(AP Photo\/Annika Hammerschlag) <\/p>\n<p class=\"c-paragraph sans-serif\">A federal judge last week rejected a bid by conservation groups to stop the Trump administration from conveying land to Alaska to support development of the 200-mile Ambler Road that could open up access for mining in a remote Arctic region.<\/p>\n<p class=\"c-paragraph sans-serif\">Alaska U.S. District Judge Aaron Peterson on Friday <a href=\"https:\/\/www.documentcloud.org\/documents\/28519959-amber-road-decision-july-2026\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.documentcloud.org\/documents\/28519959-amber-road-decision-july-2026\/\">dismissed<\/a> portions of the lawsuit, denying the request for a preliminary injunction and removing a legal cloud over the 1.4-million-acre land transfer, tentatively approved by the Interior Department <a href=\"https:\/\/www.adn.com\/business-economy\/energy\/2026\/05\/06\/trump-administration-transfers-land-to-state-to-support-ambler-road-and-alaska-lng\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.adn.com\/business-economy\/energy\/2026\/05\/06\/trump-administration-transfers-land-to-state-to-support-ambler-road-and-alaska-lng\/\">in May<\/a>. <\/p>\n<p class=\"c-paragraph sans-serif\">The state has said the land transfer could also support the proposed Alaska LNG megaproject that seeks to deliver North Slope gas to Asian countries and Alaskans. Conservation groups argue that state control of the land removes federal protections for subsistence hunting and reduce environmental safeguards as mining takes place and projects are developed. <\/p>\n<p class=\"c-paragraph sans-serif\">The <a href=\"https:\/\/storymaps.arcgis.com\/stories\/991fa1a030f84f1ba2ff55051a4a7486\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/storymaps.arcgis.com\/stories\/991fa1a030f84f1ba2ff55051a4a7486\">land<\/a> lies along the Dalton Highway near Coldfoot north of the Yukon River, where part of the the 800-mile trans-Alaska pipeline passes. It\u2019s part of the Dalton Utility Corridor and includes the route that would host the Alaska LNG pipeline, if it is built.<\/p>\n<p class=\"c-paragraph sans-serif\">\u201cAlaska has fought hard to secure access to the lands that were promised to us at Statehood,\u201d Gov. Mike Dunleavy said in a statement Friday. \u201cI am glad to see this land finally returning to Alaska\u2019s control, and I am thankful for the tireless efforts of Alaskans who made it possible.\u201d<\/p>\n<p class=\"c-paragraph sans-serif\">Alaska had selected the lands under the Statehood Act, but they were withdrawn by the federal government for more than 50 years. Interior removed the withdrawals for the land earlier this year, and the agency began taking steps to convey the lands to the state.<\/p>\n<p class=\"c-paragraph sans-serif\">Trustees for Alaska <a href=\"https:\/\/trustees.org\/wp-content\/uploads\/2026\/03\/2026LawsuitChallengesTrumpsMassivePublicLandsGiveawayAlaska.pdf\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/trustees.org\/wp-content\/uploads\/2026\/03\/2026LawsuitChallengesTrumpsMassivePublicLandsGiveawayAlaska.pdf\">filed<\/a> the case in March on behalf of the Northern Alaska Environmental Center and nine other groups. The groups argued that the transfer violates laws such as the National Environmental Policy Act. <\/p>\n<p class=\"c-paragraph sans-serif\">They said that removing federal oversight would open the land to mining claims, road-building and industrial activities, threatening clean water, wildlife habitat and subsistence resources.<\/p>\n<p class=\"c-paragraph sans-serif\">The <a href=\"https:\/\/dnr.alaska.gov\/mlw\/ambler-road\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/dnr.alaska.gov\/mlw\/ambler-road\/\">state\u2019s<\/a> controversial Ambler Road proposal <a href=\"https:\/\/dnr.alaska.gov\/mlw\/ambler-road\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/dnr.alaska.gov\/mlw\/ambler-road\/\">would extend a gravel corridor west<\/a> through wilderness from the Dalton corridor. It\u2019s designed to open a mining district containing copper, zinc, lead and other minerals considered <a href=\"https:\/\/www.usgs.gov\/news\/science-snippet\/interior-department-releases-final-2025-list-critical-minerals\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.usgs.gov\/news\/science-snippet\/interior-department-releases-final-2025-list-critical-minerals\">critical<\/a> by