The exchanges launched on January 1, 2014\u2014nearly four years after President Obama signed the <a class=\"color-link\" href=\"https:\/\/www.healthcare.gov\/where-can-i-read-the-affordable-care-act\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.healthcare.gov\/where-can-i-read-the-affordable-care-act\/\" aria-label=\"Affordable Care Act\">Affordable Care Act<\/a> into law on March 23, 2010.<\/p>\n<p>A new analysis from KFF estimates that the number of people enrolled in an exchange plan this year could drop by roughly <a class=\"color-link\" href=\"https:\/\/www.kff.org\/affordable-care-act\/what-we-know-so-far-about-2026-aca-marketplace-enrollment-premiums-and-deductibles\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.kff.org\/affordable-care-act\/what-we-know-so-far-about-2026-aca-marketplace-enrollment-premiums-and-deductibles\/\" aria-label=\"5 million\">5 million<\/a> following the expiration of more generous pandemic-era premium subsidies at the end of last year.<\/p>\n<p><a class=\"color-link\" href=\"https:\/\/www.commonwealthfund.org\/blog\/2026\/emerging-state-data-paint-bleak-picture-2026-marketplace-enrollment\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.commonwealthfund.org\/blog\/2026\/emerging-state-data-paint-bleak-picture-2026-marketplace-enrollment\" aria-label=\"Progressives\">Progressives<\/a> view that decline as evidence that fewer Americans will have access to affordable coverage. But a <a class=\"color-link\" href=\"https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" aria-label=\"new analysis\">new analysis<\/a> from the Paragon Health Institute suggests another possibility. A substantial share of recent exchange enrollment may never have been legitimate in the first place.<\/p>\n<p>According to Paragon, roughly <a class=\"color-link\" href=\"https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" aria-label=\"6.2 million\">6.2 million<\/a> marketplace enrollees this year may be improperly enrolled in the exchanges. Some may not actually qualify for the subsidies they receive. Others may have been enrolled in plans without their knowledge.<\/p>\n<p>In other words, declining enrollment is not necessarily evidence of a failing insurance market. It may instead reflect a long-overdue correction to enrollment figures that have become inflated by fraud, abuse and weak eligibility verification.<\/p>\n<p>Paragon\u2019s analysis focuses on Americans reporting incomes between <a class=\"color-link\" href=\"https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" aria-label=\"100% and 150%\">100% and 150%<\/a> of the federal poverty level\u2014between <a class=\"color-link\" href=\"https:\/\/aspe.hhs.gov\/sites\/default\/files\/documents\/b1bfa16b20ae9b89d525bc35de7c1643\/detailed-guidelines-2026.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/aspe.hhs.gov\/sites\/default\/files\/documents\/b1bfa16b20ae9b89d525bc35de7c1643\/detailed-guidelines-2026.pdf\" aria-label=\"$15,960 and $23,940\">$15,960 and $23,940<\/a> for an individual. That is the <a class=\"color-link\" href=\"https:\/\/www.congress.gov\/crs-product\/R44425\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.congress.gov\/crs-product\/R44425\" aria-label=\"income range\">income range<\/a> that benefited most from the enhanced Obamacare subsidies enacted during the pandemic and later extended by Congress.<\/p>\n<p>The <a class=\"color-link\" href=\"https:\/\/www.healthsystemtracker.org\/brief\/higher-premium-payments-or-higher-deductibles-the-tradeoffs-aca-enrollees-face\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.healthsystemtracker.org\/brief\/higher-premium-payments-or-higher-deductibles-the-tradeoffs-aca-enrollees-face\/\" aria-label=\"enhanced subsidies\">enhanced subsidies<\/a> allowed many people in that income band to secure exchange coverage with no monthly premium at all.<\/p>\n<p>Florida is the most striking example. According to Paragon, <a class=\"color-link\" href=\"https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" aria-label=\"more than 3 million\">more than 3 million<\/a> exchange enrollees in the state reported incomes between 100% and 150% of the federal poverty level this year. Yet the report estimates that just <a class=\"color-link\" href=\"https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" aria-label=\"636,000\">636,000<\/a> Floridians plausibly had incomes within that range.<\/p>\n<p>That gap strongly suggests that exchange enrollment data are being distorted by widespread misreporting of income and improper enrollment activity.