Rachel May, a Democrat representing Auburn and central Syracuse, would give the Department of Environmental Conservation new authority to approve leases and easements on state-managed lands known as \u201creforestation areas.\u201d The bill limits those agreements to electrical transmission and lower-voltage distribution infrastructure projects, with the goal of more easily connecting renewable energy installations to the wider grid.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Reforestation areas are a subset of <a href=\"https:\/\/dec.ny.gov\/nature\/forests-trees\/dec-land-stewardship\/state-land-classifications\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">state forest lands<\/a>. Created from unproductive farmland <a href=\"https:\/\/dec.ny.gov\/nature\/forests-trees\/dec-land-stewardship#:~:text=Much%20of%20the%20farmland%20in,planting%20program%20in%20New%20York.\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">purchased by<\/a> the state nearly a century ago, these properties are now managed by professional foresters. They serve as sustainable sources of timber while also functioning as one of New York\u2019s primary sources of outdoor recreation outside the Adirondack and Catskill parks. They also support ecosystems across the state by protecting watersheds and promoting forest succession.<\/p>\n<p>Although land-use regulations allow reforestation areas to be crossed by infrastructure such as electrical lines, new construction has historically faced significant legal hurdles. Because of stringent development restrictions, projects have largely avoided siting infrastructure near reforestation areas.<\/p>\n<p>Marguerite Wells, executive director of the Alliance for Clean Energy New York, said the current regulations effectively require companies seeking to route their projects to new infrastructure through a reforestation area to lobby for a new law in the state Legislature specifically permitting construction of their projects.<\/p>\n<p>Make the Times Union a Preferred Source on Google to see more of our journalism when you search.<\/p>\n<p><a href=\"https:\/\/www.google.com\/preferences\/source?q=timesunion.com\" data-link=\"native\" role=\"button\" aria-label=\"Add Preferred Source\" class=\"td300 cp f aic jcc disabled:cd wsn px24 y40px px16 py8 buttonSm fs13 xs:fs16 xs:buttonLg bg-primaryAccessible hover:o80 c-white disabled:bg-gray300 disabled:c-gray600 border bn tac br2\"><\/p>\n<p>Add Preferred Source<\/p>\n<p><\/a><\/p>\n<p>\u201cIt\u2019s only been done twice, by Cassadaga wind and by Alle-Catt wind,\u201d Wells said. \u201cIt\u2019s a huge lift to pass your own state law for your own tiny little thing.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p><a href=\"https:\/\/americas.rwe.com\/projects-and-locations\/cassadaga-onshore-wind-farm\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Cassadaga Onshore Wind Farm<\/a>, located in Chautauqua County, is a 40,000-acre facility with 37 turbines, estimated at 125 megawatts and capable of powering\u00a0roughly 37,000 homes. <a href=\"https:\/\/allecattwind.invenergy.com\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Alle-Catt Wind Energy Center<\/a>, currently under construction, will span 30,000 acres across Allegany, Cattaraugus and Wyoming counties. It will be the largest onshore wind farm in New York, boasting a capacity of 340 megawatts\u00a0\u2014 enough to power 134,000 homes.<\/p>\n<p>While much of the hilly terrain around reforestation areas is unsuitable for large-scale solar development, many of those sites are ideal for wind projects, Wells added.<\/p>\n<p>Supporters of the bill predict that easing restrictions on new transmission corridors would encourage the development of large-scale projects like Cassadaga and Alle-Catt, helping lower electricity costs across the state. But no estimates of potential energy production connected to the bill have been made at this time.<\/p>\n<p>May\u2019s bill specifies that any development must not interfere with the intended purposes of reforestation areas. But conservation advocates have raised concerns since the Senate initially approved the bill in February.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>When introduced, <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2025\/S4408\/amendment\/original\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">S4408<\/a> contained language critics described as vague and potentially disruptive. Opponents argued that permitting renewable infrastructure on reforestation areas could open the door to future industrial-scale development.<\/p>\n<p>The New York chapter of Backcountry Hunters &amp; Anglers, a conservation organization focused on promoting public land use and recreation, began publicly criticizing the bill in late March. <a href=\"https:\/\/www.backcountryhunters.org\/news\/details\/New-York-Chapter-Opposes-S4408-on-State-Reforestation-Lands-Updated\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">A blog post<\/a> published March 25 voiced support for renewable energy while opposing development that could limit public hunting and fishing access.<\/p>\n<p>The following week, Brian Bird, a field operations coordinator for the organization, traveled to Albany to distribute a <a href=\"https:\/\/www.backcountryhunters.org\/Portals\/0\/A10483.pdf\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">memorandum of opposition<\/a> to the bill. The memo argued that the legislation\u2019s language was overly broad and included suggested amendments.<\/p>\n<p>\u201cIt is a sticky situation, because as a conservation organization, we are not opposed to renewable energy,\u201d Bird said. \u201cState reforestation lands were designed to create habitat and outdoor recreation opportunities and watershed protection. I don\u2019t think that siting renewables there is part of that charter.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Two days after the Backcountry Hunters &amp; Anglers blog post, the Otsego County Conservation Association and its partner program, Otsego 2000, sent a letter to supporters urging them to write to their representatives opposing the bill.<\/p>\n<p>Otsego County has approximately 20,160 acres of state forests, according to the DEC, with 18,618 acres classified as reforestation areas. The letter referenced OCCA\u2019s long history of volunteer work on those lands and warned the bill could permit development on more than 600,000 acres of reforestation areas across New York.<\/p>\n<p>OCCA interim director Shelby MacLeish said that while she understands the urgency of expanding clean energy, she is concerned that developing reforestation areas could disrupt forest succession and wildlife movement.<\/p>\n<p>Following the criticism, legislators recalled the bill from the Assembly, returned it to the Senate and amended its language to explicitly clarify the proposal would only permit new electrical transmission and distribution lines to connect renewable sites to the grid, though not specifying whether those lines would be above or below ground. May denies that the siting of new energy farms within reforestation areas was ever intended in the original draft of the bill.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>\u201cState reforestation lands are working lands, not forever wild preserves,\u201d May said in a statement, adding that \u201cmany renewable projects can\u2019t move forward because they\u2019re cut off from the grid. This bill fixes that by allowing for more efficient interconnection only in areas where it fits the underlying use of the land. It\u2019s simply a practical step to expand sustainable, reliable energy.\u201d<\/p>\n<p>May has pointed to her previous support for environmental protections, including votes to conserve 30% of state land by 2030 and ban drilling within state forests, as evidence that she is committed to protecting New York forests. She said her legislation would allow renewable energy projects to come online that otherwise could not connect easily to the grid, and that any permits would still be subject to existing laws governing land use in reforestation areas.<\/p>\n<p>Despite the amended language, conservation groups say the bill still lacks sufficient specificity.<\/p>\n<p>In an update to its blog post, Backcountry Hunters &amp; Anglers continued to raise concerns about the scope of the proposal and called for additional safeguards, including prohibiting any net loss of public recreation access, forbidding habitat fragmentation and requiring parcel-specific reviews for each project.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The Otsego County Conservation Association has continued encouraging residents to contact lawmakers about the potential impacts of development on local state forests.<\/p>\n<p>On April 16, MacLeish attended the Otsego County Board of Representatives\u2019 <a href=\"https:\/\/cms2.revize.com\/revize\/otsegocountynynew\/SWECCOM04-16-2026.pdf?t=202604201148540&amp;t=202604201148540\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Solid Waste and Environmental Concerns Committee<\/a> meeting to discuss the legislation with county officials.
