(ABC 6 News) \u2014 The trial of Shiloh Hendrix, the woman seen using a racial slur toward a child at a Rochester playground, is now over after the jury reached a verdict late Thursday night.<\/p>\n
After nine hours of deliberations, the jury came back with a split verdict, finding Hendrix not guilty of disorderly conduct involving the child, but guilty of disorderly conduct toward the man who caught the incident on video last year. Hendrix received probation, a $1,000 fine and 200 hours of community service.<\/p>\n
Hendrix\u2019s defense attorney Brian Karalus was not pleased with the verdict, saying he plans to file an appeal. He made a number of allegations, arguing the trial proceedings were not handled correctly or lawfully. He even went on to accuse the judge of repeatedly interrupting him, limiting evidence and mishandling the proceedings.<\/p>\n
\u201cThere are so many appellate issues,\u201d said Karalus. \u201cThis was one of the craziest trials I\u2019ve ever seen.\u201d<\/p>\n
One issue Karalus repeatedly pointed to involved Rule 901 of the Minnesota Rules of Evidence, which deals with introducing evidence at trial.<\/p>\n
\u201cThe judge said Rule 109 of the Rules of Evidence only applies to prosecutors\u2026 no it does not. That rule applies to both sides,\u201d said Karalus.<\/p>\n
ABC 6 News decided to look into the rule and clarify whether it does apply to both sides with defense attorney Peter Martin, who has known Karalus for years and says he was in contact with him throughout portions of the trial.<\/p>\n
\u201cRule nine requires the prosecution to turn over stuff. They don\u2019t have to release what their thoughts are on a case, but if there\u2019s a witness that has said something, if there\u2019s exculpatory evidence out there, if there\u2019s stuff that really would be beneficial to a defense lawyer, that stuff has to be turned over, and it isn\u2019t discretionary,\u201d said Martin. \u201cIf they didn\u2019t turn it over, if they were playing loose and hard and fast with the rules, that\u2019s a clear violation. That\u2019s a clear violation of Miss Hendrix\u2019s rights in this case.\u201d<\/p>\n
Another claim Karalus made was that the Rochester community no longer cares about the case, so ABC 6 asked people in Rochester whether they agreed.<\/p>\n
\u201cI think most of the people in the community have followed it maybe from one extreme to the other,\u201d said Krisi Bull, a community member. Bull added she believes this trial sets a precedent of what people can or can\u2019t say.<\/p>\n
Now the focus shifts to what\u2019s next. Karalus says he plans to appeal the conviction, arguing multiple issues throughout the trial made for an unfair proceeding.<\/p>\n
\u201cWhen you appeal, you also order transcripts,\u201d said Martin. \u201cAnd so the Court of Appeals will be able to look at a verbatim transcript of actually how things went down, so there will be ample opportunity to scrutinize what happened in that courtroom.\u201d<\/p>\n
And while Martin says Karalus\u2019 conduct in and outside the courtroom could lead to scrutiny by the Minnesota Lawyers Professional Responsibility Board if a complaint is filed, it would not impact his ability to appeal the conviction.\u00a0<\/p>\n
It is unclear at this time when Karalus plans to file the appeal, but Martin says we could likely see that process go on for well over another year.<\/p>\n
