{"id":859405,"date":"2026-09-24T21:18:18","date_gmt":"2026-09-24T21:18:18","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/859405\/"},"modified":"2026-09-24T21:18:18","modified_gmt":"2026-09-24T21:18:18","slug":"new-jersey-fines-data-center-1-1m-after-drone-pics-expose-62-gas-generators","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/859405\/","title":{"rendered":"New Jersey fines data center $1.1M after drone pics expose 62 gas generators"},"content":{"rendered":"<p>This week, New Jersey <a href=\"https:\/\/dep.nj.gov\/newsrel\/26_0044\/\" rel=\"nofollow noopener\" target=\"_blank\">ordered<\/a> the operator of one of the East Coast\u2019s largest planned data centers to pay a $1.1 million fine for secretly installing and operating gas generators in violation of the state\u2019s Air Pollution Control Act.<\/p>\n<p>DataOne got hit with the fine after an <a href=\"https:\/\/floodlightnews.org\/new-jersey-data-center-federal-violation\/\" rel=\"nofollow noopener\" target=\"_blank\">investigation<\/a> by The Guardian and Floodlight News in August shared thermal drone footage showing that 45 of the 62 gas generators were operating. None of the generators had permits required for generators with 37-kilowatt capacity or higher, despite running at 1,982-kw capacities more than 50 times higher than the state limit.<\/p>\n<p>States track gas generators like DataOne uses because they emit \u201ccarbon dioxide, nitrogen oxides, carbon monoxide, and other combustion-related pollutants,\u201d officials from New Jersey\u2019s Department of Environmental Protection (DEP) noted. Those pollutants can worsen asthma, trigger heart attacks, and cause early deaths.<\/p>\n<p>Calling out the enforcement action as \u201cby far the largest ever taken against a data center in New Jersey,\u201d DEP Commissioner Ed Potosnak vowed that data centers would not be \u201cconstructed or operated with impunity in this state.\u201d<\/p>\n<p>However, while historic, the state\u2019s solution doesn\u2019t immediately relieve residents\u2019 concerns. DataOne was given 45 days to apply for the permits or else cease operations, but they can continue operating the gas engines while seeking permits. Nichole Gardner, a co-chair of a local environmental nonprofit Sustain SJ, told Ars that \u201cwe believe it is insufficient, both in dollar amount and enforcement. The DataOne site should be made to discontinue operations during the 45-day period until the proper permits are issued.\u201d<\/p>\n<p>In a <a href=\"https:\/\/www.nytimes.com\/2026\/09\/23\/nyregion\/data-center-pollution-new-jersey.html\" rel=\"nofollow noopener\" target=\"_blank\">statement to The New York Times<\/a>, the company seemed unfazed by the fine.<\/p>\n<p>\u201cWe will apply for the air permits for the temporary generators,\u201d a DataOne spokesperson said, while noting that DataOne \u201cdisagreed\u201d with the fine.
