SAN JOSE – A man died after he was hit by a motorist Tuesday night as he walked across West Capitol Expressway, police said.
The collision was reported at 8:56 p.m. An initial investigation by San Jose police determined that a man driving a black 2018 Tesla sedan was traveling east just past Copperfield Drive when he hit a pedestrian, who died at the scene.
The man’s name was not publicly released pending his formal identification and notification of his next of kin by the Santa Clara County Medical Examiner-Coroner’s Office.
The Tesla driver stopped after the collision and spoke to traffic investigators. Afterward, police said he and two minors riding in his vehicle were taken to a hospital for treatment of what were described only as non-life threatening injuries.
There was no indication from police that the driver was cited or arrested, or whether the vehicle was using self-driving technology at the time of the crash. Police noted in a news release Wednesday that the deceased man was not in a marked crosswalk when the collision occurred, but in California street crossings outside of marked crosswalks are legal if they seemingly can be completed safely.
Tuesday night’s collision marked the city’s 25th traffic death of the year and the 11th to involve a pedestrian who died. San Jose recorded 15 traffic deaths, seven involving pedestrians, at the same point in 2025, according to data compiled by this news organization.
