Mangione entered the guilty plea at a hearing Friday morning in Manhattan, which was abruptly scheduled this week amid reports<\/a> suggesting the suspect was likely to reach a plea deal.<\/p>\n The 28-year-old faced two federal charges for stalking related in death, which are punishable by life in prison, though the court threw out harsher murder charges that could have resulted in the death penalty (he initially pleaded not guilty to all of them).<\/p>\n Mangione\u2019s lawyers are expected to use any plea deal in federal court to try and get the suspect out of his separate trial<\/a> in New York state court, by arguing that \u201cdouble jeopardy\u201d laws should prohibit him from being tried twice for the same crime.<\/p>\n It\u2019s still unclear if that gambit will work, the Times notes, as prosecutors in New York are likely to argue his state charges\u2014which include second-degree murder\u2014are substantially different enough to still warrant a trial.<\/p>\n What to Watch for<\/p>\n Mangione\u2019s trial in state court is still set to begin with jury selection Sept. 8, though any plea in federal court is likely to lead to a flurry of requests seeking to fend off that trial. The suspect also faces a sentence of life in prison if convicted of second-degree murder at the state trial, as New York does not have the death penalty.<\/p>\n Will Mangione\u2019s State Trial Still Take Place?<\/p>\n While the U.S. Supreme Court has broadly allowed<\/a> people to be prosecuted in both state and federal court for the same crime, New York has a stronger law against \u201cdouble jeopardy\u201d prosecutions. The state generally forbids<\/a> prosecuting people twice for the same crime, but there are a few exceptions. Multiple prosecutions are allowed if each prosecution \u201ccontains an element which is not an element of the other,\u201d for instance, or if \u201cthe acts establishing one offense are in the main clearly distinguishable from those establishing the other.\u201d That means state prosecutors could try to argue that the state charges against Mangione, which include murder and possession of a weapon, are materially different from the stalking charges he pleaded guilty to in federal court. Whether or not that will be successful remains to be seen, with the Times noting<\/a> prosecutors have previously both failed and succeeded at bringing charges in the past. \u201cIt is incredibly complicated,\u201d defense attorney Paul Shechtman told the Times earlier in August about New York\u2019s law.<\/p>\n Key Background<\/p>\n Mangione was arrested in December 2024 following a dayslong manhunt, after Thompson was shot on the streets of midtown Manhattan in the early morning of Dec. 2. The suspect was arrested at a McDonald\u2019s in Altoona, Pennsylvania, and was found with an alleged \u201cmanifesto\u201d that railed against corporate greed and the U.S. healthcare industry. Mangione\u2019s case has garnered widespread attention and the suspect has attracted some support amid Americans\u2019 growing disillusionment with rising healthcare costs.
