phnom Penh, Cambodia (Chhor Sokunthea\/World Bank)\" typeof=\"foaf:Image\"\/><\/p>\n<p>The Special Economic Zone in Khan Posenchey, Phnom Penh, Cambodia (Chhor Sokunthea\/World Bank)<\/p>\n<p>The Biden administration was <a href=\"https:\/\/www.afr.com\/policy\/foreign-affairs\/how-this-asia-guru-rates-australia-s-foreign-policy-20220914-p5bi3v\" rel=\"nofollow noopener\" target=\"_blank\">widely criticised<\/a> for the dearth of any substantive trade agenda with ASEAN. With the benefit of hindsight, tectonic economic forces proved more influential than any trade agreement. By 2024, and for the first time <a href=\"https:\/\/asia.nikkei.com\/spotlight\/comment\/trump-s-economic-weaponization-hurts-asean-as-free-trade-hub\" rel=\"nofollow noopener\" target=\"_blank\">since 2007<\/a>, the US overtook China as ASEAN\u2019s largest export market.<\/p>\n<p>This was a natural result of the confluence of China\u2019s tepid consumption, chronic overcapacity and reinvigorated mercantilism after the 2021 property collapse. Irrepressible US demand and tariff-induced supply chain reorientation out of China have likewise played major roles.<\/p>\n<p>US-bound exports from Malaysia, Thailand and Vietnam proved impervious to tariffs, recording <a href=\"https:\/\/asia.nikkei.com\/economy\/trade\/vietnam-thailand-log-higher-us-trade-surpluses-in-2025-despite-tariffs\" rel=\"nofollow noopener\" target=\"_blank\">healthy<\/a> growth in 2025. ASEAN\u2019s overall shipments to the US registered <a href=\"https:\/\/ustr.gov\/countries-regions\/southeast-asia-pacific\/association-southeast-asian-nations-asean\" rel=\"nofollow noopener\" target=\"_blank\">29% growth<\/a>.<\/p>\n<p>The contrast in <a href=\"https:\/\/www.ft.com\/content\/ea4c95c0-af00-4b79-8b7e-4bbe6d5e19f9?syn-25a6b1a6=1\" rel=\"nofollow noopener\" target=\"_blank\">ASEAN\u2019s exports<\/a> to China is stark. Across 2025, the Philippines, Malaysia and Vietnam all registered a decline in shipments to China. Thailand recorded modest growth after three years of contraction, while Indonesia registered a 15% increase \u2013 albeit after two consecutive years of decline.<\/p>\n<p>Meanwhile, China\u2019s trade surplus with ASEAN has reached new heights, with the bloc now absorbing <a href=\"https:\/\/www.ft.com\/content\/ea4c95c0-af00-4b79-8b7e-4bbe6d5e19f9?syn-25a6b1a6=1\" rel=\"nofollow noopener\" target=\"_blank\">18%<\/a> of Chinese exports.<\/p>\n<p>These figures point to a geopolitically fraught reality. Chinese shipments of raw materials as well as intermediate and capital goods are <a href=\"https:\/\/asiasociety.org\/policy-institute\/asean-caught-between-chinas-export-surge-and-global-de-risking#:~:text=While%20ASEAN%20has%20benefited%20from%20increased%20Chinese%20investment%20and%20greater,export%20opportunities%20to%20China%20diminish.\" rel=\"nofollow noopener\" target=\"_blank\">undoubtedly<\/a> helping to facilitate ASEAN\u2019s US export boom, as have Chinese investors using\u00a0predominantly\u00a0home market suppliers.<\/p>\n<p>ASEAN nations will be wary of uprooting established supply chains benefiting from high-quality, low-cost Chinese goods. Perversely, overly restrictive rules of origin may even negate the tariff-driven cost advantage that ASEAN countries enjoy over China.<\/p>\n<p>Politically, Beijing can be expected to pull out all the stops to induce ASEAN nations to resist US rules of origin efforts. ASEAN would have much greater leverage to defend its own interests \u2013 though the chances of a joint approach materialising are <a href=\"https:\/\/www.freiheit.org\/southeast-and-east-asia\/divided-we-fall-aseans-response-trumps-illiberal-trade-agenda\" rel=\"nofollow noopener\" target=\"_blank\">vanishingly small<\/a>.<\/p>\n<p>Still, a surgical and very gradual tightening of rules of origin could still be to ASEAN\u2019s benefit. ASEAN governments, particularly in <a href=\"https:\/\/www.lowyinstitute.org\/the-interpreter\/national-champions-vietnam-s-solution-middle-income-trap\" rel=\"nofollow noopener\" target=\"_blank\">Vietnam<\/a>, <a href=\"https:\/\/www.reuters.com\/plus\/malaysia-a-soaring-semiconductor-opportunity\" rel=\"nofollow noopener\" target=\"_blank\">Malaysia<\/a> and <a href=\"https:\/\/www.csis.org\/blogs\/charting-geoeconomics\/indonesian-industrialization-downstreaming-value-chain\" rel=\"nofollow noopener\" target=\"_blank\">Indonesia<\/a>, are exercised by the problem of how to capture more value from exports.<\/p>\n<p>Though there is enormous <a href=\"https:\/\/asia.nikkei.com\/business\/technology\/vietnam-s-tech-transfers-haven-t-risen-despite-export-surge-report\" rel=\"nofollow noopener\" target=\"_blank\">variance<\/a>, Chinese companies in ASEAN are generally not favourably regarded for their willingness to <a href=\"https:\/\/www.foreignaffairs.com\/china\/china-squeezing-southeast-asia\" rel=\"nofollow noopener\" target=\"_blank\">source locally<\/a>. With the right design, rules of origin could give host governments more leverage to demand much greater technology transfer and use of local content.
