(WTVM) – The Chattahoochee Riverkeeper filed a lawsuit on May 22 against the owner and developer of Aspire at Old Guard apartments for allegedly violating the Clean Water Act.

According to officials, SCorUSA, LLC, founded by Steven Corbett, and Apsire at Old Guard, LLC, did not take appropriate measures to protect nearby waterways from muddy stormwater runoff while constructing the apartment complex.

Officials say this resulted in worsening pollution conditions in neighboring streams such as a tributary to Heiferhorn Creek, which ultimately flowed into Lake Oliver and the Chattahoochee River.

“In almost twenty years with CRK, this development is among the worst that I have ever seen. The failure to implement and maintain basic pollution controls has destroyed the neighboring creeks and aquatic life downstream. Given the gravity of these violations and the defendants’ refusal to work collaboratively on a solution, CRK is moving forward with our lawsuit.”

In the lawsuit, the Chattahoochee Riverkeeper is seeking for the defendants to fully restore the affected streams and pay $68,445 per day for each violation of the Clean Water Act, as well as costs and expenses associated with the lawsuit.

Notice of intent to sue

Officials sent a 60-day notice of intent to sue on March 18 for ongoing pollution violations: In that document, attorneys for CRK stated some of the following violations of the Clean Water Act:

Violations of the general permit and the discharge of pollutants without a permitMultiple legal violations at the Old Guard Road site due to failures to failure to install and maintain the required pollution controlsDestruction of large sections of vegetative buffer on the long unamed tributary to Heiferhorn Creek without a variance from Georgia Environmental Protection Division.

Read the full notice below:

Alleged ongoing violations and lack of required pollution controls

The Chattahoochee Riverkeeper says, they first reported the site to the city of Columbus in 2025 after muddy stormwater had been released through “broken and insufficient” pollution controls, and the City required the company to repair the controls.

However, the environmental group allegedly discovered that the site worsened, and the creek was filled with sediment in February 2026 due to the flow of muddy stormwater.

Officials say that construction sites are required to have plans and pollution controls on site to stop the flow of muddy water when it rains, according to various laws. In addition, they state that sediment in waters harms aquatic life, fills drinking water reservoirs, increases water treatment costs, and causes damage to that reduces property value.

Copyright 2026 WTVM.
