SAN JOSE – An athletic trainer at Archbishop Mitty High School was arrested last week on suspicion of sexually battering a 16-year-old student and filming the incident, police said.
The incident was reported around 7:30 p.m. on Oct. 8, San Jose police Officer Tanya Hernandez said in a news release Wednesday.
The victim told officers the suspect was “providing care for her sports-related injury when he sexually battered her and recorded it on his cellphone,” Hernandez said.
Detectives identified the suspect as Kelvin Chiu, 31, of Fremont.
Chiu was taken into custody Oct. 9 in Fremont, Hernandez said, adding that detectives searched Chiu’s home and found child sexual abuse material on his cellphone.
Hernandez said Chiu was arrested on suspicion of crimes related to annoying or molesting a minor, production and possession of CSAM, and sexual battery. He was booked into Santa Clara County jail.
The school was notified and is fully cooperating with the investigation, Hernandez said.
Archbishop Mitty spokesperson Cynthia Shaw said Chiu has worked at the school for the past year. The school immediately placed him on administrative leave after it was notified.
“Our first concern is for the student and family, and for all of our students and families,” Shaw said. “We recognize the impact a situation of this nature may have on our students, and the school’s counseling teams will be available to speak with students who may need additional support.”
Due to Chiu’s position of trust, detectives believe there may be additional victims, Hernandez said.
