{"id":622163,"date":"2026-05-04T03:03:13","date_gmt":"2026-05-04T03:03:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/622163\/"},"modified":"2026-05-04T03:03:13","modified_gmt":"2026-05-04T03:03:13","slug":"the-fifth-circuit-would-like-to-run-the-united-states","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/622163\/","title":{"rendered":"The Fifth Circuit would like to run the United States"},"content":{"rendered":"<p>On May 1, the U.S. Court of Appeals for the Fifth Circuit <a href=\"https:\/\/substack.com\/@chrisgeidner\/note\/c-252319120\" rel=\"nofollow noopener\" target=\"_blank\">issued a ruling<\/a> that would ban the mailing of an abortion drug during litigation \u2014 an order that the court acknowledged would have nationwide effect. <\/p>\n<p>Although the drugmakers quickly <a href=\"https:\/\/www.lawdork.com\/p\/mifepristone-supreme-court-return-mailing\" rel=\"nofollow noopener\" target=\"_blank\">went to the U.S. Supreme Court<\/a> seeking relief, the decision in Louisiana v. U.S. Food and Drug Administration immediately upended the post-Roe landscape in the United States. <\/p>\n<p>It was one of a trio of issues in which the appeals court and the district court judges who are subject to the court\u2019s appellate jurisdiction sought to act this past week in ways that could have varying levels of control and influence outside of the Fifth Circuit states of Louisiana, Mississippi, and Texas.<\/p>\n<p>And though it is true that the Supreme Court has regularly reversed the Fifth Circuit in recent years, that \u2014 as I\u2019ve <a href=\"https:\/\/www.lawdork.com\/p\/scotus-conservatives-made-clear-they\" rel=\"nofollow noopener\" target=\"_blank\">written previously<\/a> \u2014 paints a misleading picture, because many of the court\u2019s rulings are also affirmed by the Supreme Court or not even reviewed by it. More importantly, this report explains why, regardless of what the Supreme Court ultimately does, the Fifth Circuit\u2019s actions can be (and are often intended to be) extremely destabilizing in the interim.<\/p>\n<p data-attrs=\"{&quot;url&quot;:&quot;https:\/\/www.lawdork.com\/p\/the-fifth-circuit-would-like-to-run-the-us?utm_source=substack&amp;utm_medium=email&amp;utm_content=share&amp;action=share&quot;,&quot;text&quot;:&quot;Share&quot;,&quot;action&quot;:null,&quot;class&quot;:null}\" data-component-name=\"ButtonCreateButton\" class=\"button-wrapper\"><a href=\"https:\/\/www.lawdork.com\/p\/the-fifth-circuit-would-like-to-run-the-us?utm_source=substack&amp;utm_medium=email&amp;utm_content=share&amp;action=share\" class=\"button primary\" rel=\"nofollow noopener\" target=\"_blank\">Share<\/a><\/p>\n<p>First, as to the mifepristone ruling, the appeals court took advantage of one of the ways in which the U.S. Supreme Court allowed nationwide effects of court rulings even after <a href=\"https:\/\/www.lawdork.com\/p\/scotus-conservatives-end-universal\" rel=\"nofollow noopener\" target=\"_blank\">its 2025 decision ending \u201cuniversal injunctions.\u201d<\/a> The ruling itself asserted that nationwide injunctions were impermissible when they provided protection unnecessary to give \u201ccomplete relief\u201d to the plaintiffs who brought the case. But, there were three areas in which the court at least left open the possibility of broad-based relief. <\/p>\n<p>The first, at issue in one of the birthright citizenship challenges before the court in 2025, was when the plaintiffs \u2014 there, states \u2014 asserted that the only way for them to get complete relief would be through a nationwide (or global) injunction. The second, used in the follow-up birthright citizenship case that was <a href=\"https:\/\/www.lawdork.com\/p\/supreme-court-likely-to-reject-trumps\" rel=\"nofollow noopener\" target=\"_blank\">before the justices this term<\/a>, is class-action litigation. Although not technically \u201cuniversal,\u201d a class-action lawsuit can provide protections that cover everyone (or every business) that would be affected by a policy. The final method left open with the decision is the one used by the Fifth Circuit on Friday: the Administrative Procedure Act. Under the APA, a court can stay or vacate a regulation or policy \u2014 a move that has nationwide effect.