The
\ncurrent administration did not invent these intimidation tactics. Before Texas
\nlawmakers outright banned gender-affirming care for minors in 2023, Texas Attorney General Ken Paxton was experimenting with a variety of legal threats
\nagainst providers and parents meant to accomplish what a ban would, or worse. He
\nunilaterally deemed<\/a> gender-affirming care for minors
\nto be \u201cabuse\u201d (three years ahead of Robert F. Kennedy\u2019s similar decree<\/a>, in December 2025, broadly defining such care as unsafe)
\nand directed state agencies to investigate parents of trans kids, should they
\nhelp their own children access care. He opened investigations<\/a> into two Texas hospitals, claiming
\nthey were violating unspecified state laws, and demanding that they turn over
\nthe same kinds of records now being demanded of NYU Langone. By the time gender-affirming
\ncare was banned in Texas, it was already nearly impossible to access. Some Texas families I met in 2021 as they were lobbying against the ban<\/a> and other anti-trans laws had
\nalready arranged care out of state, or had moved out of the state entirely.<\/p>\n

But
\nfor officials seeking to end gender-affirming care in Texas, the state\u2019s ban was
\nnot enough. Paxton began bringing lawsuits<\/a> against individual providers<\/a> who allegedly continued offering
\ngender-affirming care to minors, referring in court filings to one provider as
\n\u201ca scofflaw who is putting the
\nhealth and safety of minors at risk<\/a>,\u201d
\nand another as \u201ca Radical Gender Activist<\/a>.\u201d This week, Paxton, now a Trump-approved candidate<\/a> for John Cornyn\u2019s Senate seat, and
\nthe DOJ\u00a0announced<\/a> their latest victory in such
\nefforts: They have forced the largest children\u2019s hospital in Texas into
\ncreating a so-called \u201cdetransition\u201d clinic that, as Paxton put it, \u201cwill help
\nprovide free care to those who have been victimized by twisted, morally
\nbankrupt transgender ideology.\u201d The hospital must also pay $10 million in fines
\nand damages and revoke the medical privileges of five physicians.<\/p>\n

In
\nthe case of NYU Langone, we are seeing a number of extreme, lawless trends
\ncollide: Providers and patients are being intimidated with the malicious
\ncollection of private health care information; and states are attempting to
\napply their bans on stigmatized health care to states that have no such bans\u2014that
\nhave, in fact, protective laws meant to ensure patients\u2019 rights and patients\u2019
\naccess.<\/p>\n","protected":false},"excerpt":{"rendered":"The current administration did not invent these intimidation tactics.