the federal government for their economic and defense value. <\/p>\n<p class=\"c-paragraph sans-serif\">The Department of the Interior in February <a href=\"https:\/\/www.adn.com\/business-economy\/2026\/02\/23\/trump-administration-to-remove-land-orders-in-support-of-ambler-road-alaska-lng-pipeline\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.adn.com\/business-economy\/2026\/02\/23\/trump-administration-to-remove-land-orders-in-support-of-ambler-road-alaska-lng-pipeline\/\">revoked<\/a> 1970s-era public land orders that kept 2.1 million acres of land along the Dalton corridor in federal hands, including the 1.4 million acres. <\/p>\n<p class=\"c-paragraph sans-serif\">This decision from the federal government came without public comments or hearings in local communities, and the groups filed their lawsuit in March to stop the potential conveyances, they said in a statement Friday. <\/p>\n<p class=\"c-paragraph sans-serif\">After the lawsuit was filed, Interior issued \u201ctentative approvals\u201d to transfer the 1.4 million acres. <\/p>\n<p class=\"c-paragraph sans-serif\">\u201cAmericans deserve a transparent process when decisions of this magnitude are made \u2014 not backroom giveaways that put short-term industrial interests ahead of wildlife, Indigenous communities, and future generations,&#8221; said Andy Moderow, with the Alaska Wilderness League. <\/p>\n<p class=\"c-paragraph sans-serif\">\u201cThis decision does not erase the harm it poses to communities closest to these lands that will be forced to live with the consequences of a rushed federal action that prioritizes state takeover and extractive development over public process, Tribal sovereignty, and long-term stewardship,\u201d said Krystal Lapp, with the Northern Alaska Environmental Center. <\/p>\n<p class=\"c-paragraph sans-serif\">In his ruling, Peterson said that, \u201conce lands are tentatively approved, Alaska holds \u2018all right, title, and interest\u2019 to them,\u201d in reference to the 1.4 million acres. <\/p>\n<p class=\"c-paragraph sans-serif\">The remaining 700,000 acres has not been tentatively approved, and the Trump administration does not plan to take action on that land without an an additional request from the state, Peterson wrote. <\/p>\n<p class=\"c-paragraph sans-serif\">\u201cSovereign immunity (held by the state) bars claims that would disturb Alaska\u2019s vested interest in lands already tentatively approved for transfer, but it does not require dismissal as to lands that have not yet reached that stage of the transfer process,\u201d Peterson wrote.<\/p>\n<p class=\"c-paragraph sans-serif\"><a href=\"https:\/\/www.adn.com\/alaska-news\/crime-courts\/2026\/02\/04\/us-senate-confirms-aaron-peterson-as-alaskas-newest-federal-judge\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.adn.com\/alaska-news\/crime-courts\/2026\/02\/04\/us-senate-confirms-aaron-peterson-as-alaskas-newest-federal-judge\/\">Peterson<\/a>, a former natural resources attorney with the Alaska Department of Law, was nominated by President Donald Trump and confirmed by the Senate in February in a bipartisan 58-39 vote. <\/p>\n","protected":false},"excerpt":{"rendered":"The Gates of the Arctic National Park and Preserve, where the Ambler Road project would pass through, is&hellip;\n","protected":false},"author":2,"featured_media":790656,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[47],"tags":[192,79],"class_list":["post-790655","post","type-post","status-publish","format-standard","has-post-thumbnail","category-environment","tag-environment","tag-science"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/790655","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/comments?post=790655"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/posts\/790655\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media\/790656"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/media?parent=790655"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/categories?post=790655"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us\/wp-json\/wp\/v2\/tags?post=790655"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
