{"id":902575,"date":"2026-11-01T22:24:12","date_gmt":"2026-11-01T22:24:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/902575\/"},"modified":"2026-11-01T22:24:12","modified_gmt":"2026-11-01T22:24:12","slug":"legal-privilege-survives-challenge-in-jackie-os-employment-dispute","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/902575\/","title":{"rendered":"Legal privilege survives challenge in Jackie O\u2019s employment dispute"},"content":{"rendered":"<p class=\"p1\">Material relating to an investigation into Jackie O\u2019s on-air clash with co-host Kyle Sandilands has featured in a Federal Court dispute over legal professional privilege claims.<\/p>\n<p class=\"p1\">Justice Ian Jackman has refused a bid by Jacqueline Ellen Henderson, known professionally as Jackie O, to access 810 confidential documents held by the Commonwealth Broadcasting Corporation (CBC) and ARN Media.<\/p>\n<p class=\"p1\">Likewise, CBC and ARN Media were unable to convince the court to overturn legal professional privilege over a letter sent by Henderson\u2019s solicitor and four sets of text messages between Henderson and her agent in February and March.<\/p>\n<p class=\"p1\">Some of the text exchanges occurred the day before Henderson instructed her solicitors to send a complaint letter, which the ARN parties argued involved a waiver of her instructions.<\/p>\n<p class=\"p1\">In a submission to the Federal Court, Henderson said the purpose of the letter was to \u201cmake clear that Sandilands\u2019 conduct was something that had been an issue in the past, which I wanted the respondents to be aware of\u201d.<\/p>\n<p class=\"p1\">\u201cI do not regard that evidence as putting into question the contents of Henderson\u2019s confidential communications with [her agent, Gemma] O\u2019Neill,\u201d Justice Jackman said.<\/p>\n<p class=\"p1\">\u201cIn any event, having read the documents in question, they do not concern Henderson\u2019s purpose in sending the complaint letter.\u201d<\/p>\n<p class=\"p1\">The letter from Henderson\u2019s solicitor was \u201cplainly confidential\u201d.<\/p>\n<p class=\"p1\">The 800-plus documents from the ARN Group were split into what chief legal officer and company secretary Jeremy Child described as \u201cbuckets\u201d: those concerning the notice to produce;
