Judge Jay Winward presided over the case.<\/p>\n<p>Kingston was accused of raping a 20-year-old woman on Feb. 23, 2025, in a St. George residence,\u00a0<a href=\"https:\/\/www.abc4.com\/sports\/byu-wide-receiver-accused-of-rape-removed-from-the-byu-football-team\/\" rel=\"nofollow noopener\" target=\"_blank\">according to ABC4 in Provo<\/a>. He was\u00a0charged with first-degree felony rape in February 2026 and was dismissed from the football team and school shortly thereafter. BYU <a href=\"https:\/\/sports.ksl.com\/ncaa\/byu-football\/parker-kingston-no-longer\/571928\" rel=\"nofollow noopener\" target=\"_blank\">released a statement<\/a> on that at the time of the dismissal.<\/p>\n<p>The alleged victim reportedly told a forensic interviewer in June 2025 that she \u201cset clear boundaries with Kingston prior to their meetup\u201d and that there would be no sex,\u00a0<a href=\"https:\/\/www.nytimes.com\/athletic\/7043310\/2026\/02\/12\/parker-kingston-byu-arrest-details\/\" rel=\"nofollow noopener\" target=\"_blank\">according to\u00a0The Athletic<\/a>\u00a0<a href=\"https:\/\/nypost.com\/2026\/02\/13\/sports\/new-details-revealed-in-rape-allegations-against-arrested-byu-receiver-parker-kingston\/\" rel=\"nofollow noopener\" target=\"_blank\">via the\u00a0New York Post<\/a>.<\/p>\n<p>When Kingston arrived at the victim\u2019s home in the early hours of Feb. 23 of last year, the couple \u201cbegan to engage in some sexual activity\u201d while watching a movie, though she attests it didn\u2019t include sex, per\u00a0The Athletic. Once the victim began preparing for bed, she alleges Kingston \u201cinitiated sexual activity again\u201d despite her repeated protests to stop, per\u00a0The Athletic\u00a0via the\u00a0Post.<\/p>\n<p>Judge Winward cited concerns of alleged victim\u2019s readiness for September trial for dismissing case<\/p>\n<p>On Wednesday, the state of Utah filed a second motion to continue the trial, citing concerns about the alleged victim\u2019s readiness. They asked that the trial be set to begin in the first available week in September 2026, with the possibility of further delay if the state is unable to proceed at that time based on the alleged victim\u2019s therapist\u2019s request. On Thursday, however, the defense opposed the motion, asking the court to consider Kingston\u2019s employment, education, and family.<\/p>\n<p>After hearing from both parties, Judge Winward expressed that he believed that the alleged victim would not be ready for a trial by September. This led to him dismissing the case without prejudice, as he claimed Kingston had the right to a speedy trial.<\/p>\n<p>\u201cThe state is not ready. The victim is unprepared to testify, and that\u2019s okay. The case is dismissed without prejudice,\u201d said Winward, via ABC 4.<\/p>\n<p>Kingston played in 14 games for BYU last season, hauling in 67 catches for 928 yards and five touchdowns.
