{"id":668491,"date":"2026-05-27T17:48:09","date_gmt":"2026-05-27T17:48:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/668491\/"},"modified":"2026-05-27T17:48:09","modified_gmt":"2026-05-27T17:48:09","slug":"alabama-asks-supreme-court-to-house-map-that-dilutes-black-vote","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/668491\/","title":{"rendered":"Alabama asks Supreme Court to House map that dilutes Black vote"},"content":{"rendered":"<p>A map of a GOP proposal to redraw Alabama&#8217;s congressional districts is displayed at the Alabama Statehouse in Montgomery, Ala., Tuesday, July 18, 2023.<\/p>\n<p>Kim Chandler | AP<\/p>\n<p>The state of <a href=\"https:\/\/www.cnbc.com\/2026\/05\/26\/alabama-redistricting-congress-black-votes-midterm-elections.html\" rel=\"nofollow noopener\" target=\"_blank\">Alabama<\/a> asked the <a href=\"https:\/\/www.cnbc.com\/2023\/06\/08\/supreme-court-strikes-down-alabama-congressional-map-in-voting-rights-dispute.html\" rel=\"nofollow noopener\" target=\"_blank\">Supreme Court<\/a> on Wednesday to pause a lower-court order barring the state from using a controversial <a href=\"https:\/\/www.cnbc.com\/2026\/05\/11\/supreme-court-alabama-republicans.html\" rel=\"nofollow noopener\" target=\"_blank\">congressional district map<\/a> for the <a href=\"https:\/\/www.cnbc.com\/2026\/05\/27\/election-economy-congress-inflation-republicans.html\" rel=\"nofollow noopener\" target=\"_blank\">2026 midterm elections<\/a>.<\/p>\n<p>The order prohibited the map, which was submitted in 2023, from being used for the upcoming congressional elections in Alabama because it would dilute the <a href=\"https:\/\/www.cnbc.com\/2023\/09\/05\/court-rejects-alabama-congressional-map-in-racial-gerrymandering-case.html\" rel=\"nofollow noopener\" target=\"_blank\">votes of Black people<\/a>.<\/p>\n<p>The state&#8217;s request to the Supreme Court came a day after a three-judge panel in <a href=\"https:\/\/www.alnd.uscourts.gov\/\" target=\"_blank\" rel=\"nofollow noopener\">U.S. District Court in Birmingham, Ala.<\/a>, reiteratred a prior ruling that found that the 2023 r<a href=\"https:\/\/www.cnbc.com\/2026\/05\/08\/virginia-redistricting-decision-supreme-court.html\" rel=\"nofollow noopener\" target=\"_blank\">edistricting<\/a> map &#8220;intentionally discriminated based on race in violation of the Constitution.&#8221;<\/p>\n<p>&#8220;We again cannot understand the 2023 Plan as anything other than intentionally discriminatory,&#8221; the decision by the panel said. Two judges on the panel were appointed by President <a href=\"https:\/\/www.cnbc.com\/donald-trump\/\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump<\/a>.<\/p>\n<p>The panel had been instructed by the <a href=\"https:\/\/www.cnbc.com\/supreme-court-us\/\" rel=\"nofollow noopener\" target=\"_blank\">Supreme Court<\/a> to revisit the question of whether the maps could be used for November&#8217;s elections in light of the high court&#8217;s recent ruling in the case known as Louisiana v. Callais that found that Louisiana&#8217;s drawing of its own congressional maps was a racial gerrymander.<\/p>\n<p>The panel&#8217;s decision was a victory for <a href=\"https:\/\/www.cnbc.com\/2026\/05\/04\/scotus-jeffries-redistrict-new-york.html\" rel=\"nofollow noopener\" target=\"_blank\">Democrats<\/a>, who since last year have often found themselves on the defensive against <a href=\"https:\/\/www.cnbc.com\/2026\/05\/07\/election-2026-tennessee-redistricting-gop-redraw-house-maps.html\" rel=\"nofollow noopener\" target=\"_blank\">Republican<\/a> efforts to redraw congressional districts around the country in an effort to maintain their razor-thin majority in the House of Representatives.<\/p>\n<p>Alabama, in its emergency application to the Supreme Court seeking a stay of the panel&#8217;s order, said, &#8220;A stay is warranted so that Alabama is not again precluded from using its legislatively enacted 2023 Plan based on a decision that defies Callais, manipulates the Purcell principle, and offends the Constitution&#8217;s promise of equal protection for all.&#8221; <\/p>\n<p>The Purcell principle is the idea that a court should not change the rules for an election close to the date of that contest.<\/p>\n<p>&#8220;Callais vindicates Alabama&#8217;s position on the lawfulness of the 2023 Plan, yet the district court decided in one week that Callais changed nothing,&#8221; the state said in its filing.<\/p>\n<p>&#8220;Worse, the district court doubled down on its constitutional holding that finds no home in our Constitution: that Alabama intentionally discriminated by refusing to intentionally discriminate,&#8221; the state said. &#8220;The district court faulted the State for denying &#8216;opportunity&#8217; to minority voters and &#8216;diluting&#8217; votes without once acknowledging how Callais itself refuted the district court&#8217;s pre-Callais holding on that score.&#8221;<\/p>\n<p>Alabama asked the Supreme Court to issue a decision on its request by next Monday, June 1.<\/p>\n<p><a href=\"https:\/\/www.google.com\/preferences\/source?q=https:\/\/www.cnbc.com\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Choose CNBC as your preferred source on Google and never miss a moment from the most trusted name in business news.<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"A map of a GOP proposal to redraw Alabama&#8217;s congressional districts is displayed at the Alabama Statehouse in&hellip;\n","protected":false},"author":2,"featured_media":668492,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[18],"tags":[5183,23,1071,122,1072,12,1070,10059,3130,3,111,21,19,22,20,25,24],"class_list":["post-668491","post","type-post","status-publish","format-standard","has-post-thumbnail","category-united-states","tag-alabama","tag-america","tag-breaking-news-politics","tag-business-news","tag-donald-j-trump","tag-donald-trump","tag-elections","tag-laws","tag-lawsuits","tag-news","tag-politics","tag-united-states","tag-united-states-of-america","tag-unitedstates","tag-unitedstatesofamerica","tag-us","tag-usa"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/668491","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/comments?post=668491"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/668491\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media\/668492"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media?parent=668491"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/categories?post=668491"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/tags?post=668491"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
