WASHINGTON, D.C. (KSWO) – The United States Department of Justice (DOJ) has announced it is filing a complaint challenging an Oklahoma law that offers in-state tuition to undocumented immigrants.<\/p>\n
The DOJ claims the law unconstitutionally discriminates against U.S. citizens \u201cwho are not afforded the same privileges.\u201d<\/p>\n
Government officials say the complaint was filed on August 5, which follows a motion from Oklahoma Attorney General Gentner Drummond<\/a>.<\/p>\n The complaint aligns with recent federal laws, as outlined in recent executive orders, according to the DOJ. <\/p>\n The department cites the broader \u201cEnding Taxpayer Subsidization of Open Borders<\/a>\u201d which the current administration says is to \u201censure, to the maximum extent permitted by law, that no taxpayer-funded benefits go to unqualified aliens.\u201d Specifically, regarding higher education, the DOJ cites, \u201cProtecting American Communities From Criminal Aliens<\/a>,\u201d with the intent to \u201ctake appropriate action to stop the enforcement of State and local laws, regulations, policies, and practices favoring aliens over any groups of American citizens that are unlawful, preempted by Federal law, or otherwise unenforceable, including State laws that provide in-State higher education tuition to aliens but not to out-of-State American citizens.\u201d<\/p>\n The complaint filed to the DOJ Eastern District of Oklahoma states the law \u201cblatantly\u201d conflicts with the Supremacy Clause of the U.S. Constitution. <\/p>\n Copyright 2025 KSWO.
