{"id":796311,"date":"2026-07-31T23:10:08","date_gmt":"2026-07-31T23:10:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/796311\/"},"modified":"2026-07-31T23:10:08","modified_gmt":"2026-07-31T23:10:08","slug":"justice-department-drops-criminal-case-against-ex-olympian-charged-with-damaging-reflecting-pool","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/796311\/","title":{"rendered":"Justice Department drops criminal case against ex-Olympian charged with damaging Reflecting Pool"},"content":{"rendered":"<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">WASHINGTON \u2013 The Justice Department moved Friday to dismiss a criminal case charging a former Olympian with deliberately damaging <a href=\"https:\/\/apnews.com\/article\/reflecting-pool-drained-washington-monument-trump-repairs-0745ba52bc7273ce411ef29880f71cf0\" rel=\"nofollow noopener\" target=\"_blank\">the Lincoln Memorial Reflecting Pool<\/a>, saying evidence prosecutors had recently received refuted the idea that vandals were to blame.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">Government lawyers said in a 20-page court filing that additional documents provided by the Interior Department since the indictment of David Hearn show that the damage was the result of a botched installation by a contractor as well as \u201cthe rush to complete the project prior to events associated with the America 250 celebration in the weeks surrounding Independence Day 2026.\u201d In addition, a recent visual inspection revealed damage throughout the pool, including in the middle \u2014 where prosecutors say a vandal would not likely attempt to peel the lining.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">\u201cGiven all of this newly discovered information, it is difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt,\u201d said the filing from U.S. Attorney Jeanine Pirro.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">Hearn&#8217;s lawyers said in a statement that the case against him should never have been brought. <\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">\u201cIts dismissal today does not erase the abuse of government power in arresting and charging a patriotic American who did nothing wrong. The government\u2019s approach was ready, fire, aim. The administration owes Mr. Hearn an apology,\u201d the lawyers said.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">The dismissal marks an embarrassing setback for a Justice Department that had billed the prosecution as a measure of accountability for damage at a Washington landmark discovered in the lead-up to Fourth of July festivities in the nation&#8217;s capital. But the case has long been saddled with evidentiary problems and challenges, with Hearn and his supporters characterizing the prosecution as a politically motivated attempt by the Trump administration to deflect blame and scapegoat others.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">Earlier this week, Hearn&#8217;s lawyers sought access to <a href=\"https:\/\/apnews.com\/article\/reflecting-pool-olympian-trump-grand-jury-b2f8b76d678e09438811c3c87233d0df\" rel=\"nofollow noopener\" target=\"_blank\">grand jury transcripts<\/a> because of what they said were \u201cirregularities\u201d in the process. They said a National Park Service official testified that the pool already was damaged before Hearn allegedly touched it, couldn\u2019t quantify any damage attributable to Hearn and said the same repairs would have been required regardless of his conduct.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">\u201cThe witness\u2019s testimony established that the pool had substantial preexisting damage requiring repair before any alleged conduct by Mr. Hearn,\u201d his lawyers wrote. \u201cAccording to the witness, the pool was leaking more than one million gallons of water per week; its expansion joints had exceeded their service life; and the liner already contained a rip.\u201d<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\"><a href=\"https:\/\/apnews.com\/article\/reflecting-pool-damage-trump-david-hearn-c2f8e1d689d8cd3cd4f9aade65c674ee\" rel=\"nofollow noopener\" target=\"_blank\">Hearn pleaded not guilty<\/a> earlier this month to one felony count of property destruction and had a trial scheduled to start Sept. 28 in D.C. Superior Court. The charge, which carries a maximum prison sentence of 10 years upon conviction, accused Hearn of causing at least $1,000 in damage to the pool.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">In court papers Friday, prosecutors said they had only recently received new information that undermines the basis for the prosecution.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">\u201cIt was not until after these documents were produced that (prosecutors) first became aware of information showing that the damage was the result of a botched installation and not vandalism as initially represented\u201d by the Interior Department. Prosecutors could \u201conly rely,\u201d they wrote, on the initial information suggesting that the damage was caused by vandals.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">Hearn has <a href=\"https:\/\/apnews.com\/article\/trump-reflecting-pool-paint-algae-6b7b499ada2701a34bc6bc380013ad04\" rel=\"nofollow noopener\" target=\"_blank\">told The Associated Press<\/a> he was detained by <a href=\"https:\/\/apnews.com\/article\/reflecting-pool-trump-algae-coating-a41bbf59575f221d28e70452d0757f78\" rel=\"nofollow noopener\" target=\"_blank\">National Guard troops and U.S. Park Police<\/a> for five hours after stopping by the pool during a bike ride on June 19. He said he reached in to examine the pool\u2019s newly peeled coating and briefly touched a chunk attached to the side of the pool, but said he obeyed a park worker who told him to let go of it.<\/p>\n<p class=\"Box-_wrDxHtU__Box-sc-10sa3ie-0 Text-nO2aZ44r__TextBase-sc-s2hv5x-0 jJNfBD fSvavs article-text\">Hearn, 67, of Bethesda, Maryland, competed in three Summer Olympics, earning his best finish, ninth, at the 1996 Atlanta Olympic Games, the U.S. Olympic and Paralympic Committee says on its website.<\/p>\n<p>Copyright 2026 The Associated Press.
