{"id":864967,"date":"2026-09-29T17:56:20","date_gmt":"2026-09-29T17:56:20","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/864967\/"},"modified":"2026-09-29T17:56:20","modified_gmt":"2026-09-29T17:56:20","slug":"house-panel-accuses-ny-of-flouting-law-by-ignoring-fraud-risk-to-medicaid-providers","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/864967\/","title":{"rendered":"House panel accuses NY of flouting law by ignoring fraud risk to Medicaid providers"},"content":{"rendered":"<p>WASHINGTON \u2014 A House committee has accused New York of flouting federal law by failing to identify \u201crisk levels\u201d of Medicaid service providers that could be defrauding the taxpayer-funded program, according to a new report.<\/p>\n<p>The House Energy and Commerce Committee has been <a href=\"https:\/\/nypost.com\/2026\/06\/18\/us-news\/ny-calif-medicaid-directors-among-four-to-appear-for-house-fraud-hearing\/\" rel=\"nofollow noopener\" target=\"_blank\">probing New York<\/a> and <a href=\"https:\/\/nypost.com\/2026\/03\/05\/us-news\/house-expands-medicaid-fraud-probe-to-10-states-to-combat-rampant-waste-new-york-and-california-on-notice\/\" rel=\"nofollow noopener\" target=\"_blank\">nine other states<\/a> for potential fraud in the distribution of Medicaid or Medicare funding and concluded in a Tuesday report that the Empire State was \u201cnot complying with federal law by designating provider risk levels\u201d for some of its state-level programs.<\/p>\n<p>\u201cNew York\u2019s counsel later disclosed to the Committee that it does not designate categorical risk levels of all Medicaid-only providers,\u201d the 87-page report from the Republican-led panel found.<\/p>\n<p>Amir Bassiri, Medicaid Director at the New York State Department of Health, is pictured in the New York City metropolitan area. Amir Bassiri \/ Linkedin<\/p>\n<p>\u201cOnly recently did New York begin the process of elevating the three provider types that it does designate by risk level to the high risk category,\u201d the report also noted. \u201cIt is deeply concerning that the nation\u2019s second largest Medicaid program, which spent nearly $98.2 billion in FY 2024 and $12,528 per enrollee per year in FY 2023, is not complying with federal regulations.\u201d<\/p>\n<p>The Energy and Commerce Committee claimed that the Empire State, in response to the House investigation, ended up pausing enrollment for a six-month period in some programs such as home health care agencies, adult day cares and applied behavioral analysis, among others.<\/p>\n<p>It\u2019s unclear exactly how much taxpayer funding may have been diverted for fraudulent purposes, though Centers for Medicare and Medicaid Services Administrator Dr. Mehmet Oz has been <a href=\"https:\/\/nypost.com\/2026\/03\/03\/us-news\/dr-oz-launches-fraud-probe-of-nys-124b-medicaid-program\/\" rel=\"nofollow noopener\" target=\"_blank\">probing New York\u2019s system<\/a>.<\/p>\n<p>Medicaid spending currently makes up the largest category of state budgets, with 30.7% set aside on average in funding for the programs, the House report added.<\/p>\n<p>\u201cEvery dollar stolen from Medicare and Medicaid is a dollar taken from the seniors, children, pregnant women, and Americans with disabilities these programs were created to serve,\u201d Committee Chairman Brett Guthrie (R-Ky.) said in a statement.<\/p>\n<p>\u201cOur findings expose the worst actors, but the accompanying recommendations also lay out commonsense steps to help CMS and the states stop fraud before it happens. William Farrington for NY Post<\/p>\n<p>Even before those lapses, however, several state programs were experiencing surges in their Medicaid budgets.<\/p>\n<p>The report cited California\u2019s Medi-Cal spending as spiking from $83 billion annually in 2014 to $219.7 billion by 2027.<\/p>\n<p>The committee found that non-emergency medical transportation, adult day care, applied behavioral analysis, treatment for substance use disorders as well as home and community based services were all \u201cexperiencing high rates of fraud.\u201d<\/p>\n<p>\u201cThe Oversight and Investigations Subcommittee is focused on rooting out fraud that threatens the future of Medicare and Medicaid,\u201d said Rep. USA TODAY Network via Reuters Connect<\/p>\n<p>\u201cStates have rapidly expanded benefits under HCBS Section 1915(c) waivers, resulting in skyrocketing program costs and leaving Medicaid vulnerable to fraud without proper programmatic safeguards,\u201d the report noted.<\/p>\n<p>Also, \u201chospice, home health care services, DME [durable medical equipment], and genetic testing\u201d have all been flagged for \u201celevated fraud activity\u201d in Medicare programs too, per the report.<\/p>\n<p>\u201cThe Oversight and Investigations Subcommittee is focused on rooting out fraud that threatens the future of Medicare and Medicaid,\u201d said Rep. Protecting the integrity of these programs must be a shared goal, because millions of Americans are counting on us to get it right.\u201d\u00a0<\/p>\n<p>The findings are similar to the fraud, waste and abuse uncovered by Vice President JD Vance\u2019s task force.<\/p>\n<p>So far, the White House anti-fraud task force has identified $96.4 billion in fraudulently obtained funding from HHS programs \u2014 and halted $46.2 billion from being improperly distributed.<\/p>\n<p>Another $33.1 billion has been recovered by the Trump administration.<\/p>\n<p>Reps for New York Gov.
