He approved the view of the crime scene over the objection of the home\u2019s current owner during pretrial proceedings. <\/p>\n
Sullivan said jurors will be allowed to visually inspect the outside of the property and the basement, where Patrick Clancy, 38, discovered the then-couple\u2019s three children \u2014 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan \u2014 strangled. They\u2019ll also view all rooms on the first floor and all rooms on the second floor. They will not be permitted to open closet doors, touch any items within the premises, or disturb any items in the home, according to the order.<\/p>\n
Duxbury police and State Police will be responsible for securing the area before jurors arrive and keeping away people not permitted access to the property, he said. Jurors will be under the supervision of police and court security.<\/p>\n
During the view, journalists and media outlets will have to remain at least 100 yards away from the premises, according to the order. Sullivan has prohibited the filming or photographing of jurors, and no person \u201cshall contact, follow, interview, or communicate\u201d with jurors prior to the jury leaving the view or \u201cotherwise harass or tamper with a juror\u201d during or after the visit, he said. <\/p>\n
After the visit to the home in Duxbury, jurors will also visit the the nearby CVS where Patrick Clancy picked up medicine for his daughter, Cora, and the restaurant ThreeV in Plymouth, where he picked up takeout for the family on the evening Lindsay Clancy allegedly killed their three children.<\/p>\n
She will not attend the viewings, said her lawyer, Kevin J. Reddington.<\/p>\n
Clancy, 35, a former labor and delivery nurse, doesn\u2019t deny that she strangled the children with exercise bands in the basement before cutting herself and jumping from a second-story window in a suicide attempt that left her paralyzed.<\/p>\n
She has pleaded not guilty to three murder counts. Reddington is mounting what\u2019s commonly known as an insanity defense, arguing his client was overmedicated as she struggled with postpartum psychosis and unable to conform her behavior to the law at the time of the children\u2019s deaths.<\/p>\n
Prosecutors contend she planned the killings by sending Patrick Clancy to a CVS to pick up medication and to get dinner at the Pymouth restaurant so she\u2019d have enough time to commit the slayings.<\/p>\n
Should jurors acquit Lindsay Clancy, she would not go free but would instead be sent to a state psychiatric facility where she would come up for periodic reviews to determine whether she can live safely in the community.<\/p>\n
During two days of wrenching testimony, Patrick Clancy said his ex-wife was suffering from postpartum depression<\/a> and anxiety and confided in December 2022 that she was having \u201cintrusive thoughts\u201d about harming the children, or of something bad happening to them. But, he said, she sought help from doctors, received in-patient psychiatric care, and \u201cwas having one of her best days\u201d on Jan. 24, 2023. Clancy said he had no inkling anything was wrong. He found all three children in the basement when he returned from the errands.<\/p>\n He was led out of the courtroom<\/a> midway through testimony Wednesday, sparing him the trauma of hearing the 911 recording of his gut-wrenching screams as he told police his wife had killed their children. After listening to the call, jurors left the courtroom for a break. Lindsay Clancy sobbed uncontrollably in her wheelchair.<\/p>\n On Thursday, first responders recounted what they saw and heard<\/a> when they arrived at the crime scene.
