GOP legislators would harm Black and brown communities"},"content":{"rendered":"<p>Listen to article \u2022\u00a00:00 min<\/p>\n<p class=\"inq-p text-primary  \">Pennsylvania\u2019s Republican lawmakers are on the verge of deepening the state\u2019s pharmacy access crisis \u2014 and Black and brown communities will pay the highest price.<\/p>\n<p class=\"inq-p text-primary  \">Earlier this year, three Republican state senators <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.pasenategop.com\/news\/langerholc-ward-stefano-announce-legislation-to-reform-pharmacy-benefit-managers\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.pasenategop.com\/news\/langerholc-ward-stefano-announce-legislation-to-reform-pharmacy-benefit-managers\/\">announced intended legislation<\/a> that purports to \u201cprotect\u201d Pennsylvanians\u2019 access to care. While not yet introduced, this proposed legislation would do the opposite, forcing the closure of chain pharmacies that are owned by companies that also own pharmacy benefit managers. <\/p>\n<p class=\"inq-p text-primary  \">Verbatim, the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.pasenategop.com\/news\/langerholc-ward-stefano-announce-legislation-to-reform-pharmacy-benefit-managers\/\" target=\"_blank\" rel=\"nofollow noopener\">announcement says<\/a> the bill would, \u201cprohibit PBMs from holding a pharmacy license in Pennsylvania.\u201d If enacted, hundreds of brick-and-mortar and mail-order pharmacies could lose their licenses and be forced to shut down.<\/p>\n<p class=\"inq-p text-primary  \">Closing pharmacies is not protection. It is a deliberate harm to vulnerable seniors, working families, and the communities that already struggle most to access care. <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC12338793\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC12338793\/\">Academic studies<\/a> document that socioeconomic barriers can influence access to pharmacies.<\/p>\n<p class=\"type-pull-quote relative mb-5 text-primary\">Communities\u00a0of color\u00a0cannot absorb more neglect.<\/p>\n<p class=\"inq-p text-primary  \">Pennsylvania is already deep in a pharmacy desert crisis. Since 2020, <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.nbcphiladelphia.com\/investigators\/consumer\/pharmacy-deserts-why-more-pharmacies-are-disappearing-from-neighborhoods\/4303446\/\" target=\"_blank\" rel=\"nofollow noopener\">more than 1,100<\/a> independent and chain pharmacies have closed across the commonwealth \u2014 including <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/health\/rite-aid-pharmacies-closed-pennsylvania-new-jersey-20250823.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"Original URL: https:\/\/www.inquirer.com\/business\/health\/rite-aid-pharmacies-closed-pennsylvania-new-jersey-20250823.html. Click or tap if you trust this link.\"><a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/rite-aid\" rel=\"nofollow noopener\" target=\"_blank\">Rite Aid<\/a>, which filed for bankruptcy and permanently shuttered in 2025. <\/p>\n<p class=\"inq-p text-primary  \">Residents in predominantly Black and brown neighborhoods in Philadelphia, Pittsburgh, and Allentown, as well as those in rural townships, already face long distances and real hardships just to fill a prescription. <\/p>\n<p class=\"inq-p text-primary  \">The health stakes are high. Hispanic Pennsylvanians, in particular, experience higher risk factors for <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.frontiersin.org\/journals\/public-health\/articles\/10.3389\/fpubh.2023.1134044\/full\" target=\"_blank\" rel=\"nofollow noopener\">chronic disease<\/a>, <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.pa.gov\/content\/dam\/copapwp-pagov\/en\/health\/documents\/topics\/healthstatistics\/minorityhealthstatistics\/documents\/Minority_Hosp_for_Select_Conditions_2014.pdf\" target=\"_blank\" rel=\"nofollow noopener\">asthma<\/a>, and multiple <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.pa.gov\/content\/dam\/copapwp-pagov\/en\/health\/documents\/topics\/healthstatistics\/minorityhealthstatistics\/documents\/minority_cancer_incidence_2022.pdf\" target=\"_blank\" rel=\"nofollow noopener\">cancers<\/a> than white residents. Managing chronic conditions requires consistent, affordable access to medication \u2014 and when that access is severed, patients split pills, skip doses, or abandon prescriptions entirely. <\/p>\n<p class=\"inq-p text-primary  \">Medication adherence is <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC7368138\/\" target=\"_blank\" rel=\"nofollow noopener\">already lower<\/a> in minority communities. This legislation would make a serious problem catastrophic.<\/p>\n<p class=\"inq-p text-primary  \">Proponents argue that independent pharmacies can <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/spectrumlocalnews.com\/nys\/central-ny\/news\/2025\/01\/24\/independent-pharmacies-challenges\" target=\"_blank\" rel=\"nofollow noopener\">fill the void<\/a>. We\u2019ve seen how that plays out. When Rite Aid collapsed, independent pharmacists <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/whyy.org\/articles\/rite-aid-closure-customers-new-pharmacy\/\" target=\"_blank\" rel=\"nofollow noopener\">reported<\/a> being overwhelmed, creating waitlists and turning away patients on less profitable insurance plans. The chaos that followed will repeat \u2014 and intensify \u2014 if hundreds more pharmacies are shuttered at once.<\/p>\n<p class=\"inq-p text-primary  \">This legislation also ignores legal reality. Arkansas passed a similar law that was immediately halted in federal court for <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/arkansasadvocate.com\/2025\/07\/28\/federal-judge-blocks-arkansas-restrictions-on-pharmacy-benefit-managers\/\" target=\"_blank\" rel=\"nofollow noopener\">violating the Commerce Clause<\/a> and interfering with TRICARE, the healthcare program for veterans and military families. Tennessee faced <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.knoxnews.com\/story\/opinion\/readers\/2026\/04\/25\/letters-readers-split-over-tn-bill-on-cvs-pharmacy-benefit-managers\/89772573007\/?gnt-cfr=1&amp;gca-cat=p&amp;gca-uir=true&amp;gca-epti=z114438p000850c000850e001900v114438d--48--b--48--&amp;gca-ft=174&amp;gca-ds=sophi\" target=\"_blank\" rel=\"nofollow noopener\">fierce opposition<\/a> from patient advocates and state Medicare officials. <\/p>\n<p class=\"inq-p text-primary  \">Pennsylvania should avoid repeating these costly mistakes.<\/p>\n<p class=\"inq-p text-primary  \"><a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.pa.gov\/agencies\/insurance\/laws-regulations-notices\/act-77-pharmacy-benefit-reform-act\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.pa.gov\/agencies\/insurance\/laws-regulations-notices\/act-77-pharmacy-benefit-reform-act\">Pennsylvania\u2019s Act 77<\/a>, passed in 2024, already established meaningful oversight, transparency, and fairness in pharmacy benefit management \u2014 with the explicit goal of preventing pharmacy closures. These new proposals directly contradict that intent.<\/p>\n<p class=\"inq-p text-primary  \">Communities of color cannot absorb more neglect.