<\/p>\n<p>Paragon identified similar patterns in a number of states, particularly those that rely on HealthCare.gov, the federal exchange platform. Based on those enrollment patterns, the report estimates that roughly <a class=\"color-link\" href=\"https:\/\/paragoninstitute.org\/newsletter\/the-persistent-obamacare-enrollment-fraud\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/paragoninstitute.org\/newsletter\/the-persistent-obamacare-enrollment-fraud\/\" aria-label=\"6.2 million\">6.2 million<\/a> marketplace enrollees nationwide may be improperly enrolled this year\u2014more than one-quarter of all exchange enrollment\u2014at a potential cost to taxpayers of as much as <a class=\"color-link\" href=\"https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/paragoninstitute.org\/private-health\/the-persistent-obamacare-enrollment-fraud\/\" aria-label=\"$25 billion\">$25 billion<\/a> in federal subsidies.<\/p>\n<p>The report\u2019s findings are consistent with other evidence that serious problems exist within the exchanges.<\/p>\n<p>In 2024, the <a class=\"color-link\" href=\"https:\/\/www.forbes.com\/sites\/sallypipes\/2026\/01\/30\/cms-officials-are-undermining-trumps-push-for-affordable-drugs\/\" data-ga-track=\"InternalLink:https:\/\/www.forbes.com\/sites\/sallypipes\/2026\/01\/30\/cms-officials-are-undermining-trumps-push-for-affordable-drugs\/\" target=\"_self\" aria-label=\"Centers for Medicare and Medicaid Services\" rel=\"nofollow noopener\">Centers for Medicare and Medicaid Services<\/a> reported receiving roughly <a class=\"color-link\" href=\"https:\/\/www.cms.gov\/newsroom\/press-releases\/cms-statement-agent-broker-marketplace-activity-update\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.cms.gov\/newsroom\/press-releases\/cms-statement-agent-broker-marketplace-activity-update\" aria-label=\"50,000 complaints\">50,000 complaints<\/a> of unauthorized marketplace enrollments or plan switches during just the first quarter of the year. Around the same time, CMS suspended approximately <a class=\"color-link\" href=\"https:\/\/www.cms.gov\/newsroom\/press-releases\/cms-statement-system-changes-stop-unauthorized-agent-broker-marketplace-activity\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.cms.gov\/newsroom\/press-releases\/cms-statement-system-changes-stop-unauthorized-agent-broker-marketplace-activity\" aria-label=\"200 agents and brokers\">200 agents and brokers<\/a> pending investigations into alleged misconduct involving unauthorized enrollments and other abusive marketplace practices.<\/p>\n<p>A separate Paragon analysis found that <a class=\"color-link\" href=\"https:\/\/paragoninstitute.org\/newsletter\/dont-believe-ahip-improper-and-phantom-obamacare-enrollees-are-both-major-problems\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/paragoninstitute.org\/newsletter\/dont-believe-ahip-improper-and-phantom-obamacare-enrollees-are-both-major-problems\/\" aria-label=\"12 million\">12 million<\/a> exchange enrollees in 2024 generated no insurance claims at all that year. Some may simply have remained healthy\u2014and thus sought no medical care that year. But it\u2019s difficult to believe that such a large population would enroll in subsidized coverage and never use it at all.<\/p>\n<p>Unauthorized enrollment and other improper enrollment practices offer a more plausible explanation. Brokers and enrollment firms can collect commissions and facilitate subsidy payments regardless of whether the enrollee ever seeks care\u2014or knows that they\u2019ve been signed up for coverage at all.<\/p>\n<p>All of which suggests that raw Obamacare enrollment figures deserve far more scrutiny than they typically receive.<\/p>\n<p>KFF estimates that average monthly marketplace enrollment could drop from <a class=\"color-link\" href=\"https:\/\/www.kff.org\/affordable-care-act\/what-we-know-so-far-about-2026-aca-marketplace-enrollment-premiums-and-deductibles\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.kff.org\/affordable-care-act\/what-we-know-so-far-about-2026-aca-marketplace-enrollment-premiums-and-deductibles\/\" aria-label=\"22.3 million\">22.3 million<\/a> in 2025 to about <a class=\"color-link\" href=\"https:\/\/www.kff.org\/affordable-care-act\/what-we-know-so-far-about-2026-aca-marketplace-enrollment-premiums-and-deductibles\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-ga-track=\"ExternalLink:https:\/\/www.kff.org\/affordable-care-act\/what-we-know-so-far-about-2026-aca-marketplace-enrollment-premiums-and-deductibles\/\" aria-label=\"17.5 million\">17.5 million<\/a> this year, given the expiration of the enhanced premium subsidies.