<\/p>\n<p>As <a href=\"https:\/\/www.lawdork.com\/p\/mifepristone-supreme-court-return-mailing\" rel=\"nofollow noopener\" target=\"_blank\">discussed at Law Dork<\/a> on Saturday, the district court in this case held off on issuing immediate relief in part because of the nationwide effect of an APA stay order. Bush appointee, or U.S. District Judge Mark Pittman, a Trump appointee.<\/p>\n<p>It went to O\u2019Connor, <a href=\"https:\/\/www.lawdork.com\/p\/the-prep-decision-is-bad-but-the\" rel=\"nofollow noopener\" target=\"_blank\">who has<\/a> a <a href=\"https:\/\/www.lawdork.com\/p\/judge-reed-oconnor-aca-prep-cancer-screenings\" rel=\"nofollow noopener\" target=\"_blank\">long history<\/a> of <a href=\"https:\/\/www.lawdork.com\/p\/reed-oconnor-title-ix-guidance-documents-ruling\" rel=\"nofollow noopener\" target=\"_blank\">anti-LGBTQ rulings<\/a>, and he came through. The same day the petition was filed, he granted it \u2014 without seeking any response from the hospital and before DOJ even <a href=\"https:\/\/www.justice.gov\/opa\/pr\/department-justice-seeks-enforce-subpoena-against-hospital-performs-sex-rejecting-procedures\" rel=\"nofollow noopener\" target=\"_blank\">publicly announced<\/a> it had sought such relief. <\/p>\n<p>O\u2019Connor granted the petition in <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.419013\/gov.uscourts.txnd.419013.2.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">a two-page order<\/a> entered on April 30 but not posted on the court\u2019s docket until May 1.<\/p>\n<p>Operating within the Fifth Circuit, given its extremism, has empowered the most extreme district court judges \u2014 like O\u2019Connor \u2014 to go even further, and they have done so, with this being judge the latest example. <\/p>\n<p>In the petition, DOJ appeared to have claimed that O\u2019Connor had jurisdiction here <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/3486\" rel=\"nofollow noopener\" target=\"_blank\">under a federal law<\/a> that allows DOJ to seek enforcement of an administrative subpoena in \u201cany court of the United States within the jurisdiction of which the investigation is carried on or of which the subpoenaed person is an inhabitant\u201d simply by stating that its broader investigation \u201cis being carried out in the Northern District of Texas.\u201d<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/substackcdn.com\/image\/fetch\/$s_!w9Wm!,f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fsubstack-post-media.s3.amazonaws.com%2Fpublic%2Fimages%2F958e811e-22bb-4e49-a183-f7d9d804bded_1258x542.png\" data-component-name=\"Image2ToDOM\" class=\"image-link image2 can-restack\" rel=\"nofollow noopener\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/05\/https:\/\/substack-post-media.s3.amazonaws.com\/public\/images\/958e811e-22bb-4e49-a183-f7d9d804bded_1258.jpeg\" width=\"550\" height=\"236.96343402225756\" data-attrs=\"{&quot;src&quot;:&quot;https:\/\/substack-post-media.s3.amazonaws.com\/public\/images\/958e811e-22bb-4e49-a183-f7d9d804bded_1258x542.png&quot;,&quot;srcNoWatermark&quot;:null,&quot;fullscreen&quot;:null,&quot;imageSize&quot;:null,&quot;height&quot;:542,&quot;width&quot;:1258,&quot;resizeWidth&quot;:550,&quot;bytes&quot;:156710,&quot;alt&quot;:null,&quot;title&quot;:null,&quot;type&quot;:&quot;image\/png&quot;,&quot;href&quot;:null,&quot;belowTheFold&quot;:true,&quot;topImage&quot;:false,&quot;internalRedirect&quot;:&quot;https:\/\/www.lawdork.com\/i\/196237187?img=https%3A%2F%2Fsubstack-post-media.s3.amazonaws.com%2Fpublic%2Fimages%2F958e811e-22bb-4e49-a183-f7d9d804bded_1258x542.png&quot;,&quot;isProcessing&quot;:false,&quot;align&quot;:null,&quot;offset&quot;:false}\" alt=\"\"   loading=\"lazy\" class=\"sizing-normal\"\/><\/a><\/p>\n<p>Putting aside the questions about the legitimacy of the underlying investigation, the DOJ <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.419013\/gov.uscourts.txnd.419013.1.1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">declaration<\/a> attached to the petition contains no other information suggesting that the Rhode Island Hospital investigation specifically involves the Northern District of Texas at