lack of cooperation, lack of compliance with the rules<\/a>,\u201d district judge Joe Hardy said, via Noble Brigham of the Las Vegas Review-Journal.<\/p>\nThe NFL had complained that Gruden was dragging his feet in the discovery process associated with his lawsuit alleging that the NFL deliberately leaked otherwise confidential emails in an effort to force him out as the Raiders\u2019 head coach in October 2021.<\/p>\n
\u201cNo explanation was proffered by Gruden\u2019s side that would address the court\u2019s concern about the delays, particularly in light of months ago, when I said, in Gruden\u2019s favor and against the NFL\u2019s position, we\u2019re going forward,\u201d Judge Hardy said. \u201cGruden understandably at least represented to me that their side wanted to proceed expeditiously and has done the opposite of that.\u201d<\/p>\n
Judge Hardy partially granted a request from the league to force Gruden to produce certain documents and to provide supplemental answers to written questions within the next seven days.<\/p>\n
The NFL had argued that Gruden failed to provide information to which the league was entitled.<\/p>\n
“[T]he NFL Parties cannot defend this case with both hands tied behind their backs,\u201d the NFL\u2019s lawyers wrote. \u201cDiscovery is the mechanism by which litigants discover the truth, but Gruden does not want the truth discovered.\u201d<\/p>\n
The judge agreed with the NFL \u2014 and chastised Gruden.<\/p>\n
\u201cYou\u2019re saying you\u2019re proceeding expeditiously, but clearly you\u2019re not,\u201d Judge Hardy told Gruden\u2019s lawyers.<\/p>\n
Both sides in every civil case are entitled to obtain information from each other. The parties to lawsuits typically try to restrict what is provided. When those squabbles consume the judge\u2019s time, the judge is often not pleased.<\/p>\n
And that same judge will eventually be making fairly important decisions about the case. So it\u2019s important for both sides to avoid, speaking in the technical sense, pissing the judge off.<\/p>\n
