Food ‘not fit for human consumption,’ lawsuit alleges<\/p>\n
Texas resident Yvette Hinds claims that in 2023, she ate a Sausage Egg McMuffin at a McDonald\u2019s in New York City\u2019s Times Square that was \u201cnot fit for human consumption<\/a>,\u201d according to a complaint filed May 26 in New York\u2019s Supreme Court.<\/p>\n The case was elevated to the high court because, as the complaint notes, the damages Hinds sustained were so costly, they \u201c(exceed) the jurisdictional limits of all lower courts\u201d that otherwise would\u2019ve heard it.<\/p>\n ‘Systemic poisoning’: Parents say popular baby foods gave kids ‘brain injury’ in new lawsuits<\/a><\/p>\n In the complaint, Hinds alleges that soon after she ate the meal, she \u201cbecame violently ill and nauseated, and suffered severe pains and distress throughout her body,\u201d symptoms she claims were directly tied to the food.<\/p>\n The complaint includes a litany of potential causes, including \u201cinjurious substances, contaminants, poisons, toxins, parasites, bacteria, germs and\/or organisms.\u201d It further alleges that the staff either knew, or should have known, that the food was tainted.<\/p>\n The McDonald’s sign is seen outside its store at the Times Square in New York June 9, 2008.<\/p>\n In a statement shared with USA TODAY, McDonald\u2019s owner-operator Paul Goodman said he takes \u201cgreat pride in serving safe, high-quality food to every customer who walks through our doors,\u201d and that his team is \u201ccommitted to upholding strict food safety and handling practices across our restaurants every day.\u201d<\/p>\n \u201cWe always take matters like these seriously and investigate thoroughly,\u201d Goodman added. \u201cWe strongly dispute the facts alleged in this lawsuit, but to remain focused on our customers, this matter was resolved months ago.\u201d<\/p>\n Opinion: I don’t care if the McRib is real pork rib. (Photo by Kena Betancur\/Getty Images)<\/p>\n The permanent damage to Hinds\u2019 \u201cphysical, nervous and mental systems\u201d have since left her unable to perform regular duties around the house, as well as \u201cwork as she was accustomed to do,\u201d the lawsuit states. Meanwhile, she also suffered significant economic damage in medical expenses.<\/p>\n All of this, the lawsuit claims, was the direct result of \u201cnegligence and carelessness\u201d on the part of McDonald\u2019s and its employees.<\/p>\n Hinds\u2019 attorney did not respond to USA TODAY\u2019s request for more information, including the exact nature of her illness and injuries.<\/p>\n McRib class-action lawsuit<\/p>\n McDonald\u2019s has also been busy this year responding to a class-action lawsuit that alleges its iconic McRib sandwich doesn\u2019t contain any rib meat, but is made entirely from other pork cuts, as USA TODAY previously reported.<\/p>\n \u201cDespite its name and distinctive shape \u2013 its meat patty has been deliberately crafted to resemble a rack of pork ribs \u2013 the McRib does not contain any actual pork rib meat at all,\u201d the lawyers wrote in the lawsuit filed in late December.<\/p>\n A McRib is seen at a McDonald’s restaurant on November 3, 2010 in San Francisco, California.<\/p>\n In a statement shared with USA TODAY in January, McDonald\u2019s said the lawsuit \u201cdistorts the facts and many of the claims are inaccurate.\u201d<\/p>\n \u201cWe\u2019re committed to using real, quality ingredients across our entire menu,\u201d McDonald\u2019s USA said. \u201cOur fan-favorite McRib sandwich is made with 100% pork sourced from farmers and suppliers across the U.S. We\u2019ve always been transparent about our ingredients so guests can make the right choice for them.\u201d<\/p>\n![\"The](\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/06\/e334abbb50ea2198015963d4217c3d56.jpeg\"\/)