all. Neither the petition nor the declaration even provide any specific evidence that any DOJ action in the broader investigation has taken place in the Northern District of Texas aside from the filing of the petition there. <\/p>\n<p>Nonetheless, eight lawyers signed onto this filing. <\/p>\n<p>Further, the Justice Department barely acknowledged the widespread conclusion from district courts that the patient-specific portions of the subpoena, at the least, are inappropriate \u2014 not mentioning the contrary court decisions once in the first two sections of its petition, arguing that \u201cThe Subpoena Is Within the Department\u2019s Statutory Authority\u201c and that \u201cThe Subpoena Seeks Documents Reasonably Relevant to the Investigation.\u201c<\/p>\n<p>Contrary to that, to give just one example, U.S. District Judge Mark Kearney <a href=\"https:\/\/www.lawdork.com\/p\/judges-doj-actions-trans-care-subpoenas\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a> last year that \u201cCongress never authorized a roving mandate to regulate and alter state-licensed medical care\u201d in his ruling blocking the patient data from needing to be turned over.<\/p>\n<p>Instead, the Justice Department \u2014 again, in a petition signed onto by eight lawyers \u2014 only mentioned the contrary rulings in a footnote in the last section of its petition, arguing that \u201cThe Subpoena\u2019s Demands Are Reasonable. <\/p>\n<p><a target=\"_blank\" href=\"https:\/\/substackcdn.com\/image\/fetch\/$s_!XNHk!,f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fsubstack-post-media.s3.amazonaws.com%2Fpublic%2Fimages%2Fa74d0ccb-67ac-4382-8d33-86d022cf17e1_1250x508.png\" data-component-name=\"Image2ToDOM\" class=\"image-link image2 can-restack\" rel=\"nofollow noopener\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/05\/https:\/\/substack-post-media.s3.amazonaws.com\/public\/images\/a74d0ccb-67ac-4382-8d33-86d022cf17e1_1250.jpeg\" width=\"549\" height=\"223.1136\" data-attrs=\"{&quot;src&quot;:&quot;https:\/\/substack-post-media.s3.amazonaws.com\/public\/images\/a74d0ccb-67ac-4382-8d33-86d022cf17e1_1250x508.png&quot;,&quot;srcNoWatermark&quot;:null,&quot;fullscreen&quot;:null,&quot;imageSize&quot;:null,&quot;height&quot;:508,&quot;width&quot;:1250,&quot;resizeWidth&quot;:549,&quot;bytes&quot;:270370,&quot;alt&quot;:null,&quot;title&quot;:null,&quot;type&quot;:&quot;image\/png&quot;,&quot;href&quot;:null,&quot;belowTheFold&quot;:true,&quot;topImage&quot;:false,&quot;internalRedirect&quot;:&quot;https:\/\/www.lawdork.com\/i\/196237187?img=https%3A%2F%2Fsubstack-post-media.s3.amazonaws.com%2Fpublic%2Fimages%2Fa74d0ccb-67ac-4382-8d33-86d022cf17e1_1250x508.png&quot;,&quot;isProcessing&quot;:false,&quot;align&quot;:null,&quot;offset&quot;:false}\" alt=\"\"   loading=\"lazy\" class=\"sizing-normal\"\/><\/a><\/p>\n<p>Even then, the footnote only cited two of the cases (not including Kearney\u2019s ruling), and the text introducing those cases asserted, \u201cThe Department acknowledges that a handful of mistaken district judges have found \u2018improper purpose\u2019 given the administration\u2019s policy positions and priorities.\u201c The lawyers then claimed, \u201cThese decisions are wrong and currently on appeal.\u201c  <\/p>\n<p>The eight signatories were: Ryan Raybould, United States Attorney for the Northern District of Texas; Brett Shumate, Assistant Attorney General, head of the Civil Division, and the person whose name is on the subpoena; Jordan C. Campbell, Deputy Assistant Attorney General; Lisa K. Hsiao, Acting Director of the Enforcement and Affirmative Litigation Branch and the person who submitted the declaration; Ross Goldstein and Patrick Runkle, Assistant Directors of the branch; Scott Dahlquist, Trial Attorney in the branch; and Ethan Womble, an Assistant U.S. Attorney in the Northern District of Texas.<\/p>\n<p>DOJ sought and O\u2019Connor granted a secretly obtained order in Texas for a D.C. subpoena of a Rhode Island entity. <\/p>\n<p>It was not immediately clear what the next steps will be for the hospital. Reuters had <a href=\"https:\/\/www.reuters.com\/legal\/government\/justice-department-gets-quick-win-first-bid-enforce-subpoena-gender-affirming-2026-05-01\/\" rel=\"nofollow noopener\" target=\"_blank\">reported<\/a> Friday that a spokesperson for Brown University \u2014 Rhode Island Hospital is a part of Brown University Health \u2014 said they were \u201creviewing it carefully with counsel.