(KATU) \u2014 An employee failed to wear gloves while giving a customer a set of acrylic nails, and the customer got herpes, according to a lawsuit filed Monday in Multnomah County Court. <\/p>\n<p>According to court documents, a 31-year-old Multnomah County woman went to PDX Nails on Northeast Glisan Street for a walk-in appointment in August of 2025.<\/p>\n<p>During the acrylic nails treatment, a drill bit and other implements were used, along with a hand massage using lotion or oil. The following day, the woman began to experience an unusual burning and stinging sensation on her right hand and pinky.<\/p>\n<p>A day after that she had an itchy fluid-filled blister on her hand.<\/p>\n<p>According to the lawsuit, when she went to the doctor 11 days after the procedure, they collected samples and told her they believes the infection was caused by Herpes Simplex Virus 2.<\/p>\n<p>She was warned she could get more blisters, and a follow-up test in September 2025 confirmed the infection was herpes. There is no cure for that strain of herpes, and the woman must continue to monitor outbreaks.<\/p>\n<p>The lawsuit contends that the woman did not have herpes prior to getting her nails done.<\/p>\n<p>READ MORE | <a href=\"https:\/\/katu.com\/news\/local\/washington-revises-foster-licensing-rules-after-settlement-on-religion-lgbtq-children-religious-beliefs-gay-lesbian-bisexual-transgender-gender-identity-youths-identity-pronouns-given-name-deadname-conservative-christian-foster-parent\" target=\"_blank\" rel=\"nofollow noopener\">Washington revises foster licensing rules after lawsuit on religion and LGBTQ+ children<\/a><\/p>\n<p>It also alleges that a state investigation found in 2021 that PDX Nails was failing to disinfect used tools, specifically &#8220;used drill bits at the workstation.&#8221; <\/p>\n<p>The investigation also found the company was failing to properly clean foot spa equipment.<\/p>\n<p>The lawsuit was filed by Attorney Amity Girt and is seeking  $2.5 million in damages.<\/p>\n<p>The suit names PDX Nails LLC along with the Oregon Health Authority  and Health Licensing Office.<\/p>\n<p>The suit alleges the state put other customers at risk by failing to suspend revoke or decline to issue a renewal license to PDX Nails after another infection was reported in 2023.<\/p>\n<p>Girt is the same attorney who sued PDX Nails in 2024 for nearly $2 million, alleging a very similar problem.<\/p>\n<p>A different woman went to the same location in 2023 for a manicure and noticed infection and inflammation and was diagnosed with the same herpes strain.<\/p>\n<p>The case was dismissed in 2025  due to a confidential settlement according to court records. <\/p>\n<p>The Oregon Health Authority responded by saying they cannot comment on pending litigation.<\/p>\n<p>PDX Nails has not responded with a statement to the lawsuit.<\/p>\n","protected":false},"excerpt":{"rendered":"PORTLAND, Ore.
