{"id":810719,"date":"2026-08-12T02:46:22","date_gmt":"2026-08-12T02:46:22","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/810719\/"},"modified":"2026-08-12T02:46:22","modified_gmt":"2026-08-12T02:46:22","slug":"nad-backs-force-factor-1-beet-supplement-claims","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/810719\/","title":{"rendered":"NAD backs Force Factor \u2018#1\u2019 beet supplement claims"},"content":{"rendered":"<p class=\"c-paragraph b-article-body-skinny\">The National Advertising Division has reaffirmed that unit sales remain the preferred measure for substantiating \u201c#1\u201d selling claims, siding with Force Factor in a challenge brought by rival beet supplement brand Human Power of N Company (Humann).<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">The decision leaves intact an established advertising standard at a time when the National Advertising Division (NAD) has revisited aspects of claim substantiation for dietary supplements, according to Jennifer Adams, partner at Amin Wasserman Gurnani.<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">\u201cNAD has issued some precedent shifting decisions lately for dietary supplements, but for #1 claims the substantiation requirements remain the same,\u201d Adams told NutraIngredients.<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">Human Power of N Company, which markets the Humann brand, challenged Force Factor\u2019s claims that Total Beets is \u201cAmerica\u2019s #1 Best-Selling Beets Brand,\u201d the \u201c#1 Best Selling Beets Brand in America\u201d and the \u201c#1 Beets Brand in America.\u201d<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">The challenge was brought through NAD\u2019s Fast-Track SWIFT process, an expedited review for single-issue advertising disputes.<\/p>\n<p>What counts as \u2018#1\u2019?<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">At the center of the dispute was not whether the companies could produce sales data but which sales measure should determine category leadership.<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">As detailed in NAD\u2019s <a href=\"https:\/\/bbbprograms.org\/media\/newsroom\/decisions\/force-factor\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/bbbprograms.org\/media\/newsroom\/decisions\/force-factor\">case decision<\/a>, Humann argued that dollar sales were the appropriate metric and that its brand led on that basis. Force Factor maintained that unit sales better reflected the message consumers would take from a \u201c#1\u201d claim and submitted sales data showing its lead by that measure.<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">NAD agreed with Force Factor, concluding that consumers generally understand such claims to mean a product is purchased more frequently than competitors. It found that \u201cthe record did not demonstrate that differences in product form, size, or pricing made unit sales an unreliable measure in this case,\u201d the release stated. <\/p>\n<p class=\"c-paragraph b-article-body-skinny\">\u201cThis is an interesting challenge, as NAD has well-established precedent that unit sales, not dollar sales, are the preferred metric for #1 selling claims,\u201d Adams said. <\/p>\n<p class=\"c-paragraph b-article-body-skinny\">\u201cHuman Power of N had a tall order arguing NAD should contradict its own precedent, and ultimately NAD declined to do so,\u201d she added. <\/p>\n<p class=\"c-paragraph b-article-body-skinny\">Adams noted that NAD has turned to dollar sales when unit sales distort the comparison.