\u201c <\/p>\n<p>Among the multitude of ways that the hospital or patients could respond to this ruling, several paths could end up with a request before the Fifth Circuit relating to a New England hospital.<\/p>\n<p>Nonetheless, for now, there is an order in place from O\u2019Connor requiring Rhode Island Hospital to comply with the subpoena by May 14 \u2014 leaving questions up in the air about what people\u2019s rights are (literally) across the nation in the wake of the ruling. <\/p>\n<p>Finally, in the immediate aftermath of the U.S. Supreme Court\u2019s <a href=\"https:\/\/www.lawdork.com\/p\/scotus-voting-rights-decision-tps-arguments\" rel=\"nofollow noopener\" target=\"_blank\">Voting Rights Act decision<\/a>, two different three-judge district court panels are in place addressing different aspect of what happens next. <\/p>\n<p>Under <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/2284\" rel=\"nofollow noopener\" target=\"_blank\">federal law<\/a>, redistricting cases are among the cases that can be subject to a three-judge district court. When such a set-up is called for, the three-judge panel includes the judge who drew the case, a circuit judge \u201cdesignate[d]\u201d by the chief judge of the circuit, and a third judge designate[d] by the chief judge of the circuit.<\/p>\n<p>The Callais panel \u2014 the Louisiana map challenge that was on appeal at the Supreme Court \u2014 is made up of Circuit Judge Carl Stewart is a Clinton appointee, and U.S. District Judges Robert Summerhays and David Joseph are Trump appointees. They sought to move quickly, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lawd.203979\/gov.uscourts.lawd.203979.261.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">ordering<\/a> briefing over the week after the ruling about next steps in the state \u2014 despite questions <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/25a1197.html\" rel=\"nofollow noopener\" target=\"_blank\">raised<\/a> at (and still before) the Supreme Court about whether they even had authority to act.<\/p>\n<p>That same day, though, Louisiana Gov. Jeff Landry <a href=\"https:\/\/gov.louisiana.gov\/news\/5093\" rel=\"nofollow noopener\" target=\"_blank\">issued<\/a> an <a href=\"https:\/\/gov.louisiana.gov\/assets\/2026-Executive-Orders\/JML-Exective-Order-26-038.pdf\" rel=\"nofollow noopener\" target=\"_blank\">executive order<\/a> purporting to immediately suspend the congressional primary elections.<\/p>\n<p>In a new federal <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lamd.68576\/gov.uscourts.lamd.68576.1.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">lawsuit<\/a> filed challenging Landry\u2019s action, another three-judge panel was sought and <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lamd.68576\/gov.uscourts.lamd.68576.5.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">appointed<\/a>. (There is <a href=\"https:\/\/www.lwv.org\/newsroom\/press-releases\/civil-rights-groups-file-emergency-challenge-louisiana-governors-attempt\" rel=\"nofollow noopener\" target=\"_blank\">other litigation<\/a> \u2014 <a href=\"https:\/\/www.lwv.org\/sites\/default\/files\/2026-05\/5.1.26-Petition-for-TRO_FINAL.pdf\" rel=\"nofollow noopener\" target=\"_blank\">filed<\/a> in state court \u2014 as well.)<\/p>\n<p>In the federal case, in addition to U.S. District Judge Shelly Dick, an Obama appointee in the Middle District of Louisiana who was originally assigned the case, the two other judges designated by Chief Judge Jennifer Walker Elrod of the Fifth Circuit are two Trump appointees: Circuit Judge Kyle Duncan and U.S. District Judge Greg Guidry. <\/p>\n<p>That panel\u2019s first task is to decide whether to grant Louisiana\u2019s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lamd.68576\/gov.uscourts.lamd.68576.6.1.pdf\" rel=\"nofollow noopener\" target=\"_blank\">request<\/a> to send the case to the Western District of Louisiana, where it could be considered by the Callais panel.
