The companies\u2019 own documentation warned that it was starting a \u201cdoom loop\u201d that would damage the web, characterized its scraping of data to train its models as the \u201clargest theft of labor in human history,\u201d and that it made a \u201ccomplete mockery of the idea of fair use.\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">Many of the most eye-catching quotes from the document come from Microsoft\u2019s Director of Applied Science, Brent Hecht. Though, the company has tried to distance itself from Hecht\u2019s assertions. Microsoft spokesperson Alex Haurek told The Verge that \u201cThese comments reflect one employee\u2019s individual perspective, are not a legal analysis, and do not represent the company\u2019s views.\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">In a separate court filing, Jordan Usdan, GM for Data Strategy and Ops at Microsoft AI, characterized Hecht\u2019s role as adversarial. He said that Hecht \u201cholds divergent, academic, and forward-looking views about how data ecosystems for AI should operate and is employed at Microsoft to bring asymmetrical, futuristic, and academic points of view \u2026 nor is he someone who speaks for Microsoft specifically as to his theoretical views on AI\u2019s potential effect on content creators.\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">But whether or not Microsoft wants to own these comments, it\u2019s clear that this came true. <a href=\"https:\/\/www.theverge.com\/podcast\/970735\/google-zero-reddit-ai-publishers-vergecast\" rel=\"nofollow noopener\" target=\"_blank\">Google Zero is real!<\/a> AI is eating the web!<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">There are plenty more wild statements in NYT\u2019s filing from a variety of figures, including Satya Nadella, Sam Altman, and other OpenAI employees. Here are some highlights from the 92 page document.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">\u201cAn astonishing theft\u201d<\/p>\n<p><a class=\"_1pegheu1\" href=\"https:\/\/platform.theverge.com\/wp-content\/uploads\/sites\/2\/2026\/09\/Screenshot-2026-09-18-at-12.47.37-PM.png?quality=90&amp;strip=all&amp;crop=0,0,100,100\" data-pswp-height=\"888\" data-pswp-width=\"1840\" target=\"_blank\" rel=\"noreferrer nofollow noopener\"><img alt=\"This case is about, as Microsoft\u2019s Director of Applied Science [Brent Hecht] put it, \u201can astonishing theft of unprecedented proportions\u201d; SF1437, perhaps the \u201clargest theft of labor in human history.\u201dSF1652. Defendants repeatedly copied millions of Plaintiffs\u2019 copyrighted articles in their entiretywithout permission to produce substitutive commercial AI products. OpenAI\u2019s Head of ChatGPTwrote that \u201c[p]ublishers\u201d face an \u201cexistential threat\u201d from those products, SF1466, which, he said,\u201care largely substitutive, period\u201d and \u201cwill get more and more substitutive as they get better.\u201dSF1473-74. Such admissions eviscerate Defendants\u2019 \u201cfair use\u201d defense because substitution is\u201ccopyright\u2019s b\u00eate noire.\u201d Andy Warhol Foundation for the Visual Arts, Inc. v. Hecht calls ChatGPT and Copilot\u2019s harvesting of data the \u201clargest theft of labor in human history\u201d and says that Microsoft\u2019s defense makes a \u201ccomplete mockery of the idea of \u2018fair use.\u2019\u201d<\/p>\n<p><a class=\"_1pegheu1\" href=\"https:\/\/platform.theverge.com\/wp-content\/uploads\/sites\/2\/2026\/09\/doom-loop.png?quality=90&amp;strip=all&amp;crop=0,0,100,100\" data-pswp-height=\"452\" data-pswp-width=\"1322\" target=\"_blank\" rel=\"noreferrer nofollow noopener\"><img alt=\"Microsoft\u2019s CEO Satya Nadella agreed under oath that conversing with chatbots \u201chassubstituted \u2026 giving you the information right there on the website on the AI platform versusneeding to go to the underlying source.\u201d SF1432. OpenAI cofounder Greg Brockman is more interested in the \u201cgazillions\u201d of dollars it he could potentially make through commercial AI.<\/p>\n<p><a class=\"_1pegheu1\" href=\"https:\/\/platform.theverge.com\/wp-content\/uploads\/sites\/2\/2026\/09\/paywall.png?quality=90&amp;strip=all&amp;crop=0,0,100,100\" data-pswp-height=\"322\" data-pswp-width=\"1584\" target=\"_blank\" rel=\"noreferrer nofollow noopener\"><img alt=\"Individuals within OpenAI and Microsoft ignored such issues as circumventing paywallsand violating terms of use when acquiring data. good at regurgitation.\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">The filing then goes on to cite several examples of ChatGPT outputting long strings of copy straight from articles in the Times, Mercury News, The Denver Post, LifeHacker, and Eurogamer in response to queries.<\/p>\n<p
