(WLOS) \u2014 A decades-old wildlife protection law is facing a major challenge in court, with conservation advocates warning a new rollback by President Donald Trump\u2019s administration could open critical habitats in western North Carolina to more development and pollution.<\/p>\n<p><p>WLOS<\/p>\n<\/p>\n<p>The <a href=\"https:\/\/www.biologicaldiversity.org\/\" target=\"_blank\" rel=\"nofollow noopener\">Center for Biological Diversity<\/a> is one of several conservation groups suing over the Trump administration\u2019s changes to the Endangered Species Act, arguing the new policy weakens decades of habitat protections by narrowing what qualifies as \u201charm\u201d to threatened and endangered species.<\/p>\n<p><a href=\"https:\/\/wlos.com\/news\/local\/hellbender-salamander-complaint-us-fish-wildlife-service-center-biological-diversity-endangered-species-act-federal-protections-north-carolina\" target=\"_blank\" rel=\"nofollow noopener\">GROUP CLAIMS US WILDLIFE OFFICIALS HAVE YET TO PROTECT ENDANGERED HELLBENDER SALAMANDER<\/a><\/p>\n<p>Will Harlan, the Southeast director for the nonprofit, said he fears the change could reduce oversight of projects that affect endangered species habitat. He said the original rule allowed federal officials to consider habitat destruction as part of the harm caused to protected species, but now that changes.<\/p>\n<p>\u201cRight now, Trump\u2019s rule tries to take that off the table and say you can pollute, you can clear-cut, you can do whatever you want to species\u2019 habitats as long as you don\u2019t directly kill the species itself,\u201d Harlan said.<\/p>\n<p>The rule, <a href=\"https:\/\/www.doi.gov\/pressreleases\/trump-administration-finalizes-endangered-species-act-regulation-reform\" target=\"_blank\" rel=\"nofollow noopener\">finalized by the U.S. Department of the Interior<\/a>, removes the previous regulatory definition of \u201charm\u201d under the act. (Photo: NC Wildlife Resource Commission\/Clifton Avery)<\/p>\n<p>The Center for Biological Diversity and other groups are asking a federal court to block the policy, arguing the administration exceeded its authority by changing how habitat protections are applied under the Endangered Species Act.<\/p>\n<p><a href=\"https:\/\/wlos.com\/news\/local\/monitoring-planned-after-endangered-indiana-bat-maternity-roost-found-in-nantahala\" target=\"_blank\" rel=\"nofollow noopener\">MONITORING PLANNED AFTER ENDANGERED INDIANA BAT MATERNITY ROOST FOUND IN NANTAHALA<\/a><\/p>\n<p>Harlan and other advocates with the center argue that habitat destruction has long been considered a threat to wildlife survival.<\/p>\n<p>\u201cWe\u2019re going to see more injured and orphaned animals as forests are clear-cut, as rivers are polluted,\u201d Harlan said. \u201cWe\u2019re going to see more demand upon our local wildlife rehabilitators to rescue animals that are harmed by the destruction of habitat across the region.\u201d<\/p>\n<p><img alt=\"FILE IMAGE of an Indiana bat,  a federally endangered bat species, that was found in western North Carolina. (Photo: North Carolina Wildlife Resources Commission)<\/p>\n<p>Savannah Trantham, the executive director of <a href=\"https:\/\/www.appalachianwild.org\/\" target=\"_blank\" rel=\"nofollow noopener\">Appalachian Wildlife Refuge<\/a>, a non-profit that coordinates wildlife rehabilitation efforts across the region, said this federal move is \u201cdisheartening\u201d to see. In western North Carolina, she said species like the <a href=\"https:\/\/www.ncwildlife.gov\/species\/carolina-northern-flying-squirrel\" target=\"_blank\" rel=\"nofollow noopener\">Carolina northern flying squirrel<\/a> and<a href=\"https:\/\/www.ncwildlife.gov\/blog\/2026\/07\/20\/endangered-bats-caught-nc-first-time-10-years\" target=\"_blank\" rel=\"nofollow noopener\"> Indiana bat<\/a>, which depend on protected forest habitats in the Southern Appalachians, are already some of the most at-risk species.<\/p>\n<p>Tara Zuardo, a senior advocate with the Center for Biological Diversity, said the legal case could take over a year to play out.<\/p>\n<p>News 13 reached out to the Trump administration for comment, but they have not yet responded.<\/p>\n","protected":false},"excerpt":{"rendered":"ASHEVILLE, N.C.
